General Design of the Facility. During the Term, Seller shall maintain the Facility according to Good Utility Practice(s). The Facility shall at all times:
(A) have the required panel space and 125VDC battery supplied voltage to accommodate Company’s metering, generator telemetering equipment and communications equipment;
(B) use communication circuits from the Facility to Company’s EDCC for the purpose of telemetering, supervisory control/data acquisition, and voice communications as required by Company.
(C) be capable of accepting a signal from the Company’s SCADA System designed to limit Renewable Energy output to a level not to exceed the AGC Set-Point, which AGC Set-Point may be increased or decreased in accordance with the AGC Protocols;
(D) have each Wind Turbine equipped with meteorological measurement equipment (e.g. anemometers) which are individually linked to Seller’s plant information system;
(E) send the real time data specified on Exhibit I to Company’s Primary and Backup Transmission Dispatch Center;
(F) be capable of receiving and reacting to the SCADA AGC Set-Point signal; and
(G) be capable of AGC Remote/Local.
General Design of the Facility. Seller shall construct the Facility in accordance with Prudent Industry Practice(s) and in compliance with the terms and conditions of the Interconnection Agreement, Applicable Law, and applicable Permits. During Commercial Operation, Seller shall maintain the Facility according to Prudent Industry Practice(s) and the Interconnection Agreement. In addition to the requirements of the Interconnection Agreement, the Facility shall at all times:
(A) have the required panel space to accommodate metering, generator telemetering equipment and communications equipment;
(B) have remote monitoring facilities; and
(C) have no fewer than four (4) suitable solar radiation meters necessary to characterize the solar resource and site ambient conditions, including plane of array irradiance (POAI), global horizontal irradiance (GHI), temperature, pressure and humidity.
General Design of the Facility. Subject to the satisfaction or waiver of the Seller’s Conditions Precedent and subject to the provisions of Section 4.1, the Facility shall be constructed in accordance with Prudent Industry Practice(s) and in compliance with the terms and conditions of the Interconnection Agreement, Applicable Law, and applicable permits. The Facility shall at all times:
(A) have the required panel space to accommodate metering, generator telemetering equipment and communications equipment;
(B) have remote monitoring facilities; and
(C) have, the greater of 1) no fewer than one (1) location per 25 MWac of Facility Capacity and 2) one (1) met station for every major rectangular region within the plant, with no rectangular region encompassing fewer than 3 inverter blocks, rounded up to the next whole number; and distributed evenly throughout the project site, suitable meteorological stations and solar radiation meters necessary to characterize the solar resource and site ambient conditions, global horizontal irradiance (GHI) (with two sensors per station), tracker-mounted plane of array irradiance sensors at each station (if reasonably possible with the required met station radius), but no fewer than 50% of the met station quantity (rounded up for an odd number of met stations across the plant) temperature, wind speed, pressure and humidity.
General Design of the Facility. (A) Seller at its sole expense shall use Commercially Reasonable Efforts to design, construct, operate, maintain, repair and replace the Facility in accordance with all Applicable Laws and permit conditions, Good Utility Practice, the terms of this PPA and the Interconnection Agreement.
(B) The Facility shall include all equipment necessary to successfully interconnect with the Transmission Authority’s System for the delivery of the Facility’s output to the Point of Delivery.
(C) The Facility shall include all equipment and telecommunications capabilities necessary to communicate with Buyer’s SCADA System.
(D) Seller currently contemplates the Facility shall include all of the equipment specified in Exhibit C (as such Exhibit C will be replaced upon Seller’s selection of the Wind Turbines to be installed at the Facility as provided in Article 3.1 above) or otherwise necessary to fulfill Seller’s obligations under this PPA. Seller shall notify Buyer of any change in the make or model of the Wind Turbines. After completion of construction of the Facility, Seller shall deliver to Buyer the As-built Supplement to Exhibit C (as such Exhibit C is replaced pursuant to Article 3.1 above).
General Design of the Facility. Seller shall design, construct, operate and maintain the Facility according to Good Utility Practices and the Interconnection Agreement. The Facility shall include all equipment specified in Exhibit C - Facility Description and otherwise necessary to fulfill Seller’s obligations under this PPA, including all equipment necessary (i) to meet the requirements of Exhibit I - Operating Standards, and (ii) to interconnect successfully with the Transmission Authority’s System for the delivery of Contract Energy to the Point of Delivery. The total namplate capacity of the Facility shall be [__] MW. The Combustion Units Net Capability shall be [__] MW. The Solar Units nameplate capacity shall be [__] MW AC. The Facility shall be capable of starting the Facility’s Combustion Units, synchronizing such Combustion Units to the Transmission Authority’s System and having all such Combustion Units generating at their Minimum Loading levels, as specified in Exhibit C - Facility Description, within ten (10) minutes of receiving the Combustion Unit start dispatch request from Company’ EMCC [applicable to quick start facilities]; and

(B) The Facility shall include all equipment specified in Exhibit C - Facility Description and Site Maps and otherwise necessary to fulfill Seller’s obligations under this PPA, including all equipment necessary (i) to meet the requirements of Exhibit I - AGC Protocols; Dispatch and Availability Notices; Data Collection; Technical Specifications and Exhibit O – Battery Storage System Operating Procedures, and (ii) to interconnect successfully with HCE’s System for the delivery of Energy to the Point of Delivery.
(C) The Solar Nameplate Capacity shall be [ ] MW AC +/- 0.5%. The Battery Storage System Nameplate Capacity shall be [ ] MW AC. Seller shall certify to Company the final actual Solar Nameplate Capacity and Battery Storage System Nameplate Capacity promptly following COD. (B) The Facility shall include all equipment specified in Exhibit C - Facility Description and otherwise necessary to fulfill Seller’s obligations under this PPA, including all equipment necessary (i) to meet the requirements of Exhibit I - Operating Standards, and (ii) to interconnect successfully with the Transmission Authority’s System for the provision of Contract Capacity at the Point of Delivery.
(C) The Net Capability of the Facility shall be [ ] MW.
General Design of the Facility. Seller has constructed the Facility in accordance with Good Utility Practice(s), the Interconnection Agreement and rules of the Transmission Operator, including the PJM Manuals and Agreements. During the Delivery Period, Seller shall maintain the Facility according to Good Utility Practice(s) and the Interconnection Agreement. In addition to the requirements of the Interconnection Agreement, the design of the Facility shall at all times include metering accurately the current transformers and voltage transformers located at the Point of Delivery (or some other point mutually agreed to by the Parties) as required to connect to the Electric Metering Devices.

With the exception of specifying the Solar Panels selected by Seller for installation at the Facility as contemplated by Section 3.1 above, Seller shall not make any material modification to the equipment described in Exhibit C, unless the same change is made to the equipment listed in the Interconnection Agreement. After completion of construction of the Facility, Seller shall deliver to Buyer the As-built Supplement to Exhibit C (as such Exhibit C is replaced pursuant to Section 3.1 above).
