City of Galveston. Galveston shall be responsible for providing or securing transportation for a maximum of 1200 individuals seeking transportation to and from Austin during a mandatory evacuation, including the families of the bus drivers. Galveston will use its best efforts to provide bus transportation at the shelter location(s) to assist in transporting individuals within the City of Austin. Transported individuals will be allowed to bring pets, subject to certain conditions. Galveston will use its best efforts to require and/or provide animal carriers and animal supplies. Galveston agrees that the sheltering is for general population evacuees, which may include evacuees with medical and functional needs. Galveston does not intend to transport individuals requiring care in an institutional setting or in a medical shelter to Austin under this Agreement. Galveston will, with assistance from the State of Texas 2-1-1 Registry Program, be responsible for collecting data and identifying individuals who seek transportation, including those individuals with medical needs, and will be responsible for loading passengers onto buses at their pre-designated pickup points. Galveston will provide travel supplies, which will consist of snacks, water, and toiletries, if necessary. Galveston, in collaboration with Galveston County, will provide triage of evacuees prior to departure from the departure hub and will provide for the necessary transportation of evacuees’ medical supplies and equipment. Galveston does not anticipate sending individuals with known medical needs. Galveston also will provide City employees to accompany evacuees to Austin and to assist at the shelter(s). City staff support to be provided by Galveston will be commensurate with the evacuee population, at the ratio of no less than one staff person per 50 evacuees. Galveston will ensure that at least one City employee shall ride on each bus or other vehicle transport that is transporting evacuees to or from Austin under this Agreement. Galveston will not transport for sheltering under this Agreement individuals requiring extensive medical oversight or individuals receiving care in an institutional setting. City of Galveston. 1. As part of its consideration for this project, the City of Galveston will convey to Texas A&M its right-of-way or other interests it has in the existing Seawolf Parkway between Gti Boulevard and the terminus of the Pelican Island Bridge upon completion and opening of the new bridge contemplated by this MOU and upon passage of a City Ordinance recognizing such roadway is no longer needed to meet the transportation needs of the citizens of the City; however, the City will retain or establish all necessary utility easements in that portion of the roadway to be conveyed to Texas A&M. 2. The City agrees to contribute $6.0 million to the Project in support of the total local funding participation with $5.0 million in support of the total initial funding and another $1M should costs exceed all other available funding. This funding will come to the City via agreement with its Industrial Development Corporation and other current revenue sources. 3. Upon the completion of the Project, the City of Galveston agrees to be the sole owner of the new Pelican Island Bridge and will provide routine maintenance and operation of the new bridge as well as the road through the Texas A&M Galveston campus connecting the Pelican Island Bridge to Seawolf Parkway. The City of Galveston agrees to be the local government sponsor for future off-system maintenance and rehabilitation funding requests, as applicable, to TxDOT.

The City will be the applicant and owner for all insurance claims and requests for federal or state assistance. The City will be the recipient of all proceeds from insurance, FEMA, or any other body offering assistance. The City is responsible for management of all disaster recovery projects. Though the City will make its best efforts to complete any disaster repair and recovery in a swift and timely manner, the City will not be responsible for the cancellation of games or any other events.

  • Joint Funded Project with the Ohio Department of Transportation In the event that the Recipient does not have contracting authority over project engineering, construction, or right-of-way, the Recipient and the OPWC hereby assign certain responsibilities to the Ohio Department of Transportation, an authorized representative of the State of Ohio. Notwithstanding Sections 4, 6(a), 6(b), 6(c), and 7 of the Project Agreement, Recipient hereby acknowledges that upon notification by the Ohio Department of Transportation, all payments for eligible project costs will be disbursed by the Grantor directly to the Ohio Department of Transportation. A Memorandum of Funds issued by the Ohio Department of Transportation shall be used to certify the estimated project costs. Upon receipt of a Memorandum of Funds from the Ohio Department of Transportation, the OPWC shall transfer funds directly to the Ohio Department of Transportation via an Intra- State Transfer Voucher. The amount or amounts transferred shall be determined by applying the Participation Percentages defined in Appendix D to those eligible project costs within the Memorandum of Funds. In the event that the Project Scope is for right-of-way only, notwithstanding Appendix D, the OPWC shall pay for 100% of the right-of-way costs not to exceed the total financial assistance provided in Appendix C.

  • PREVAILING WAGE RATES - PUBLIC WORKS AND BUILDING SERVICES CONTRACTS If any portion of work being Bid is subject to the prevailing wage rate provisions of the Labor Law, the following shall apply:

  • Area of Mutual Interest The “ Xxxxxx Well #1” leases and any new lease to be acquired under this agreement, identified within the legal descriptions above, shall be designated as an Area of Mutual Interest (“AMI”) which shall expire on the termination of this Agreement. If any party hereunder acquires any interest within the AMI, the acquiring party will notify the non-acquiring party in writing of the terms of the acquisition and any costs and/or obligations incurred pursuant thereto within fifteen (15) days following the acquisition. The non-acquiring party will elect in writing within thirty (30) days from its receipt of such notice, as to its election to participate or not participate with its proportionate share of the acquisition. Each non-acquiring party’s election to participate will be accompanied by payment of its share of costs associated with the acquisition. If the non-acquiring party elects not to participate with its proportionate share of the acquisition, the acquiring party may retain the interest for its own benefit. The non-acquiring party’s failure to respond and make payment within the designated time frame shall be deemed an election not to participate in the acquisition. If the interest acquired covers lands lying partially inside and partially outside the boundaries of the AMI, the acquiring party shall offer the entirety of such interest to the non-acquiring party. If a non-acquiring party acquires its proportionate share of such interest, the lands lying outside the AMI and covered by the interest acquired, shall become a part of the “ Xxxxxx Well # 1” Lease and any new lease to be acquired subject to this Agreement and the AMI shall be enlarged to include said lands. Each lease, right, title or interest acquired under the terms of this AMI shall be subject solely to the burdens specified in this agreement and shall include specifically the carried working Interest specified in herein above. The prospect needs to be evaluated by Purchaser’s verification efforts with the understanding that a certain amount of risk is involved in the search and joint venture of oil production in this field despite third party geological reports and efforts by Seller to determine that there are economic quantities of oil to be produced from the “Xxxxxx Lease” lease or any new lease to be acquired under this agreement. Seller does not normally deal with individuals or companies who are not other oil companies or experienced service contractors or sophisticated investors, and it is understood all parties have experience in the oil and gas industry or understand the risks associated with doing business within that industry. Seller acquired the property but has no first-hand experience and was relying on the Operator to finalize the start-up and maintain the property, sell was acquired for investment property.
