Employee not on Availability Duty. Employees, who are not on Availability Duty and are called in to carry out unplanned / emergency work on a public holiday, will receive accrued time in lieu on a time for time basis. This will be in addition to any applicable penalty payment that may otherwise be claimed. To attract the accrued time in lieu the following minimum conditions will apply: • A minimum of four (4) hours actual time must be worked on the public holiday; and • The maximum hours to be allocated to the employees annual leave accrual will be equivalent to the employee’s ordinary working day. For example if an employee works 6.5 hours actual time, 6.5 hours will be allocated to their annual leave accrual on a time for time basis.

Employee not on Availability Duty. Public Holiday Employees, who are not rostered on an availability duty roster and are called in to carry out emergency work on a public holiday, will be entitled to payment at the applicable overtime penalty payment for such work from the time of leaving home until they return home within a reasonable time. Additionally, employees will receive accrued time in lieu added to their annual leave for any time worked on the public holiday, on a time for time basis. The maximum hours to be allocated to the employees annual leave accrual will be 8.03 hours. For example if an employee works 6.5 hours actual time, 6.5 hours will be allocated to their annual leave accrual on a time for time basis. The response shall include appropriate data from the Registry System. An EPP command with “EPP command RTT” 5 times higher than the corresponding SLR will be considered as unanswered. If 51% or more of the EPP testing probes see the EPP service as unavailable during a given time, the EPP service will be considered unavailable.

  • Availability for Duty Where an employee is on availability duty (as defined by Clause 22.11 of the Award), he/she shall be paid an, ‘Availability for Duty Allowance’ of a minimum of $100.00 per week increasing to $105.00 per week on 1 July 2006, $110.00 per week on 1 July 2008 and $115.00 per week on 1 July 2010. Companies who have superior arrangements will maintain those superior arrangements.

  • RDDS availability Refers to the ability of all the RDDS services for the TLD, to respond to queries from an Internet user with appropriate data from the relevant Registry System. If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.

  • General Availability The commitment to availability specified in the letter of appointment shall be subject to mutually acceptable revision. Such revision will occur once per year, or, if mutually agreed between the Employer and the employee, on a more frequent basis. The Employer will issue a revised letter of appointment to reflect approved changes to employee’s general availability.

  • DNS service availability Refers to the ability of the group of listed-­‐as-­‐authoritative name servers of a particular domain name (e.g., a TLD), to answer DNS queries from DNS probes. For the service to be considered available at a particular moment, at least, two of the delegated name servers registered in the DNS must have successful results from “DNS tests” to each of their public-­‐DNS registered “IP addresses” to which the name server resolves. If 51% or more of the DNS testing probes see the service as unavailable during a given time, the DNS service will be considered unavailable.

  • Service Availability You understand that Service availability is at all times conditioned upon the corresponding operation and availability of the communication systems used in communicating your instructions and requests to the Credit Union. We will not be liable or have any responsibility of any kind for any loss or damage thereby incurred by you in the event of any failure or interruption of such communication systems or services resulting from the act or omission of any third party, or from any other cause not reasonably within the control of the Credit Union.

  • Funding Availability This Contract is at all times subject to state appropriations. The Department makes no express or implied representation or guarantee of continued or future funding under this Contract. The Department has, as of the date of the execution of this Contract, obtained all requisite approvals and authority to enter into and perform its obligations under this Contract, including, without limitation, the obligation to make the initial payment or payments required to be made under this Contract on the date or dates upon which such initial payment or payments may otherwise be disbursed during the current contract period, (i.e., Sept ember 1, 2015, through August 31, 2017). The Grantee acknowledges the Department’s authority to make such payments is contingent upon the Texas Legislature's appropriation to the Department of sufficient funds and the availability of funds to the Department for such purpose. If the State of Texas or the federal government terminates its appropriation through the Department or fails to pay the full amount of the allocation for the operation of any grant or reimbursement program hereunder , or the funds are otherwise unavailable, the Department may immediately and without penalty reduce payments or terminate this Contract, in whole or in part. Upon termination of the Contract or reduction of payments, the Grantee shall return to the Department any unexpended funds already disbursed to the Grantee. Neither the Department nor the State of Texas shall incur liability for damages or any loss that may be caused or associated with such termination or reduction of payments. The Department shall not be required to give prior notice for termination or reduction of payments.
