AWARD OR REJECTION OF BIDS. The Bid will be awarded to the lowest responsible bidder complying with conditions of the invitation for bids, provided his bid is reasonable and it is in the interest of the City of Fairhope to accept it. The bidder to whom the award is made will be notified at the earliest possible date. The City of Fairhope, however, reserves the right to reject any and all bids and to waiver any informality in bids received whenever such rejection or waiver is in the interest to the City of Fairhope.
AWARD OR REJECTION OF BIDS. 1.10.1 The CONTRACT will be awarded to the lowest responsible BIDDER determined from the Base Bid, plus any combination of Bid Alternates that GILBERT may select, which comply with these instructions and with the Notice and Call for Bids. GILBERT, however, reserves the right to accept or reject any or all bids, to waive any informality or irregularity in the bids received or to withhold the AWARD for any reason GILBERT determines. Bids will be received until the time and date designated in the Notice and Call for Bids. Bids received after the designated time set will be returned to the BIDDERS unopened.
1.10.2 Bids shall be opened in public and the amount of the bid read aloud. After the bid opening, GILBERT shall analyze the bids and notify all BIDDERS of the name of the apparent low bidder or (2) if the analysis results in a recommendation to award the CONTRACT to a BIDDER other than the apparent low BIDDER, the BIDDER who’s recommended for award of the CONTRACT. This will be done by issuing a NOTICE OF APPARENT LOWEST RESPONSIBLE BIDDER. Such notice shall be given at least four (4) days prior to the date set for the AWARD of the CONTRACT.
AWARD OR REJECTION OF BIDS a. The basis of award shall be the lowest responsible bidder submitting a responsive bid that conforms to the specifications established in the solicitation with consideration given to the quantities involved, time required for delivery, purpose for which required, competency and responsibility of bidder, the ability of the bidder to perform satisfactory service, and the plan for utilization of minority contractors, if applicable.
b. WCPS reserves the right to determine completeness and/or timeliness of bids, to reject any or all bids in whole or in part, to make partial awards, to waive any informality in any quotation, to increase or decrease quantities if quantities are listed in the bid, to reject any bid that shows any omissions, alterations of form, additions not called for, conditions, or alternate proposals, and to make any such award as is deemed to be in its best interest.
c. Bidders may be required, before the awarding of a contract, to show to the complete satisfaction of WCPS, that they have the necessary facilities, ability, and financial resources to execute the contract in a satisfactory manner, and within the time specified. Bidders may be required to demonstrate they have the necessary experience, history, and references to assure WCPS of their qualifications.
d. The Board of Education of Washington County reserves the right to award the bid within 90 days from the date of the bid opening unless a different time period is stated in the bid document.
e. Unless stated otherwise in Section II, the contract may be awarded by line item, group, or in the aggregate, whichever is in the best interest of WCPS.
f. In the event of a tie, where all other factors, such as past performance, are considered comparable, the award shall be made to the Washington County based bidder; the closest Maryland out-of-county based bidder; and the closest out-of-state based bidder, in that order of preference.
g. WCPS does not have local, state or federal preference requirements except when mandated by a targeted funding source.
h. If, after competitive sealed bids have been opened, the Purchasing Manager determines that only one responsible bidder has submitted a responsive bid, the procurement contract may be negotiated with that one bidder as sole source procurement.
i. A recommendation for the award of a contract will be presented to the Board of Education of Washington County for approval. Upon approval of the award of contract, the bidder(s) shall be notified...

The Owner, however, reserves the right to reject any and all bids and to waiver any informality in bids received whenever such rejection or waiver is in the interest of the Owner. It also reserves the right to reject the bid of a bidder who has previously failed to perform properly or complete on time contracts of a similar nature, or a bid of a bidder who is not, in the judgment of the Owner, in a position to perform the Contract.
12.02 Local vendors, within the city limits of the City of Fairhope, will have a 5% favorable allowance if bid is greater than the bid of the lowest responsible bidder.

In determining responsibility the following qualifications, in addition to price will be considered by the Purchasing Agent
(a) The ability, capacity and skill of the bidder to perform the service required within the specified time.
(b) The character, integrity, reputation, judgment, experience and efficiency of the bidder.
(c) The quality of performance of previous contracts or services.
(d) The previous and existing compliance by the bidder with laws and ordinances relating to previous contacts with the City and to the bidders employment practices.
(e) The sufficiency of the financial resources and ability of the bidder to perform the contract or provide the services.
(f) The quality, availability and adaptability of the supplies, or contractual services to the particular use required.
(g) The ability of the bidder to provide future maintenance and service for the use of the subject of the contract.
(h) Whether the bidder is in arrears to the City in debt on contract or is a defaulter on surety to the City or whether the bidder’s taxes or assessments are delinquent.
(i) The resale value of the subject of the contract.
(j) Such other information as may be secured by the Purchasing Agent having a bearing on the decision to make the award. In determining a bidder’s responsiveness, the Purchasing Agent shall consider material deviations from the advertised specifications which materially affect price, quantity, quality or limit the bidder’s liability.
AWARD OR REJECTION OF BIDS. A. The contract, if awarded, will be awarded to the responsible and responsive bidders who have best complied with the qualifications described in 1.3, and has the highest point score as described in 1.7.
B. The bid will be awarded subject to the Owner's right to reject any or all bids and to waive informality and irregularity in the bids and in the procedure. The result of this bid will allow UF to enter into a contract with a pool of Contractors to provide minor plumbing construction services over the contract period. Each project will have a value of less than $200,000.00.
C. After award, it will be up to the discretion of the University which of the awarded Contractors will be selected to quote individual projects under this contract. Award does not guarantee work.

In determining responsibility, the following other qualifications, in addition to price, will be considered by the Director of Purchasing:
a. The ability, capacity and skill of the bidder to perform the service required.
b. Whether the bidder can perform the contract or provide the service promptly, or within the time specified, without delay or interference.
c. The character, integrity, reputation, judgment, experience and efficiency of the bidder.
d. The quality of performance of previous contracts or services.
e. The previous and existing compliance by the bidder with laws and ordinances relating to the contract or service.
f. The sufficiency of the financial resources and ability of the bidder to perform the contract or provide the service.
g. The quality, availability and adaptability of the supplies, or services, to the particular use required.
h. The ability of the bidder to provide future maintenance and service for the use of the subject of the contract.
i. Whether the bidder is in arrears to the City on a debt or contract or is a defaulter on surety to the City, or whether the bidder's taxes or assessments are delinquent.
j. Such other information as may be required or secured.

The bid will be awarded based on the responses utilizing the evaluation percentages as noted on page 20., too the most responsible bidder complying with the conditions of the Invitation for Bids, provided their bid is reasonable and it is to the interest of the ASD to accept it. The bidder to whom the award is made will be notified at the earliest possible date. The ASD, however, reserves the right to reject any and all bids and to waive any informality in bids received, and to accept any bid whenever such rejection, waiver or acceptance is in the interest of the ASD. The ASD also reserves the right to reject the bid of a bidder who has previously failed to perform properly or complete on time contracts of a similar nature, or a bid of a bidder who is not in a position to perform the contract. To better ensure fair competition, and to permit a determination of the lowest bidder, bids obviously unbalanced may be rejected by the ASD at its discretion. Bid security equal to 5% of the awarded BID will be required for this contract.
