Early Entry into Premises. Provided that the existing occupant of the Premises has vacated and surrendered the Premises, Tenant may enter into the Premises upon receipt of Landlord's consent, solely for the purpose of and, subject to Tenant's compliance with Paragraph 7 below, a security system, installing furniture, special flooring or carpeting, trade fixtures, telephones, computers, photocopy equipment, and other business equipment including racks and inventory. Such early entry will not advance the Commencement Date so long as Tenant does not commence business operations from any part of the Premises. All of the provisions of this Lease shall apply to Tenant during any early entry, including the indemnity in Paragraph 12.1, but excluding the obligation to pay Rent unless and until Tenant has commenced business operations in the Premises, whereupon Rent shall commence. Landlord may revoke its permission for Tenant's early entry to the extent Tenant's activities or workers interfere with the completion of Landlord's Work. If Tenant is granted early entry, Landlord shall not be responsible for any loss, including theft, damage or destruction to any work or material installed or stored by Tenant at the Premises or for any injury to Tenant or its agents, employees, contractors, subcontractors, subtenants, assigns or invitees (collectively, "TENANT'S PARTIES"), except to the extent resulting from Landlord's gross negligence or willful misconduct. Landlord shall have the right to post appropriate notices of non-responsibility and to require Tenant to provide Landlord with evidence that Tenant has fulfilled its obligation to provide insurance pursuant to paragraphs 7(d) and 12.3 of this Lease.

Early Entry into Premises. On the condition that, (a) this Lease shall have been fully executed; and (b) Tenant shall have (i) paid to Landlord (in the form of cash by wire transfer or a cashiers check) the first month’s payment of Rent in the amount specified in Item 10 of the Basic Lease Provisions, and (ii) provided to Landlord proof (in a form that is satisfactory to Landlord in Landlord’s good faith discretion) that Tenant is carrying all of the insurance that Tenant is required to carry under the Lease (including, without limitation, under Paragraphs 7(d) and 12.3, below and Paragraph 8 of the Work Letter); (collectively, the “Early Occupancy Conditions”), Tenant may enter into the Premises for the sole purpose of performing Tenant’s Early Work (as defined in the Work Letter.) In entering the Premises and performing the Tenant’s Early Work, Tenant shall not interfere with Landlord’s contractors performing the Tenant Work (defined in the Work Letter) at the Premises during the Early Occupancy Period. Such early entry by Tenant will not advance the Commencement Date. During the period (the “Early Occupancy Period”) commencing on the date (the “Early Occupancy Date”) on which Tenant first enters and occupies the Premises under this Paragraph 1.4 and continuing through the Commencement Date, all of the provisions of this Lease shall apply to Tenant (including, without limitation, Tenant’s obligations to the indemnify Landlord in accordance with Paragraph 12.1 and Tenant’s obligations to carry insurance in accordance with Paragraphs 7(d) and 12.3 of this Lease and under Paragraph 8 of the Work Letter); provided, however, that Tenant shall have no obligations to pay Base Rent (defined in Paragraph 2.1, below) under Paragraph 2.1, below, or any Additional Rent (defined in Paragraph 2.4, below) under Paragraph 2.4, below during or with respect to such Early Occupancy Period. If Tenant is granted early entry to and occupies the Premises during the Early Occupancy Period, Landlord shall not be responsible for any loss, including theft, damage or destruction to any work or material installed or stored by Tenant at the Premises or for any injury to Tenant or its agents, employees, contractors, subcontractors, subtenants, assigns or invitees (collectively, “Tenant’s Parties”) except for damage to the extent resulting from the gross negligence of Landlord or any of the Landlord Parties (but only to the extent such damage is not coverable under a customary course of construction policy carri...

To the extent any such early entry actually delays the making of the Premises Ready For Occupancy, such delay, but only to the extent that such early entry actually delays the completion of the Tenant Improvements, shall constitute a Tenant Delay.
Early Entry into Premises. If and to the extent permitted by applicable laws, rules and ordinances and provided Tenant obtains, at no cost to Landlord, a temporary certificate of occupancy or such other permits or approvals from the applicable governmental. agency or department authorizing the early entry described herein, Tenant shall have the right to enter the Premises for the period following the Effective Date hereof but prior to the Commencement Date in order to temporarily operate an affiliated division of Tenant, provided that during said period: (i) Tenant shall comply with all terms and conditions of this Lease other than the obligation to pay rent, (ii) Tenant shall not interfere with Landlord's completion of the Premises and (iii) Tenant shall not otherwise begin operation of its business. Tenant does hereby indemnify, agree to defend and save Landlord harmless from and against any and all claims, liabilities, damages and expenses (including reasonable attorney's fees) suffered, paid or incurred by Landlord arising out of Tenant's Early Entry.
Early Entry into Premises. Tenant, upon providing Landlord with at least two (2) business days' prior notice, may enter the Premises after the execution and delivery of this Lease by Landlord and Tenant in order to commence the design and construction of the "Tenant Improvements" as that term is defined in Section 2 of the Tenant Work Letter; provided, however, that Landlord shall not be responsible for, and Tenant is required to obtain insurance covering, any loss caused by Tenant or those entering the Premises on behalf of Tenant to design or construct the Tenant Improvements, including theft, damage or destruction to any work or material installed or stored by Tenant or any contractor or individual involved in the construction of the Tenant Improvements, or for any injury to Tenant or Tenant's employees or to any other person and provided further that Landlord shall have the right to post the appropriate notices of non-responsibility and to require Tenant to provide Landlord with evidence that Tenant has fulfilled its obligation to provide insurance pursuant to Section 4.5 hereof.

Prior to any such early entry, Tenant is required to obtain insurance pursuant to Section 8.2, and provide Landlord with written evidence thereof.
