AUTHORIZATION FOR DUES. In accordance with the requirements of Section 4117.09 (B) (2) of the Ohio Revised Code, upon presentation of a written deduction authorization by the employee, the College shall deduct from the pay due such employee, and turn over to the proper officers of the Lodge, regular monthly Lodge dues, initiation fees, and assessments payable by him or her to the Lodge, during the period provided for in said authorization. The Lodge shall indemnify the College against any and all claims, demands, suits, or other forms of liability that shall arise out of or by reason of action taken or not taken by the College for the purpose of complying with the provisions of this Article. As a consequence of the decision in Janus v. AFSCME, Council 31, et al. (decided June 27, 2018), the College and the Lodge have agreed to remove prior provisions pertaining to the payment of fair share fees by non-members; and, the College and Lodge agree that fair share fees may no longer be deducted from non-members’ pay. The College and the Lodge agree further that, in the event there are changes in the law that permit the collection of fees or other financial support from non-members of the Lodge through payroll deduction, the Lodge and the College shall enter into good faith negotiations to address whether to permit the collection of such fees and/or financial support though payroll deduction.

AUTHORIZATION FOR DUES. Authorization for the deduction of monthly dues and/or initiation fees shall become effective on the first full pay period occurring following the completion of the probationary period. Anixter Center shall not be required, under the terms of this Article, to make any deductions from paychecks of employees, which are prohibited by any present or future law which may become effective during the term of this Agreement.

The Employer’s obligations to make deductions shall terminate automatically upon termination of employment, lay off from work, unpaid leave of absence, transfer of an employee to a job classification outside the bargaining unit, or submission to the employer of a signed employee revocation of dues authorization. The Employer is acting solely in a ministerial function. Copies of employee’s dues checkoff authorization cards are available from the Union upon request. With voluntary written authorization from the employee, the College will deduct from the employee’s pay amounts charged by the Union for grievance representation and arbitration costs, if allowable by law. The written authorization will identify the amount and duration of the deduction. The Union shall indemnify the College against any and all claims, demands, suits, or other forms of liability that shall arise out of or by reason of action taken or not taken by the College for the purpose of complying with the provisions of this Article.
