Charter School. Public schools of choice which operate under a performance contract, or a “charter,” in accordance with Section 1002.33, F.S. Class Size Reduction: Florida Constitutional amendment creating class size limits for teacher to pupil ratios for core educational instruction, as implemented by the Florida legislature. Comprehensive Plan: A plan that meets the requirements of Section 163.3177 F.S. Concurrency Service Area (CSA): A geographic unit adopted by the School Board and local governments within which the level-of-service standard is measured when a School Impact Analysis (SIA) is undertaken by the School Board for a residential development. Within Brevard County the CSA’s are coincident with the school attendance boundaries at each school level (elementary, middle, high school). Concurrency Evaluation and Finding of Nondeficiency (CEFoN) or equivalent: Once the School Board has issued a School Capacity Determination Letter (SCADL) confirming the existence of FISH Capacity, the local government may issue a CEFoN, or equivalent, and the FISH Capacity for the development is reserved or vested for that development for the life of the CEFoN. Consistency: Compatible with and furthering the goals, objectives and policies of the Comprehensive Plan Elements and this Agreement.
Charter School. An alternative public school authorized pursuant to Section 1002.33, Florida Statutes. The school is built to meet the State Requirements for Educational Facilities standards when used as a Proportionate Share Mitigation Option and is operated by a not-for-profit entity, under a charter with the local school district.
Charter School. In a new charter school’s first year of operation, at the conclusion of the application period, if the applications for students do not exceed the slots available, students applying during the application period shall be admitted. If the total number of eligible applicants exceeds the capacity of a program, class, grade level, or school, admission to the program, class, grade level, or school shall be based on an admissions lottery conducted from among the total number of eligible applicants. If the percentage of at-risk applicants, as defined herein, does not exceed the required percentage of at-risk students to be enrolled in the charter school, then the BOARD may take action as described in Exhibit E.
Charter School. A charter school, chartered through one of the local governing boards or the SELPA that operates as its own LEA for special education purposes, shall be assigned to a region for representation on the Program Advisory Council (PAC). Responsibilities of the Program Advisory Council • Advise the SELPA Director and the SELPA Governing Board regarding the status, accomplishments and needs of special education programs operated within the Local Education Agencies. • Provide technical advice and assistance to the SELPA Director and the SELPA Governing Board. • Work cooperatively to plan and coordinate educational programs and services for all individuals with exceptional needs within the SELPA. • Provide leadership and support in the implementation of SELPA policies and procedures. • Act as liaison with parents, community resources, other Local Education Agencies, the SELPA Director and the SELPA Governing Board. • Xxxxxx, interpret, and report data regarding the implementation, administration and operation of the Local Plan. • Advise the SELPA Director of the annual program needs of the Local Plan Area to be considered in the development of the annual budget plan. • Provide the SELPA Director with information relative to the development of the annual service plan. • Recommend staff development activities for the SELPA. • Recommend members for the Community Advisory Committee (CAC). • Recommend policies and procedures to the SELPA Governing Board. A charter school that has been approved to operate as an LEA for special education purposes shall be included in the Community Advisory Committee (CAC) in the same manner as other LEAs. Finance Advisory Council Note: All regions will agree on a procedure and criteria that the regional representative will use to make decisions for his/her region. The Finance Advisory Council (FAC) is made up of the chief school business officers or designee from each Region. The Finance Advisory Council (FAC) makes recommendations to the SELPA Director and/or SELPA Governing Board regarding fiscal issues related to special education funding, facilities and review of the fiscal allocation of special education funds. FAC will collaborate with the Program Advisory Committee (PAC) as needed. A quorum will consist of four voting members in attendance. Charter School shall promptly pay to District the Pro Rata Share on the first day of each month in advance during the Term of the Agreement, without deduction, setoff, prior notice or demand.

Recommended Practice in Conducting Lottery During the First Year of Operation: • Separate applications by grade level. • For each grade level, draw names until all slots have been filled. • If there are more names for a given grade than slots available, continue to pull names and add such names to the Charter School’s waitlist in order as pulled. It is important to note that in subsequent years (Year 2 and thereafter), all charter schools must: • Provide all previously enrolled students (e.g. students that attended the Charter School during its first year of operation) the right to continue to attend the Charter School, provided that the Charter School serves the grade level in which the student should be enrolled. • Give lottery preferences to siblings of students already enrolled in the charter school.
Charter School. Charter School s abandonment of the Premises for a period of fifteen (15) consecutive days (with or without the payment of fees), it being agreed that the fact that any of Charter School’s property remains in the Premises shall not be evidence that Charter School has not vacated or abandoned the Premises; provided, however, any normal holidays or vacation days shall not constitute abandonment of the Premises. A move by Charter School to provide only virtual instruction as a result of Charter School students’ or employees’ quarantine due to exposure to, or infection with, COVID-19 or pursuant to local or state public health guidance or order shall not be deemed abandonment for purposes of this Paragraph (19.1.4).
