Contingent Reopener Sample Clauses

Contingent Reopener. Salary schedules, stipends, and benefits for a given year may be reopened by the Association for negotiations in either of the following events: (1) the present salary limitation laws are voided as applied to the District by a final and binding court order; or (2) the legislature removes or eases the present salary and benefit limitation laws found in RCW 28A.400.200.

Contingent Reopener. Salaries, stipends, and benefits may be reopened by the Association or District for negotiations in any of the following events: (a) the present salary and benefit limitation laws are voided as applied to the District by a final and binding court order; or (b) the Legislature or administrative agencies remove the present salary limitations as applied to the District; or (c) the Legislature increases funding for salaries or benefits which are not automatically passed through according to other provisions of this Agreement; or (d) the Legislature decreases funding for salaries or benefits; or (e) the Legislature increases or decreases local levy authority resulting in an increase or decrease of in local revenue; or (f) levy failure; or (g) increase or decrease of funding based on changes in regionalization.
Contingent Reopener. In the event the Legislature repeals the Salary Limits of a final and binding court order is entered voiding the Salary Limits as applied to the District, the District and the Association will reopen negotiations upon the written request of the Association solely in regard to the current salary schedule. Such notice must be given within thirty (30) calendar days of the date on which the legislative repeal becomes effective or the court order becomes final.

Contingent Reopener. In the event the Legislature authorizes and funds additional State 28 monies to the District, or reduces State monies to the District for salary increases or 29 decreases (as the case may be) for certificated, non-supervisory employees, the District 30 and Association will reopen this section for negotiations for the purpose of distributing 31 such additional monies or allocating such reductions. 32
