ESST. Effective January 1, 2024, and each school year thereafter, the first forty-eight (48) hours of sick leave accrued shall be designated as ESST. ESST shall be allowed whenever an employee’s absence is found to have been due to reasons set forth in Minnesota Statutes, section 181.9447. Employees who are newly employed will not be eligible to use ESST until they have performed work for at least eighty (80) hours and have accrued ESST as per school district payroll practices. Employees shall provide their Supervisor with at least seven (7) days advance notice of the need for use of ESST if the need for leave is foreseeable. If the need for ESST is unforeseeable, notice shall be provided as soon as practicable. ESST may be approved only upon the employee’s submission of a request using the authorized ESST pay request form available either electronically or in each building office. Sick leave and ESST (Earned Safe and Sick Time) will accrue separately but will co-exist in perpetuity. ESST accrues at a rate of 1 hour for every 30 hours worked. Leave will be deducted from accumulated ESST until ESST is exhausted. Once ESST has been exhausted, additional sick leave taken shall be deducted from the ESP member’s accumulated, unused sick leave if the ESP member has such leave available. Sick leave with pay shall be allowed whenever an employee’s absence is found to have been due to the employee’s illness and/or disability which prevented his/her attendance at school and performance of duties on that day or days.
