Duration of Memorandum. The Memorandum of Understanding will take effect from the date of its signature and shall continue for three years unless it is terminated by the giving of three months' notice by either Party. It may be extended on mutual agreement of both Parties. Upon termination, both Parties agree that the termination shall not affect the validity and duration of any arrangements, activities or projects unless mutually agreed, in writing, between both Parties.
Duration of Memorandum. The specific modifications in this document shall be made applicable on the dates indicated upon the approval of the Board of Directors; and these modifications relating to wages, hours and conditions of employment shall remain unchanged for the period of January 1st 2020 through December 31st 2022 unless such changes are the result of mutual agreement.

The effect of the Memorandum shall be extended automatically to another fiscal year, unless a written objection is issued either by NII or by USER more than one month before the expiration date of the Memorandum. If the term is not renewed, after expiration of the term, USER shall promptly delete DATA from any computer or media onto which it has been copied. In addition, if Representative or the affiliation of Representative is changed, USER shall report the change to NII without delay and, if necessary, shall sign another Memorandum.

The terms and conditions of this MOU shall prevail over conflicting provisions of the Newport Beach City Charter, the ordinances, resolutions and policies of the City of Newport Beach, and federal and state statutes, rules and regulations which either specifically provide that agreements such as this prevail, confer rights which may be waived by any collective bargaining agreement, or are, pursuant to decisional or statutory law, superseded by the provisions of an agreement similar to this MOU.

Negotiations for a successor agreement shall commence in March 2014.

Duration of Memorandum. In order to deliver sustainable waste management on the scale required, long- term investment will be necessary. This investment must be matched by a firm commitment to abide by the terms of this agreement, the subsequent IAA and to deliver the Strategy. Therefore, the terms of the MOU will reflect the duration of any contractual arrangement entered into between the MWDA and the service provider to deliver the Strategy. This is anticipated to be for a period of 25 years effective from October 2008. In order to support the Strategy procurement timescale, and demonstrate commitment to delivering the Strategy, it is anticipated that this MOU will be ratified by all Partners before the end of June 2005 or preferably sooner. Following ratification, the Partners will work towards developing a more detailed IAA to be agreed before the end of December 2005.
Duration of Memorandum. The terms of this MOU are to remain in full force and effect beginning July 1, 2014 through December 31, 2017.
