BID EVALUATIONThe Commissioner reserves the right to accept or reject any and all Bids, or separable portions of Bids, and waive technicalities, irregularities, and omissions if the Commissioner determines the best interests of the State will be served. The Commissioner, in his/her sole discretion, may accept or reject illegible, incomplete or vague Bids and his/her decision shall be final. A conditional or revocable Bid which clearly communicates the terms or limitations of acceptance may be considered, and Contract award may be made in compliance with the Bidder’s conditional or revocable terms in the Bid.

BID EVALUATIONThe Professional shall attend one (1) bid-opening conference to be administered by NBU’s Purchasing Department. The Professional shall assist NBU in analyzing the bids received for the Project, which includes researching contractor qualifications and references. The Professional shall recommend award of contract or other actions as appropriate to be taken by NBU in the form of a letter of recommendation.
BID EVALUATION. Bid offer shall be evaluated by the submitted percent discount off the most recently published manufacturer’s price list.

BID EVALUATION. All Bids received shall be evaluated using the following three (3) procedures: a) Bid Document Evaluation - the submitted Bid is compared to the requirements found herein and in the Bid Document for Bid form and content. Failure to meet any of the requirements specified in the Bid Document may result in disqualification of the Bid. b) Bid Specification Evaluation - the submitted Bid is compared to the specification in the Bid Document. Failure to meet any of the requirements specified in the Bid Document may result in disqualification of the Bid.
BID EVALUATION. 16.2.1 The Bids shall be evaluated based on the criteria mentioned above. In case a bidder fails to meet the above mentioned qualification criteria, their bids shall be treated as non- responsive and financial bids of such bidders shall not be opened. 16.2.2 A substantially responsive bid is one that conforms to all the terms, conditions, and specifications of the bidding document without material deviation or reservation. A material deviation or reservation is one: (a) that affects in any substantial way the scope, quality, or performance of the Works; (b) that limits in any substantial way, inconsistent with the bidding documents, the Employer’s rights or the bidder’s obligations under the contract; or (c) whose rectification would affect unfairly the competitive position of other bidders presenting substantially responsive bids. Further, a bid will not be considered substantially responsive if the bidder has not offered to undertake all the items of the work as listed in Bill of Quantity no. (BoQ) -1 to 3 of section V of bid document. 16.2.3 The estimated effect of the price adjustment provisions of the Conditions of Contract, applied over the period of execution of the Contract, shall not be taken into account while evaluating bids. 16.2.4 The lowest priced bidder i.e. L-1 shall be chosen separately for the 3 Stretches based on the amount quoted by the bidders in each BoQ (1 to 3) of Section V. For avoidance of doubt it is clarified that bidder who has quoted the lowest for the Stretch in BoQ 1 shall be considered for award of that Stretch. Similarly for Stretch 2 and Stretch 3, the bidder with lowest quote in BoQ 2 and BoQ 3 respectively, shall be considered for award of those Stretches. In case a bidder’s quote, for all the Stretches’ put together i.e. aggregate sum of all the BoQ’s, turns out to be the lowest though the bidder is not L-1 in individual BoQ, then in such case also the methodology stipulated above shall be adopted and such bidder shall not be considered for award of work. 16.2.5 If the bid, which results in the lowest Evaluated Bid Price, is seriously unbalanced or front loaded as compared to the estimate of the items of work to be performed under the Contract, the bidder shall be asked to produce detailed price analyses for any or all items of the Bill of Quantities, to demonstrate the internal consistency of those prices with the construction methods and operating methodology proposed. BID EVALUATIONThe Construction Manager in cooperation with Architect shall assist the District in pre-qualification, the bid opening, evaluation of the bids for completeness, full responsiveness and price, including alternate prices and unit prices (if applicable), shall make a formal report to the District with regard to the potential award of a Contract, shall receive bids, prepare bids. The Construction Manager shall include a copy of the proposed Contract for each bidder recommended by the Construction Manager. If applicable, the summary of bids shall classify all bids according to SAB cost allowance categories. When a bid includes work in more than one cost category, the summary shall assign an appropriate amount to each. Construction Manager shall certify in writing that the Contracts contained in the submittal for the District represents all the contracts required to perform the work in the plans and specifications for the Project, and that no additional contracts are foreseen to complete the necessary work for such Project. In the event the contracts and the work deferred for the future does not represent 100% of the work and/or exceeds the SAB’s standards (if applicable), the additional necessary work shall be offset by a reduction in the Construction Manager’s fees.

In the event the contracts and the work deferred for the future do not represent 100% of the work, Construction Manager shall be responsible for providing all the construction management services necessary to complete the work that was not included in the initial Contract submittal at no additional cost to the District. In no event shall Construction Manager be entitled to additional compensation or general conditions costs for performing construction management services that are necessary to complete work that was not included in the initial Contracts submittal prepared by the Construction Manager.
BID EVALUATION. Bids will be evaluated in conformance with the New Jersey Local Lands and Buildings Law. The BOROUGH reserves the discretion to make an award, if any. All Bidders must demonstrate that they have the financial resources, experience, expertise, personnel, equipment, permits and physical capability to perform through the submission of information required with the Bid as described in the Contract Documents. In evaluating Bids, the BOROUGH will consider the qualifications of the Bidders, whether or not the Bids comply with the prescribed requirements, and such prices and other data, as may be requested in the Contract Documents. The BOROUGH reserves the right to reject any Bid if the evidence submitted by, or investigation of, a Bidder fails to satisfy the BOROUGH that such Bidder is properly qualified to carry out the obligations of the Contract Documents and to provide the services contemplated therein.
