Employment During Notice Period. Where an Employee has given or been given notice of termination in accordance with Clause 6 (b) or (c) then he/she shall continue employment until the date of the expiration of such notice. Any Employee who, having given or been given notice of Termination, without reasonable cause (proof of which shall lie with the Employee) absents himself/herself from work during such period, shall be deemed to have abandoned his/her employment and shall not be entitled to payment for work done by him/her within that period.

Employment During Notice Period. Following the provision of notice to terminate the Employee’s employment by either party or, if the Employer is undertaking an investigation at any time during the employment, the Employer may by written notice require the Employee not to perform any services (or to perform only specified services) for the Employer or any Related Company of the Employer until the termination of the employment or a specified date. During any period of Garden Leave, the Employer shall be under no obligation to provide any work to, or vest any powers in the Employee, who shall have no right to perform any services for the Employer or any Related Company of the Employer. Employment During Notice Period. Following the date upon which Employee gives notice of resignation, the Company shall pay Employee an amount equal to six (6) months' base salary (the "Mutual Agreement Payments"). Such Mutual Agreement Payments shall be determined with reference to the salary in effect for the month in which the date of notice of resignation occurs. During the six months following Employee's notice of resignation (the "Notice Period"), Employee shall, at the discretion of the Chief Administrative Officer, continue to serve in the capacity of Chief Financial Officer of the Company or in an unnamed advisory capacity, unless the Chief Administrative Officer determines that Employee's services are not required. Whether or not Employee's services are required during the Notice Period, Employee shall receive the Mutual Agreement Payments.

  • Termination Period This Option shall be exercisable for three (3) months after Participant ceases to be a Service Provider, unless such termination is due to Participant’s death or Disability, in which case this Option shall be exercisable for twelve (12) months after Participant ceases to be a Service Provider. Notwithstanding the foregoing sentence, in no event may this Option be exercised after the Term/Expiration Date as provided above and this Option may be subject to earlier termination as provided in Section 13 of the Plan.
