Duties of the State. In discharging its obligations under this contract, and in addition to the obligations set forth in other parts of this contract, the Department shall perform the following duties:
Duties of the State. (a) The State agrees to perform the obligations as set forth in Exhibit 1.
(b) The State agrees to pay to Contractor at the rates set forth in Exhibit 2, Pricing and Payment Terms, in exchange for Contractor's performance of its obligations under this Agreement. Exhibit 2 is attached hereto and incorporated herein.
Duties of the State. 5.1 The STATE shall pay NAMED for ICF/DD services provided pursuant to Section 6 of this Contract.
5.2 The STATE shall coordinate the activities of its various licensing and certification entities to eliminate redundant regulatory requirements in its oversight of ICF/DD operations.

Duties of the State and the MCO include:
(A) The STATE shall provide the MCO on a monthly basis with data extracts containing monthly Recipient Waiver Obligation amounts for the MCO’s Enrollees for the past thirty-six (36) months. The MCO shall reduce payments it makes to Providers of EW services by the amount indicated on the STATE files, and shall notify Providers of the amounts attributed to the Waiver Obligation.
(B) The MCO must reconcile Waiver Obligation changes and assure that they are communicated to Providers. The MCO shall make adjustments to the payment made to the EW Provider when a change in the waiver obligation amount is reported on the data extract from that State. A Waiver Obligation may not be deducted until the service is provided. The Enrollee is not obligated to pay the full amount of the Waiver Obligation each month if the services are not utilized.
(C) The MCO may delegate the billing and collection of the Waiver Obligation of Enrollees to its EW service Providers.
Duties of the State. A. State is responsible for any extraordinary maintenance, betterment, construction, or reconstruction on the Trunk Highways and bridges described in Section I, Paragraph A. If State desires City to perform any such work, the parties must enter into a separate agreement or Master Contract Work Order therefore. Extraordinary maintenance, betterment, construction, or reconstruction includes, but is not limited to, seal coat, overlay of the roadway surface, mill and overlay of the roadway surface, replacement and repair of guardrail and attenuators, replacement and repair of drainage structures and culverts which require excavation, major washout repairs and lifecycle replacement of state owned signs for retro-reflectivity.
B. State will retain its authority to administer, issue, and regulate access permits, sign advertising permits, drainage permits, and permits to install new utilities on the Trunk Highways described in Section I, Paragraph A.
C. For the State owned bridges referenced in Exhibit B, the State shall be responsible for all bridge safety inspections and associated reporting into the Pontis Bridge Inspection System, thus the City will not be responsible for the structural integrity of these bridges, routine maintenance with the exception of yearly flushing and duties addressed as City responsibilities in other sections of this agreement (i.e. Snow and Ice and Sweeping).
D. Maintain the pavement markings on trunk highways. June 2017 4
E. Attractive Roadsides: Perform routine maintenance of vegetation and landscaping, including necessary and regular mowing, tree trimming, diseased tree removal, and litter or debris collection and disposal within the Trunk Highway right-of-way per current state policy.
