Control Committee. Architectural Control Committee" means that committee consisting of the Developer during the Development and Sales Period and during the first construction of any dwelling or condominium site improvement upon any Unit and thereafter that committee consisting of at least three persons established pursuant to the Condominium Bylaws for the purpose of reviewing proposed house plans to determine compliance with the Master Deed.
Control Committee. The Board shall establish an Architectural Control Committee to consist of three (3) persons, all of whom shall be appointed by and shall serve at the discretion of the Board. Members of the Committee may include persons who are not Members of the Association. Members of the Committee may or may not be members of the Board. During the Development Period, the Developer shall have all of the powers and authority of the Committee.
Control Committee. An Architectural Control Committee (the “Committee”) shall be appointed by the Board, at its discretion. If no Committee is appointed, the Board shall serve as the Committee. No residence, building, fence, wall, or other structure shall be commenced upon any lot or on any properties in Glendower Court, nor shall any exterior addition, change or alteration, be made, until the plans and specifications showing the nature, kind, shape, height, colors, materials, and location of the same shall have been submitted to, and approved in writing by, the Committee as to harmony of external design, location in relation to surrounding structures and topography, and consistency or acceptability in relation to the then prevailing norms for such construction, addition, change, or alteration in the Glendower Court subdivision.
Control Committee. An Architectural Control Committee (the “Committee”) composed of at least three (3) Lot Owners shall appointed by the Board of Directors and may be, but need not be, members of the Board of Directors. The exception to this is that the Chair of the Committee must be a Board member. Committee members shall be subject to removal by the Board upon a majority vote at any time, with or without cause, and any vacancies from time to time shall be filled by appointment of the Board. At the Board’s discretion, the Board may serve as the Committee. Subject to these Covenants, the Committee shall regulate the external design, appearance, use, location and maintenance of Lots and improvements thereon in such a manner as to preserve and enhance values and maintain a harmonious relationship among structures and the natural vegetation and topography, and in keeping with the intent of the provisions of these Covenants.
Control Committee. Except for construction or development by, for or under contract with the Declarant, and except for any improvements to any lot or to the common areas accomplished by the Declarant concurrently with said construction and development, and except for purposes of proper maintenance and repair, no building, fence, wall or other improvements or structures shall be commenced, directed, placed, moved, altered or maintained upon The Property, nor shall any exterior addition to or change (including any change of color) or other alteration thereupon be xxxx until the complete plans and specifications showing the location, nature, shape, height, material, color, type of construction and any other proposed form of change (including, without limitation ,any other information specified by the Architectural Control Committee) shall have been submitted to and approved in writing as to safety, harmony of external design, color and location in relation to surrounding structures and topography and conformity with the design concept for the community by an Architectural Control Committee designated by the Board of Directors.
Control Committee. 4.1 An Architectural Control Committee (the “Committee”) shall be appointed by the Board, at its discretion. If no Committee is appointed, the Board shall serve as the Committee. No residence, building, fence, wall, or other structure shall be commenced upon any lot or on any properties in Glendower Court, nor shall any exterior addition, change or alteration, be made, until the plans and specifications showing the nature, kind, shape, height, colors, materials, and location of the same shall have been submitted to, and approved in writing by, the Committee as to harmony of external design, location in relation to surrounding structures and topography, and consistency or acceptability in relation to the then prevailing norms for such construction, addition, change, or alteration in the Glendower Court subdivision.
4.2 Neither the Committee nor the Association shall be held responsible for any loss or damage, or be liable in any way whatsoever for any errors or defects, which may or may not be shown on plans and specifications submitted to the Committee for approval, or in any building or structure erected in accordance with such plans and specifications or otherwise.
4.3 Notwithstanding anything else herein to the contrary, the Committee shall have the right, power, and authority to approve a variation or modification from any restrictions contained in this Declaration including those restrictions applicable to the architectural or landscape design of any lot, when in the opinion of the Committee such modification or variation shall be appropriate and shall not detract from the quality or attractiveness of the property, or when unusual characteristics of a lot (such as shape or topography) or other circumstances warrant a variation. Such authorization must be requested in writing and must be approved in writing by the Board.
Control Committee. The sign shall be fabricated and installed by a commercial sign contractor. The sign shall be subject to Landlord's reasonable approval as to design, color, method of illumination and method of attachment. EXHIBIT I TO LEASE JANITORIAL SPECIFICATIONS -------------------------
Control Committee. No building or structure shall be erected, placed or altered on any lot until the construction plans and specifications and a plan showing the location of such building or structure shall have been approved by the Architectural Control Committee as to the quality of workmanship and materials, harmony of external design with existing structures, and as to location with respect to topography and finished grade elevation. The Architectural Control Committee shall be composed of the President and Secretary of Holiday Hills, Inc., a Michigan corporation. Provided, that in the absence or inability to serve on the part of either the President or Secretary, any other officer of Holiday Hills, Inc., may serve as a member during such absence or inability to serve. Provided, further, that the Architectural control Committee shall have the power to designate a representative or agent to act for said committee. No member of the committee or its designated representative or agent shall be entitled to any compensation for services performed pursuant to this covenant. At any time hereafter. Holiday Hills, Inc., (now turned over to North Holidya and Lake Hills Assoc. LLC) and any ten or more record title owners of anj lots shall have the power through a duly recorded written instrument to change the membership of the committee or to change, alter or amend the power and duties of said committee. The committee's approval or disapproval of a-proposed building or structure as required in this covenant shall be in writing. In the event the committee or its designated representatives fails to approve or disapprove within thirty (30) days after plans and specifications have been submitted to it, or in any event, if no suit to enjoin the construction has been commenced prior to the completion thereof, approval will not be required and these covenants shall be deemed to have been complied with.
Control Committee. The Architectural Control Committee is composed of Xxx Xxxxxx, Xxxx Xxxxxx and Xxxx Xxxxxx. A majority of the committee may designate a representative to act for them in the event of the death or resignation of any member of the committee; the remaining members shall have full authority to designate a successor. Neither the members of the committee nor its designated representative shall be entitled to nay compensation for services performed pursuant to this covenant. After all of the lots have been sold by the grantor the record owners of a majority of the lots shall have the power to change the membership of the committee or to withdraw from or restore to the committee any of its powers and duties.
Control Committee. The Architectural Control Committee shall constitute a standing committee of the Association. The ACC shall consist of the Board unless the Board delegates to other Persons the authority to serve on the ACC. At all times, however, at least one member of the ACC shall be also be a Board member. The ACC shall have the authority to select and employ professional consultants to assist it in discharging its duties, the cost of such consultants to be paid by the Owner of any Lot for which plans and specifications have been submitted for approval. The Owner of any such Lot shall be responsible for paying the full costs of each review, whether or not submitted plans and specifications are approved by the ACC, and the ACC may require payment of all such costs prior to approval of plans and specifications. The ACC also may charge reasonable fees to cover the cost of review or inspections performed hereunder, and any such fees shall be published in the design standards.
