Designated Biologist Clause Samples
The Designated Biologist clause identifies a specific individual or entity responsible for overseeing and ensuring compliance with environmental or wildlife-related requirements within a project. Designated Biologist. Permittee shall submit to CDFW in writing the name, qualifications, business address, and contact information for Designated Biologist three
Designated Biologist. A Designated Biologist shall be on site to monitor all activities that result in the clearing or grading of sensitive habitat as well as grading, excavation, and/or other ground-disturbing activities within the project area. The monitor shall: 1) ensure that the limits of grading, grubbing, crushing or other ground-disturbing activities are delineated at the site as shown on the construction drawings and the maps submitted in the notification; 2) perform necessary surveys and take photographs during the construction process, as required by this Agreement; 3) Implement measures from the Biological Resources Construction Plan (BRCP) (Condition 2.7) approved by CDFW and U.S. Fish and Wildlife Service if California gnatcatcher are identified; 4) halt construction activities if any threatened or endangered species other than California gnatcatcher are identified and notify the appropriate agencies immediately; and 5) notify the project owner and CDFW of any non-compliance with this Agreement.
Designated Biologist. At least thirty (30) business days before initiating ground- or vegetation-disturbing activities, Permittee shall submit to CDFW in writing the name, qualifications, business address, and contact information for a biological monitor (Designated Biologist). Permittee shall obtain CDFW’s written approval of the Designated Biologist prior to the commencement of project activities. The Designated Biologist shall be knowledgeable and experienced in the biology and natural history of local fish and wildlife resources present at the project site and have the necessary handling permits. The Designated Biologist shall be responsible for monitoring all project activities, including construction and any ground- or vegetation-disturbing activities in areas subject to this Agreement. The Designated Biologist shall be responsible for observing bird activity and any newly active nests. Permittee shall not enter into any agreement or contract of any kind, including but not limited to non-disclosure agreements and confidentiality agreements, with the Designated Biologist that prohibit or impede open communication with CDFW, including but not limited to providing CDFW staff with the results of any surveys, reports, or studies or notifying CDFW of any non- compliance or take. Permittee shall notify CDFW in writing if a substitute Designated Biologist is selected or identified at any time during the term of this Agreement.
Designated Biologist. At least 30 days prior to initiation of pre- construction surveys, the Permittee shall submit to CDFW for approval the name, resume, and contact information of the Designated Biologist performing the surveys and monitoring the project activities.

Designated Biologist. Permittee shall submit to CDFW in writing the name, qualifications, business address, and contact information for Designated Biologist. The Designated Biologist is an individual experienced with construction level biological monitoring and who is able to recognize species in the project area and who is familiar with the habits and behavior of those species. The Designated Biologist shall have academic and professional experience in biological sciences and related resource management activities as it pertains to this project. Permittee shall obtain CDFW’s written approval of the Designated Biologist prior to conducting pre-project surveys. In addition, the Permittee’s Inspector shall monitor and inspect implementation of the contractor’s Best Management Practices (exclusionary devices, wildlife protection measures, etc.) included in the Project Plans, specifications, and permits. The Inspector shall defer to the Designated Biologist regarding all issues pertaining to vegetation, fish, and wildlife resources.
Designated Biologist. No less than sixty (60) days prior to bridge demolition, the Permittee shall submit to CDFW in writing the name, qualifications, business address, and contact information for a Designated Biologist. Permittee shall obtain CDFW’s written approval of the Designated Biologist prior to the commencement of project activities. The Designated Biologist shall be knowledgeable and experienced in the biology and natural history of local biological resources present at the project site. The Designated Biologist shall be responsible for monitoring all project activities, avoidance measures, including any ground-disturbing activities in areas subject to this Agreement. The Designated Biologist shall submit daily reports while instream work, stream bank excavations, concrete pouring, animal exclusion/relocation, or when other activities occur that may impact biological resources.
Designated Biologist. At least 60 days prior to commencement of Project activities, including construction or site preparation, Permittee shall submit to CDFW for review and approval the names, qualifications, business addresses, and contact information of any qualified biologists (Designated Biologists) that will be utilized to conduct species/habitat surveys, biological monitoring, or mitigation planning and implementation activities. The Designated Biologist shall be knowledgeable and experienced in the biology and natural history of local fish and wildlife resources present at the Project site including least ▇▇▇▇’▇ vireo, Santa ▇▇▇ sucker, and bats. Permittee shall specify the proposed responsibilities of each Designated Biologist and provide clear evidence that the Designated Biologist is knowledgeable, experienced, and capable of performing those proposed duties.
Designated Biologist. At least 30 days before initiating ground disturbance activities, Permittee shall obtain the CDFW's written approval for a Designated Biologist (See Reporting Measure 3.3). The Designated Biologist will be on site during initial ground disturbance activities. The Designated Biologist shall be on-call for the project during all construction activities. At minimum, weekly monitoring visits will occur throughout the construction season to ensure avoidance and minimization measures are being properly implemented
