Archeological Sites. If, during the course of operations, any physical remains of historic, archaeological, or paleontological nature are discovered, work in that immediate vicinity must cease and the State must be notified. The Alaskan Historic Preservation Act prohibits the appropriation, excavation, removal, injury, or destruction of any historic, prehistoric or archaeological resources of the State.

Archeological Sites. Lessee shall ensure that no archaeological sites or objects of antiquity on the Leased Property are disturbed, altered, damaged or vandalized by any means, including but not limited to digging, probing or deliberately plowing or cultivating such sites for the express purpose of exposing artifacts or archaeological sites or other objects of antiquity. Lessee will ensure that no state or federal laws pertaining to cultural resources and/or human burials on the Leased Property are violated. Willful violation or disregard of such laws by the Lessee will result in immediate termination of the Lease.
Archeological Sites. In the event any unanticipated sites or remains such as shell, bone or charcoal deposits, human burials, rock or coral alignments, pavings, or walls are found on the Premises, Lessee and Lessee’s agents, employees and representatives shall immediately stop all land utilization and/or work and contact the Hawaii State Historic Preservation Division (SHPD) at 587-0047 in compliance with Chapter 6E, Hawaii Revised Statutes as the same may be amended.

Attachment – S5 STATE OF HAWAII SPECIAL CONDITIONS SC-29 INADVERTENT DISCOVERY OF HUMAN BURIALS Although not expected, in the event human burials are inadvertently discovered, the CONTRACTOR shall immediately stop work in the vicinity of the burial and contact the following parties and agencies immediately: State Historic Preservation Division, the Construction Manager, the Consultant, the Office of Hawaiian Affairs, Xxx Xxxxxx I Na Kupuna 'O Hawai'i Nei, and the Kauai Island Burial Council. The burial and the area in its vicinity shall be protected until DHHL has been advised of the proper Native American Xxxxxx Protection and Repatriation Act of 1990 (NAGPRA) process for burial treatment to undertake and until the selected NAGPRA process has been concluded. DHHL shall provide the CONTRACTOR with a Supplemental Agreement for additional time added to the CONTRACTOR’s performance schedule for the mitigation of any inadvertent discovery of human remains.

Monuments and Markers. The Purchaser must protect all known land survey monuments and witness trees and markers from damage or obliteration. If monuments or markers are destroyed, the PURCHASER must pay the costs of restoration. No painted, blazed or tagged tree which marks the boundary of the sale area or cutting units may be cut unless approved in writing by the State. The PURCHASER must pay the STATE stipulated damages of $100.00 for each boundary tree and leave tree that is cut or damaged, as determined by the Forester-in-Charge. Assessed damages are not limited to the bond amount.
