EFFECT OF LAW AND REGULATION. A. The parties will be governed by existing or future laws; and Government-wide rules or regulations in effect upon the effective date of this Agreement. Should any conflict arise between the terms of this Agreement and any present or future laws, provisions of such laws shall supersede conflicting provisions of this Agreement.
B. Should any conflict arise between the terms of this Agreement and any Government-wide rule or regulation (other than a rule or regulation implementing 5 U.S.C. §2302), issued after the effective date of this Agreement, the terms of this Agreement will supersede and govern.
C. In any conflict between the terms of this Agreement and any provisions of DHS or Agency Directives, Policies, Handbooks, etc., regardless of the date of issuance, the terms of the Agreement will govern.
D. The requirements of this Article shall apply to all understandings or agreements between the parties.
EFFECT OF LAW AND REGULATION. Section 1. As of the effective date of this Agreement, the Parties are governed in all matters covered by this Agreement, existing and future laws; government-wide rules and regulations in effect upon the effective date of this Agreement. In any conflict between EPA orders, manuals, notices, and advisories in effect on the effective date of this Agreement, and the terms of this Agreement, the Agreement will govern.
Section 2. Any rule or regulation published after the effective date of this Agreement, over which the Employer is obligated to bargain to the extent required by law, will not be enforced for bargaining unit employees either (1) until the Parties have fulfilled their bargaining obligations in accordance with the FLMRS, or (2) if it conflicts with the specific terms of the Agreement. An exception to this provision will be if the Parties mutually agree to accept enforcement of the rule, regulation, etc. If they agree, the rule or regulation will be effective upon agreement.
Section 3. Local level agreements and practices will not conflict with the terms of this Agreement.

SECTION 4 Nothing in this Agreement constitutes a waiver of the EMPLOYER'S rights under 5 U.S.C. Section 7106(a).

C. In any conflict between the terms of this Agreement and any provisions of Service Orders, Policy Letters, Manuals, etc., regardless of date of issuance, the terms of the Agreement will govern.
D. The requirements of this Article shall apply to all understandings or agreements between the parties.

B. For all government-wide rules and regulation impacting conditions of employment of bargaining unit employees promulgated after the effective date of this Agreement, the Agency shall provide notice to, and bargain with, the Union, in accordance with Article 9: Mid-term Negotiations.
Section 3.02 To the extent that provisions of the Agency's published policies, procedures, rules, and regulations specifically conflict with this Agreement, the provisions of this Agreement will govern.
Section 3.03 The Agency shall provide all bargaining unit employees access to the following:
A. An electronic copy of this Agreement, including all appendices affixed thereto; and
B. Any published MBDA regulations and policies.

Section 2 To the extent that provisions of the Employer's Rules and Regulations are in specific conflict with this Agreement, the provisions of this Agreement will govern.
Section 3 The parties agree that wherever the phrase, “The Employer has determined” or “Management has determined” appears in this agreement, it denotes a unilateral management determination that has been placed in the agreement for informational purposes only. The parties understand that such determinations may be unilaterally changed by the Employer at any time to the extent consistent with law, after any notification to the Union and negotiations required by law. The parties further understand that the Employer fully retains all management rights accorded by 5 USC 7106, and that nothing in this Article shall constitute a waiver of the Union’s right to negotiate over the Employer’s rules and regulations, to the extent permitted by law. EFFECT OF LAW AND REGULATION. A. In the administration of all matters covered by this Agreement, all management officials and employees are governed by all existing and/or future laws.
B. All government-wide regulations of the Office of Personnel Management (OPM), General Services Administration (GSA), Office of Management and Budget (OMB), Office of Government Ethics (OGE), and other government agencies with authority to promulgate such regulations, in effect as of the effective date of this Agreement, have full force and authority. To the extent they may be inconsistent with the provisions of this Agreement, the government-wide regulations will supersede and govern.
C. Any HHS regulation, rule or policy in effect as of the date of this agreement governs the working conditions of the parties, unless it conflicts with the terms of this Agreement.
A. Should any direct conflict arise between the terms of this Agreement and any government-wide rule or regulation, or any HHS rule, regulation, or directive, issued after the effective date of this Agreement, the terms of this Agreement will supersede and govern. However, the foregoing shall not apply to any government-wide regulation implementing 5 U.S.C. §2302 (relating to prohibited personnel practices), which will govern the parties and supersede any contrary provision of this Agreement regardless of when such regulation is issued.
B. Section A above shall not apply to any government-wide rule or regulation the Employer is obligated to implement immediately upon issuance of the regulation.
A. Past practices that are inconsistent with this agreement are extinguished upon the effective date of this agreement. Past practices not inconsistent with this agreement remain in effect until changed through the collective bargaining process.
B. Any Memorandum of Understanding (MoU), Memoranda of Agreement (MoA), or other agreements between the Parties will expire automatically upon the effective date of this Agreement unless expressly provided to the contrary in this Agreement. All MoUs, MoAs, or any other agreements that are executed after the effective date of this Agreement will be deemed to be part of this Agreement. All subsequently-executed MoAs, MoUs or other agreements must contain a specific effective and expiration date, unless the Parties mutually agree otherwise and such agreement is reflected in the text of the document. Otherwise, the MoA/MoU or other agreement will have no legal force or effect and will be considered void.
