Common use of Annual Leave Exclusive of Public Holidays Clause in Contracts

Annual Leave Exclusive of Public Holidays. 6.1.2.1 The annual leave prescribed by this Clause is exclusive of any public holiday as prescribed in Clause 7.6. If any such holiday falls within an employee's period of annual leave, the period of leave will be increased by one day for each Public Holiday, if; (a) the holiday is observed on a day which the employee would have normally been working and (b) the employee commences work at the employee’s ordinary starting time on the employee’s working day immediately following the last day of the employee’s annual leave, or provides proof of reasonable cause for absence on that day.

Annual Leave Exclusive of Public Holidays. 6.1.2.1 40.2.1 The annual leave prescribed by this Clause is in 40.1, shall be exclusive of any public holiday as of the holidays prescribed in Clause 7.6. If by clause 56 - Public holidays, and if any such holiday falls within an employee's ’s period of annual leave, the period of leave will be increased by one day for each Public Holiday, if; (a) the holiday and is observed on a day which in the case of that employee would have been an ordinary working day there shall be added to the period of annual leave time equivalent to the ordinary time which the employee would have normally worked if such day had not been working and (b) the employee commences work at the employee’s ordinary starting time on the employee’s working day immediately following the last day of the employee’s annual leave, or provides proof of reasonable cause for absence on that daya holiday.

Annual Leave Exclusive of Public Holidays. 6.1.2.1 26.2.1 The annual leave prescribed by this Clause is exclusive of any public holiday as prescribed in Clause 7.625. If any such holiday falls within an employee's period of annual leave, the period of leave will be increased by one day for each Public Holiday, if; (a) the holiday is observed on a day which the employee would have normally been working and (b) the employee commences work at the employee’s ordinary starting time on the employee’s working day immediately following the last day of the employee’s annual leave, or provides proof of reasonable cause for absence on that day.

If clause 31 - Public holidays and if any such holiday falls within an employee's employee‟s period of annual leave, the period of leave will be increased by one day for each Public Holiday, if; (a) the holiday and is observed on a day on which in the case of an employee would have been an ordinary working day there shall be added to the period of annual leave time equivalent to the ordinary time which the employee would have normally worked if such day had not been working and (b) the employee commences work at the employee’s ordinary starting time on the employee’s working day immediately following the last day of the employee’s annual leave, or provides proof of reasonable cause for absence on that daya holiday.
