Delivery and Playback. Pursuant to a Subscriber Transaction on the Licensed Digital Service, the Customer must select to Electronically Download and/or Stream a copy of the VOD Program from the Licensed Digital Service.

Delivery and Playback. An Approved Device must be Registered to an Account at the time the Subscriber requests delivery (and in order to receive such delivery) of an Included Program via the applicable Approved Delivery or Approved IP Delivery to such Approved Device. Pursuant to a Subscriber Transaction, subject to the limit set forth in paragraph (i) above, Licensee may permit a Subscriber to have an Included Program active on (i.e., viewable on) no more than one (1) Approved Device per Subscriber Transaction. To this end, the Subscriber must select either to Electronically Download a copy of the Included Program to one (1) Approved Device or to Stream a copy of the Included Program to one (1) Approved Device. For the avoidance of doubt, the Subscriber may not Stream the Included Program if he selects the option to Electronically Download, or vice versa until such time as Licensee is able to enforce the same Viewing Period for both Electronically Download and Streaming. [XXX: Is this ok?] If the Subscriber elects to Electronically Download the Included Program onto an Approved Device, the file for such Included Program shall be deleted and/or rendered inaccessible upon the earliest of (a) the end of such Included Program’s Viewing Period and (b) the day thirty (30) days after such Included Program was initially delivered. If the Subscriber elects to Stream the Included Program onto an Approved Device, such Included Program may be Streamed to such device solely during the Viewing Period for viewing on such device. In order to initiate a Stream of an Included Program, the Subscriber must be authenticated into his Account. EachWith respect to a specific Included Program each Account may only have one active authenticated user session at a time. [XXX: Is this ok?] Included Programs may be securely output from Approved Devices to an associated television set, video monitor or display device solely within a local area network within a private residence in compliance with the requirements of Schedule B. For the avoidance of doubt, the output functionality set forth in the immediately preceding sentence refers only to a Subscriber’s ability to stream Included Programs within a Subscriber’s home network which is distinct from the term “Streaming” as defined in this Agreement.

If the Customer elects to Electronically Download the VOD Program, the Customer shall be permitted to Electronically Download the VOD Program to any and all of such Customer’s Domain Devices via the Approved Digital Delivery Means, and shall be authorized to view such VOD Program on each such Domain Device an unlimited number of times solely within the VOD Viewing Period, subject to the Retention Restriction. “Retention Restriction” shall mean the requirement that a VOD Program be (i) simultaneously deleted from all of the Customer’s Domain Devices upon the expiration of the License Period for such VOD Program and (ii) rendered inaccessible with respect to each Subscriber Transaction for such VOD Program on all of the Customer’s Domain Devices upon 48-hours after the Customer initially commences viewing such VOD Program (i.e., immediately after the Customer exhausts any Preview rights with respect to such VOD Program) (for the avoidance of doubt, nothing herein prohibits a Customer from completing multiple Subscriber Transactions for any single VOD Program during its License Period on such Customer’s Domain Devices). For the avoidance of doubt, the 48-hour period referred to in the Retention Restriction begins from the first viewing of the applicable program on the Account and not on an individual device by device basis (by way of example and not in limitation, if with respect to a Subscriber Transaction of a VOD Program on the Licensed Digital Service, a Customer begins the initial viewing of the VOD Program on Domain Device #1 and stops viewing on such device to restart viewing the same VOD Program on Domain Device #2, the 48-hour period shall be deemed to have begun at the time of the initial viewing on Registered Device #1).
Delivery and Playback. An Approved Device must be registered to an Account at the time the SVOD Customer requests delivery (and in order to receive such delivery) of a SVOD Included Program via the applicable Approved Transmission Means to such device. Pursuant to a SVOD Customer Transaction, Licensee may permit a SVOD Customer to have the SVOD Included Program active on (i.e., viewable on) on up to three (3) Approved Devices per SVOD Customer Transaction, subject to Clause xi below. In order to initiate a Stream of a SVOD Included Program, the SVOD Customer must be authenticated into his Account. Each Account may only have three (3) active authenticated user sessions at any one time. SVOD Included Programs may be securely streamed from Approved Devices to an associated television set, video monitor or display device solely within a local area network within a private residence in compliance with the Content Protection Requirements and Obligations set forth in Schedule B. For the avoidance of doubt, the streaming functionality set forth in the immediately preceding sentence refers only to a SVOD Customer’s ability to stream SVOD Included Programs within a SVOD Customer’s home network which is distinct from the term “Streaming” as defined in this Agreement. This does not limit Sky’s ability to stream or download from its own servers to Customer devices outside their homes.   • Delivery and Risk of Loss Buyer’s production schedules and warranties to its customers are dependent upon the agreement that deliveries of the goods covered by this Purchase Order will occur on the required delivery dates shown on the face hereof. Therefore, time is of the essence. Seller shall be responsible for all damages of any kind incurred or suffered by Buyer which were caused by any delay of Seller in making deliveries of acceptable supplies. Xxxxxx agrees to notify Xxxxx immediately if at any time it appears that Seller may not meet the delivery schedule. Such notification shall include the reasons for the delay, actual or potential, the steps being taken to remedy the constraint and the schedule or a proposed waiver of the delivery schedule in the Purchase Order. Any assistance furnished by Buyer to overcome delays shall not be regarded as waiving Buyer’s remedies for default, including termination rights, if Seller fails to meet the contractual schedule. Unauthorized advance shipments and shipments other than for the quantity ordered are returnable at Seller’s expense. Identification of the goods under Section 2-501 of the Uniform Commercial Code shall occur at the moment Seller accepts this Purchase Order. Seller shall not be excused from performing its obligations hereunder if the goods identified are destroyed. Delivery shall not be deemed complete until the goods have been actually received by Buyer at its facility. The risk of loss and damage in transit shall be upon Seller and shall not pass to Buyer until received at Buyer’s facility in a condition in accordance with the terms of this Purchase Order. The cost of all return shipments shall be borne by Seller.

  • Technical Bulletins A Technical Bulletin (TB) will be used to explain updated processes, provisions or monitoring requirements as Florida Housing receives updates, clarification and additional guidance with respect to the CRF funds. TBs will also be used to clarify, discuss, interpret, and provide guidance for contract administration issues related to this Agreement. TBs will be posted at xxxxx://xxx.xxxxxxxxxxxxxx.xxx/about-florida-housing/florida- housing's-coronavirus-relief-fund, and Grantee is encouraged to regularly check for TBs.

  • Delivery Terms All products sent to Customer shall be sent EX Works (EXW) or FCA Company’s facility in El Cajon, CA, and in domestic packing. Customer will bear and pay for all taxes of any nature imposed prior to, at the time of, or after delivery to, the carrier at the EXW point. Customer shall also bear and pay for all charges for freight, shipping, consular fees, customs duties, and all costs and charges. Customer must return the equipment in the same shipping container it was received in.
