Environmental and Social Safeguards Management. 1. The Recipient shall ensure that the Project is carried out in accordance with the provisions of the ESMF and the RPF throughout the period of implementation of the Project. 2. Without limitation to the provisions of paragraph 1 of this Part G, the Recipient shall, prior to any construction, rehabilitation and maintenance activity under the Project: (a) as and when required under the ESMF or the RPF, carry out in accordance with the ESMF or RPF (as applicable), an assessment of such activity; (b) in the event that on the basis of such assessment, such activity, if carried out, would have a potential for adverse impact, not permit such activity to be carried out until an appropriate environmental management plan, resettlement action plan or other plan, as required, under the ESMF or RPF (as applicable) has been prepared and adopted by the Recipient to mitigate such potential adverse impact; and (c) thereafter, ensure that the agreed plan (or plans, as the case may be) referred to in (b) above is (or are) carried out with due diligence. 3. The Recipient shall not abrogate, amend or waive, or permit to be abrogated, amended or waived, the ESMF or RPF (as applicable) (including any environmental impact assessments, environmental management plans and resettlement action plans prepared under paragraph 2 of this Part G) or any provision thereof, without prior agreement in writing of the Association. 4. The Recipient shall monitor and regularly report to the Association, including through the Project Reports referred to in Part A of Section II of this Schedule, the status of compliance with the ESMF and RPF (including any environmental impact assessments, environmental management plans and resettlement action plans prepared under paragraph 2 of this Part G), giving details of: (a) measures taken or to be taken in accordance with the said frameworks, assessments and plans; (b) conditions, if any, which interfere or threaten to interfere with the implementation of the said frameworks, assessments and plans; and (c) remedial measures taken or to be taken to address such conditions. 5. In case of any conflict between the provisions of the ESMF or RPF (as applicable) (including any environmental impact assessments, environmental management plans and resettlement action plans prepared under paragraph 2 of this Part G) and the provisions of this Agreement, the provisions of this Agreement shall prevail.

Environmental and Social Safeguards Management. Without limitation upon the provisions of paragraph 7 of this Schedule, ICAR shall submit to the Association six-monthly progress reports on compliance with social and environmental safeguard measures under the Project, giving details of measures taken in furtherance of the ESMF, conditions, if any, which interfere or threaten to interfere with the smooth implementation of the ESMF, and remedial measures taken or required to be taken to address such conditions.

The Project Implementing Entity shall, through the MDPU, furnish to the Association and the Bank semi-annual progress reports on the Project Implementing Entity’s compliance with the social and environmental safeguard measures set forth in the ESA and the ESMF, providing details of measures taken in furtherance of the ESA and the ESMF, conditions, if any, which interfere or threaten to interfere with the successful implementation of the ESA and the ESMF and remedial measures taken or required to be taken to address such conditions. 2. The Project Implementing Entity shall ensure that: (a) key social development issues including, inter alia, vulnerable groups, and women’s groups shall underpin the Project’s social strategy and implementation; (b) the Project shall be implemented using to the extent practicable land free from squatters, encroachments or other encumbrances, and without recourse to compulsory acquisition of land, forcible eviction and involuntary resettlement of local population; if and where unavoidable, involuntary resettlement shall be kept to the strict minimum, and shall be undertaken in accordance with guidelines and procedures acceptable to the Association and the Bank, including, inter alia, those set forth in the ESMF; and (c) all necessary steps are taken to implement the Sub-basin Development Plans in accordance with the ESA and the ESMF, and that no action is taken that shall hinder, prevent or interfere with such implementation.

The Project State shall, in the carrying out of the Project, apply and implement, or cause to be applied and implemented: (a) the Environmental and Social Management Framework and the environmental management plans prepared pursuant to the provisions of said Framework; and (b) the Tribal and Other Vulnerable Group Development Framework, and the plans prepared pursuant to the provisions of said Framework; all in a manner and substance satisfactory to the Association. 2. The Project State shall not amend, suspend, or waive the, the Environmental and Social Management Framework or the Tribal and Other Vulnerable Group Development Framework, or any provision thereof, without the prior concurrence of the Recipient and the Association.

Environmental and Social Safeguards Management. 1. Prior to the carrying out of any works under an investment scheme under Part C of the Project, the Project Implementing Entity shall ensure that the relevant environmental assessment and environmental management plan, and all other necessary mitigation measures, acceptable to the Association, are prepared and finalized in accordance with the EMF; and thereafter ensure that said investment scheme is carried out in accordance with the relevant environmental assessment and environmental management plan, satisfactory to the Association. 2. The Project Implementing Entity shall ensure that: (a) the Project shall be implemented, as far as reasonably practicable, using exclusively land free from squatters, encroachments or other encumbrances, and without recourse to the compulsory acquisition of land, forcible eviction, or involuntary resettlement of persons; and (b) where unavoidable, land acquisition shall be kept to the strict minimum, and shall be undertaken in accordance with policies and procedures acceptable to the Association.

The State (through RWSSD) shall, in the carrying out of the Project, apply and implement, or cause to be applied and implemented: (a) the Resettlement Policy Framework and the resettlement action plans prepared and approved by the Association pursuant to the provisions of said Framework; (b) the Environmental Management Framework and the environmental management plans prepared pursuant to the provisions of said Framework; and (c) the Tribal Development Plan; all in a manner and substance satisfactory to the Association. 2. Without limitation on any of the provisions set forth in paragraph C.1 of this Section, the State (through RWSSD) shall: (a) take and cause to be taken all necessary actions to minimize to the extent possible the acquisition of land or assets of people, any involuntary loss by persons of shelter, productive assets or access to productive assets or income or means of livelihood, temporarily or permanently, and the displacement of said people in the carrying out the Project or any part thereof; and (b) where the acquisition of land or assets or the displacement of people is unavoidable, make available or cause to be made available to such people compensation in accordance with the Resettlement Policy Framework and relevant resettlement action plan, and before the carrying out of the works which would result in such acquisition or displacement, all in a manner satisfactory to the Association. 3. The State (through RWSSD) shall not amend, suspend, or waive the Resettlement Policy Framework, the resettlement action plans, the Environmental Management Framework, or the Tribal Development Plan, or any provision thereof, without the prior concurrence of the Association.
