Equipment Performance. 3.8.1 Equipment at each individual location shall maintain, at all times a 95% or better uptime. Downtime shall be computed from the time the Contractor representative is notified of equipment failure until the equipment is fully operational. Equipment that does not meet the performance standard of 95% for a two (2) consecutive month period or for three (3) months in a rolling twelve (12) month period shall be replaced by the Contractor with equal or better equipment. It is understood and accepted that equipment failure may not be attributed to the use of recycled paper and/or recycled/remanufactured supplies, as long as those products meet the specifications set by the USPS.
Equipment Performance. Temperature control for office Spaces shall be provided by concealed central heating and air conditioning equipment. The equipment shall maintain Space temperature control over a range of internal load fluctuations of plus 0.5 W/SF to minus 1.5 W/SF from initial design requirements of the tenant.
Equipment Performance. Contractor shall use all reasonable efforts to cause Subcontractors supplying any equipment to the DB Project to achieve the performance standards guaranteed by the suppliers of such equipment. Any damages payable by a supplier to Contractor shall be remitted to Concessionaire, except for that portion of such damages required to compensate Contractor for amounts paid to Concessionaire hereunder as a result of the failure of such supplier’s equipment to achieve the required standards under this Agreement and for other reasonable costs incurred by Contractor as a result of such failure. No such damages paid to Concessionaire shall relieve Contractor from any of its obligations under this Agreement and any such damages remitted to Concessionaire shall not be applied to reduce Contractor’s liability hereunder.
Equipment Performance. Equipment maintenance If issues of non-compliance are identified during County’s monitoring, the County may provide a written report to the Contractor following the monitoring visit. When issues of non-compliance are identified in the monitoring report, a written Corrective Action Plan (CAP) will be required of the Contractor. The CAP is to be submitted to the County’s Contract Manager within ten (10) days of receipt of the monitoring report. If necessary, a follow-up monitoring visit will be scheduled by the Contract Manager, and will occur within thirty (30) days of the original monitoring visit at which time full compliance must be met. Failure to correct deficiencies after thirty (30) days of receipt of a written monitoring report notating the deficiencies may result in County’s determination of breach of contract and termination of this Agreement. The County reserves the right for any County staff to make scheduled or unscheduled, announced or unannounced visits to the Contractor’s place of business.
Equipment Performance. If Equipment fails to perform within +/- 10% of the enrolled capacity noted above or to perform in self-consumption mode as required, you will have 30 days to resolve the issue and to have GMP test and verify that performance has been restored. If performance is not restored within 30 days, GMP may elect to terminate your participation in the BYOD program as provided in Paragraph 6.

Equipment Performance. Contractor guarantees the monthly uptime as measured on a quarterly basis by product segment listed below. A Copiers Black & White All 96% B Copiers Color All 96% C Wide Format Devices All 96% D Printers (Color and Black &White) All 96% E Digital Duplicators All 96% F Scanners All 96% Any unit, including all accessories and software, supplied through this contract will be subject to replacement if such unit: (a) fails (except due to operator error) to operate in accordance with the manufacturer's published performance specifications four times in any four week period or (b) fails to maintain the 96% guaranteed monthly uptime level of performance (excluding service calls caused by operator error, and provided Contractor has been given a ninety (90) day cure period). If 25% or less of the device’s useful life has been used up, the device must be replaced with a “new device”. A “like for like” device may be used if 25% or more of the useful life of the device has been used up and the Customer agrees to the “like for like” exchange. The 96% uptime requirement shall not apply to devices whose uptime depends, in large part, on the operator's efficiency in replacing operator replaceable components. Should Contractor determine that it cannot maintain a unit of Equipment or an Accessory in good working order, Contractor shall, at its own expense, replace such Equipment with another unit of the same product designation as that Equipment (a "replacement unit") and Ricoh shall bear all installation, transportation, removal and rigging charges in connection with the installation of such replacement unit; provided, however that (a) subject to section 3.4.11.2 (Lemon Clause) of the Contractor’s response to the Solicitation, the replacement unit may be a reconditioned or otherwise used unit rather than a new unit; and (b) if a replacement unit of the same product designation as the unit of Equipment it replaces is not available, the replacement unit may be a product of substantially similar or greater capabilities. The replacement unit will be in “as new” condition, both in operation and appearance. In addition, all warranties and maintenance coverage that applied to the removed unit will also apply to the permanent replacement equipment. A designated factory authorized technician must certify each unit’s ability to produce acceptable impressions with acceptable copies between calls or uptime. Equipment Performance. Equipment Downtime shall be computed from the time Sharp is notified of Equipment failure until the time in which the Equipment is fully operational. Equipment Downtime due to lack of consumable Supplies is not acceptable. Xxxxx will guarantee that the fleet of Devices for each DIR Customer will be operational at least 96% of the time, during Normal Business Hours. Sharp will provide daily communication to the DIR Customer regarding inoperable Equipment, including updates regarding resolution timeframe, and any parts, accessories, or devices on backorder.
Equipment Performance. Overall availability of the Equipment shall not be less than 90% of planned hours as per the Company schedule. In the event the Company is of the opinion that the Hiring Agency is not meeting the required performance criteria, the Company shall terminate the contract, at its discretion by serving 7 (Seven) day notice.
