For the purpose of calculating overtime, time spent on a paid approved leave, specifically a legal holiday, vacation, vacation leave used as a result of on-call obligations when the on-call duty extends past 11:30 p.m. the previous evening, and personal leave taken in the eight (8) hour increments, shall count as hours worked during the work week. Pre-scheduled medical appointments where sick leave is used and documented shall also be considered as hours worked for overtime computation. The one (1) hour paid lunch shall be considered as time worked for overtime computation.
Section 3. The Employer shall not arbitrarily alter an employee’s work schedule to avoid the payment of overtime, nor shall the Employer alter or extend its hours of operation to avoid the payment of overtime.
Section 4. In the event of an emergency, as defined in Article 38 of this agreement, the Employer may alter, for the duration of the employeeemergency, its hours of operation and the work schedules of bargaining unit employees. Overtime is defined to include The Employer shall, however, compensate at the appropriate overtime rate any regular time worked in excess of bargaining unit employee who works more than forty (40) hours in any calendar week. Holidays, calamity days, jury duty, and professional leave which shall be considered defined as the period from 12:01 a.m. Sunday to 12:00 midnight the following Saturday.
Section 5. Any bargaining unit employee who works more than four (4) hours worked for the purpose of overtimebeyond his normal shift shall have a one (1) hour paid lunch period.
Section 6. All hours worked Bargaining unit employees shall not be on Sunday duty or on call during their lunch and rest periods. They shall be compensated at time and one-half (1 ½) free to leave the employee's regular rateEmployer’s premises during these periods.
Section 7. For hours worked on paid holidays, designated by this Agreement, The Employer shall be able to schedule overtime should it be necessary when an employee or unit of employees have work that must be completed to meet state/agency requirements. Such overtime shall be compensated at time Monday through Thursday and one-half (1 ½) the regular rate of pay during their regular shift hours and double time for hours outside their regular shift hours in addition to the employee’s regular holiday pay for shall not working.
D. Any employee called in to work on a day when the employee is not scheduled to work shall receive a minimum of exceed two (2) hours pay or actual time spent, whichever is greater, at per day. E. Any employee Regular employees in the bargaining unit who are called back in to work at time outside of, or prior to and not annexed to, their regular scheduled shift shall receive a minimum of three (3) hours pay at their base hourly rate for any scheduled meeting such as training sessions or staff meetings. In the event an employee is called in for an unscheduled event or meeting, the employee shall receive a minimum of four (4) hours pay at their base hourly rate. Employees who are called in during a scheduled vacation day will be compensated for their time including the minimum three (3) hours call-in at their overtime rate.
F. Compensatory Time In lieu of paid overtime, Sergeants may elect to accrue up to a total of sixty (60) hours of compensatory paid leave in a calendar year. Sergeants may not exceed the 60-hour cap, nor may they use more than 60 hours of compensatory time in any given calendar year. The use of compensatory time is at the discretion of the Police Chief or designee and it may only be used during times that will not result in an overtime situation for the Town. In scheduling the use of compensatory time, the Police Chief or designee shall take into account the operational needs of the department and employee seniority. The Sergeant’s compensatory accrual bank shall reset at the start of the calendar year, and employees may receive payment for accumulated compensatory time upon written request to the Police Chief.
G. During the duration of this Agreement, work schedules shall be posted thirty (30) calendar days in advance of actual assignments, except in the case of unforeseen circumstances.
H. The Chief of Police or his/her designee will make a good faith effort to assign overtime work as equally as practicable among regular shift employees in this unit consistent with the operational needs and the efficient and effective operations of the Police Department.
I. In the event the Town elects to change the work schedule, it shall meet and consult with the Union pertaining to the proposed schedule change, including rotation. Alternative work schedules may also be compensated for at least twodiscussed with the Police Chief during this meet and consult process. It is understood that the Police Chief's decision on scheduling is final and must comply with the language contained in Section A of this Article.

(An employee who is required to serve as a grand or petit juror shall be paid his regular rate of pay by the Employer. If the employee is released prior to the time end of his regular tour of duty, he shall return to work.)
F. Any employee called back to work outside his/her regular shift attending a school shall be compensated paid straight time providing the school is scheduled during times other than the employee’s regular tour of duty. Straight time shall be paid at the rate provided herein.
G. The Chief of Police or his designee may, from time to time, call general meetings for the purpose of instruction and/or procedural guidance and information excluding any formal training. Such meetings shall not exceed six (6) meetings per calendar year. Any additional meetings called by the Chief of Police or his designee in an excess of six (6) meetings per calendar year, shall permit any attending employee to be paid overtime at least twothe rate provided herein.
H. Any employees requested to attend in-house department training, such as computer instruction, shall be paid straight time not overtime.
I. Employees may have the option to accept a mutual switch in shifts with another employee providing the shift is covered and the Chief of Police or his designee approves the change within eight (8) hours before the respective shift is to begin. H. If an employee’s work schedule is such that it does not allow sufficient time to vote in any federal, state, or local election in which the employee is entitled to vote, the Board shall arrange to allow sufficient time for such voting by the employee.
I. Any employee in the bargaining unit whose regularly assigned work shift commences on or after 3:00 P.M. shall receive $.16 above regular rate of pay for all hours worked during the shift schedule. Any employee whose regularly assigned shift commences on or after 11:00 P.M. and prior to 6:00 A.M. shall receive $.29 above regular rate of pay for all hours worked during the scheduled shift.
J. Overtime shall be compensated distributed in order of bargaining unit seniority within the classification and building or work area by a rotating list. If the employee with the greatest bargaining seniority elects to refuse the overtime assignment, it shall be offered to employees in the bargaining unit in descending order of seniority until the assignment is made. Refusal by a senior employee in the bargaining unit of any overtime assignment shall not waive his/her right under this section to be offered any subsequent overtime assignment in order of seniority. The least senior employee(s) must accept the overtime assignment. An employee refusing overtime shall be charged with the hours that would have been worked had he/she accepted the overtime offer. Head Custodians can enter the rotation of overtime opportunities for custodians when the event causing the overtime need is from outside groups. Overtime list(s) will be maintained by the members on the list and any disputes will be resolved among the membership without involvement of the Board.
K. Requests for services of a Head Xxxx and/or Head Custodian which are to be performed at least twoa location other than the currently assigned building of any currently assigned Head Xxxx or Head Custodian and which are received by the Support Services Supervisor or Supervisor of Buildings and Grounds, respectively, forty-eight (48) hours or more in advance of the requested services shall be assigned to the Head Xxxx and/or Head Custodian next in order on a rotating seniority list. In the case of food preparation, the food is to be prepared in the assigned Head Xxxx’x kitchen, unless this causes an added expense to the party paying for the service. In such cases, the assigned Head Xxxx will be required to work out of the nearest kitchen, or to decline the assignment. If the request is received less than forty-eight (48) hours in advance of the event or the assigned Head Xxxx/Head Custodian gives less than forty-eight (48) hours’ notice that he/she is unable to perform the assignment, the appropriate supervisor shall assign the work to the most available Head Xxxx and/or Head Custodian.
L. Pyramiding of premium and/or overtime: The allowance of overtime or premium payment on any time for which an employee receives overtime or premium compensation eliminates that time from consideration for overtime or premium payment on any other basis. If the time worked falls under two (2) or more overtime and/or premium pay classifications the higher rate shall prevail except that shift differential and classification pay for work in a higher paying classification are not premium pay and shall be included in determining overtime or premium payments under this agreement.

The length Overtime-eligible Employees working a 35- or 36-hour week (including part-time Employees who are paid on the basis of a 35-hour week) shall have any overtime payments due computed on the work day shall be designated by the Board for each classified assignment. D. The Company will grant consecutive days off where practicable and where the normal functioning of the employee. activities of the Company's business is not impaired.
E. Overtime is defined to include any regular time worked in excess of forty (40) hours in any calendar week. Holidays, calamity days, jury duty, and professional leave shall be considered hours paid only to those Employees to whom the overtime provisions of the Fair Labor Standards Act apply.
F. If overtime is worked, it shall be paid for in intervals of fifteen (15) minutes.
G. Work on a Scheduled Day Off (“SDO” as defined in H, below), whether from home or in the office, will be treated as overtime for a full-time overtime eligible (non-exempt) Employee unless the Employee’s work schedule for that week has been altered in anticipation of an unusual work schedule. If an overtime eligible Employee is assigned to come into the office or report to another location on an SDO, time worked for the purpose of overtime. HOURS AND OVERTIME. A. The normal 1. When severe weather requires snow removal, all custodians (day and night custodians) shall be required to report to the Director of Maintenance and Operations for the express purpose of snow removal and related operations to their job sites at 7:00 a.m., unless called in earlier. In the event that custodians are called in to work week prior to the 7:00 a.m. time, they shall receive 1 ½ times their regular pay for fullthe time prior to 7:00 a.m. Employees shall be required to report, as requested, for snow removal first to their own site and then to other sites within the district as directed by the maintenance and operations supervisor or superintendent’s designee. An employee must account for the severe weather day by using any applicable and available personal leave. 2. Any employee shall have the right to reject any offer or request for call back or overtime. Overtime may be refused if an employee has previously scheduled an appointment that cannot be reasonably altered.
3. An employee in the bargaining unit who is assigned to work an average of thirty (30) minutes or more per day in excess of his or her regular part-time assignment for a period of twenty (20) consecutive working days or more, shall have his/her regular assignment adjusted upward to reflect the longer hours, effective the next pay period.
4. All employees covered by this Agreement shall be entitled to an uninterrupted lunch period, without pay, after the employee has been on duty for four (4) or more hours as desired by the employee. The length of time for such lunch period shall be for a period of no longer than one (1) hour or less than one-half (1/2) hour and shall be scheduled for full time employees at or about the midpoint of each work shift.
5. All bargaining unit employees shall consist be granted rest periods, which insofar as practicable, shall be in the middle of five each work period, at the rate of fifteen (515) minutes per consecutive days three and forty three quarters (403 3/4) hours per week except worked. 6. The District shall make available at each work site, lunchroom, restroom, and lavatory facilities for classified employee use.

(c) When an employee is assigned to work on a scheduled holiday/vacation day, an said employee shall be compensated at the rate of time and one-one half (1 ½1/2) of the regular rate of pay during their regular shift hours and double time for hours outside their regular shift hours pay, in addition to the regular pay received for the holiday/vacation day.
8. A 5% shift differential will be applied to those employees where over one half (1/2) of their regularly scheduled work shift is after five (5) p.m. When so qualified, the 5% differential will be applied to the total shift wages.
(a) An employee who receives a shift differential premium on the basis of the shift worked shall suffer no reduction in pay, including differential when temporarily assigned to a day shift.
9. An employee in the bargaining unit shall have the option to elect to take compensatory time off in lieu of cash compensation for overtime work, if mutually agreeable. Compensatory time granted shall be at the appropriate rate of overtime. Compensatory time to be taken at employee’s regular holiday pay for request and with Supervisor’s approval. Compensatory time may be accrued up to 24 hours at any time. Compensatory time may not workingbe used in lieu of vacation time.
D. 10. Overtime shall be distributed and rotated among employees in the bargaining unit within each department, unless otherwise provided by this Agreement. Unsatisfactory employee performance in an overtime assignment may limit additional assignments given to that employee.
11. Any employee called in back to work after completing a shift shall be entitled to pay for hours worked, but not less than for two (2) hours, at the appropriate rate of pay.
12. Any employee called to work on a day when the employee is not scheduled to work shall receive a minimum of be paid for the hours worked, but not less than for two (2) hours at the appropriate rate of pay. An employee assigned to school security check on weekends or holidays shall receive a minimum of three (3) hours pay or actual at the appropriate rate.
13. For the purpose of computing the number of hours worked, all authorized time spentduring which an employee is in a paid status shall be construed as hours worked.
14. Required in-service training shall be scheduled by the District. If scheduled by the District after regular working hours, whichever is greaterthe employees shall be paid their regular hourly rate for the time scheduled. If the annual in-service training after hours exceeds ten (10) hours, the rate of pay shall be at the overtime rate. This paragraph does not apply to Transportation employees.
E. Any 15. An employee called back to work outside his/her on duty at the time of the C.S.E.A. regular shift meeting shall be compensated given release time to attend such meetings and shall be able to extend the working day to compensate for at least twothe release time. Any employee whose regularly assigned shift commences on or after 11:00 P.M. and prior to 6:00 A.M. shall receive $.29 above regular rate of pay for all hours worked during the scheduled shift.
J. Overtime shall be compensated distributed in order of bargaining unit seniority within the classification and building or work area by a rotating list. If the employee with the greatest bargaining seniority elects to refuse the overtime assignment, it shall be offered to employees in the bargaining unit in descending order of seniority until the assignment is made. Refusal by a senior employee in the bargaining unit of any overtime assignment shall not waive his/her right under this section to be offered any subsequent overtime assignment in order of seniority. The least senior employee(s) must accept the overtime assignment. An employee refusing overtime shall be charged with the hours that would have been worked had he/she accepted the overtime offer.
K. Requests for services of a Head Xxxx and/or Head Custodian which are to be performed at least twoa location other than the currently assigned building of any currently assigned Head Xxxx or Head Custodian and which are received by the Support Services Supervisor or Supervisor of Buildings and Grounds, respectively, forty-eight (48) hours or more in advance of the requested services shall be assigned to the Head Xxxx and/or Head Custodian next in order on a rotating seniority list. In the case of food preparation, the food is to be prepared in the assigned Head Xxxx’x kitchen, unless this causes an added expense to the party paying for the service. In such cases, the assigned Head Xxxx will be required to work out of the nearest kitchen, or to decline the assignment. If the request is received less than forty-eight (48) hours in advance of the event or the assigned Head Xxxx/Head Custodian gives less than forty-eight (48) hours’ notice that he/she is unable to perform the assignment, the appropriate supervisor shall assign the work to the most available Head Xxxx and/or Head Custodian.
L. Pyramiding of premium and/or overtime: The allowance of overtime or premium payment on any time for which an employee receives overtime or premium compensation eliminates that time from consideration for overtime or premium payment on any other basis. If the time worked falls under two (2) or more overtime and/or premium pay classifications the higher rate shall prevail except that shift differential and classification pay for work in a higher paying classification are not premium pay and shall be included in determining overtime or premium payments under this agreement.
