HOURS AND OVERTIME. The District agrees to extend hours of some paraeducator position to 6.5 hours per day. The parties agree that start and end times of paraeducator shifts shall be negotiated with CSEA annually for all departments and sites no later than July 31 of each year. District agrees to consider a number of District-wide “Floater” Paraeducator positions with fixed daily hours, to be assigned as needed to cover lunches and breaks, leaves of absence (in lieu of substitutes as preferred), and coverage for the students in the classroom who may ultimately need a Paraeducator per their IEP. 13.1 Unit members shall be on duty as assigned by the District. 13.7 Any bargaining unit member who works will receive the assignment based on availability, demonstrated job performance and skills. If those factors are equal, the most senior employee at the same site/department shall receive the assignment. If no bargaining unit members meet these criteria, the supervisor may fill the absence with a substitute employee.
8.7 The bargaining unit member’s regular work days shall not be reduced because of time worked in addition to the bargaining unit member’s regular assigned work days.
8.8 The District may fill a vacant position(s) with a substitute(s) for no longer than sixty (60) calendar days. After the completion of sixty (60) days the district shall not continue to fill the vacant position(s) with a substitute without an average agreement with CSEA.
8.9 A substitute may be hired for less than 195 days to replace a bargaining unit member who is temporarily absent from duty. This section does not preclude the District from hiring additional substitutes if the bargaining unit member’s absence is for more than 195 days.
8.10 Bargaining unit members who are contracted to work six (6) or more hours shall be provided an uninterrupted, non-compensated lunch period. The length of time for lunch shall be for a period of no longer than one (1) hour nor less than one- half (1/2) hour. The lunch period shall be scheduled upon initial employment in the position, and annually thereafter, by the immediate supervisor at or about the midpoint of the bargaining unit member's work shift. By mutual agreement, the lunch period may be rescheduled.
8.11 When a bargaining unit member’s contracted workday is more than four (4) hours but less than six (6) hours an uninterrupted, non-compensated lunch period may be requested by the bargaining unit member to be approved by the supervisor or may need to be scheduled by the immediate supervisor upon initial employment in the position, and annually thereafter. If scheduled, the lunch period shall be at or about the midpoint of the bargaining unit member's work shift. By mutual agreement, a lunch period may be scheduled, rescheduled or eliminated.
8.12 Bargaining unit members who are contracted to work 2.5 to 3.49 hours shall receive one five (5) minute rest period, which shall, when practicable, be scheduled at the mid-point of the work shift.
8.13 Bargaining unit members who are contracted to work 3.5 to 5.99 hours shall receive one fifteen (15) minutes minute rest period, which shall, when practicable, be scheduled at the mid-point of the work shift.
8.14 Bargaining unit members who are contracted to work six (6) or more per day in excess hours shall receive two fifteen (15) minute rest periods. The first rest period shall, when practicable, be scheduled at the mid-point of the regular partfirst half of the shift and the second rest period shall, when practicable, be scheduled at the mid-time assignment point of the second half of the shift.
8.15 The District shall make lunchroom and restroom facilities available for a period of twenty (20) consecutive working days or more, shall have the regular assignment adjusted upward to reflect the longer hours, effective with the next pay periodbargaining unit member’s use.

13.7 Any unit member who works an average of fifteen thirty (1530) minutes or more per day in excess of the a regular part-part- time assignment for a period of twenty (20) consecutive working days or moremore by virtue of assignment to so work by his/her immediate supervisor, shall have the his/her regular assignment adjusted upward to reflect the longer hours in order to acquire fringe benefits on a pro rata basis. The District shall have the right to reduce upward adjusted hours back to regular work schedule when it is determined to be in the best interest of the District, however, the District may be required to utilize layoff or other legal procedures as required by law in order to reduce the adjusted hours. This section does not apply to temporary increases in assigned time to fill in for another unit member on leave of absence or vacation.
4.3 Bargaining unit members who work six (6) or more consecutive hours per day shall be entitled to an unpaid meal period of not less than thirty (30) minutes and no more than one hour, except bus drivers.
4.4 All bargaining unit members will be granted a rest period of fifteen (15) minutes for every four (4) consecutive hours of work.
4.5 Overtime will not be allowed unless the unit member has the prior approval of his/her immediate supervisor. Overtime compensation shall be based on the individual's rate of pay at the time the overtime was worked at time and one-half for all time over forty (40) hours a week or over eight (8) hours a day.
4.6 The District will grant a unit member paid time off for the purpose of voting in State or Federal elections if the unit member is required to be at work during the entire time the polls are open.
4.7 Unit members shall be granted paid time off to donate blood during District sponsored blood drives.
4.8 Any unit member working four (4) or more hours per day, five (5) days a week shall be paid overtime for any work required on the sixth or seventh consecutive day of work. Work done on the sixth consecutive day shall be compensated at a rate of time and one-half. Any unit member working less than four (4) hours per day shall be paid overtime for any work required on the seventh consecutive day of work. Work done on the seventh consecutive day shall be paid at a rate of double time.
4.9 Overtime shall first be offered to regular unit members at the site, in the classification that is responsible for performing the duties as defined in the job description. Offers of overtime shall be distributed on a rotating basis by seniority. In the event overtime cannot be filled by a site unit member serving in the classification, it will be offered to site unit members qualified to perform the duties. Unit members shall be first offered the opportunity to take pay for overtime before being offered compensatory time.
4.9.1 Compensatory time off must have prior approval by the immediate supervisor. Compensatory time off, if overtime, will be equal to one and one half times the number of hours actually worked. Non-overtime compensatory time shall be allowed with prior approval of his/her immediate supervisor, and shall be based upon the actual time worked. The supervisor who denies a compensatory time off request will attach an explanation. All compensatory time off requests will be handled in a timely manner. The compensatory time off shall be used by June 30th of the year accrued. If earned in June, time may be carried over to December of the following year. The District shall pay the employee for unused compensatory time in June of each school year.
4.10 For the purpose of computing the number of hours worked, time during which the unit member is excused from work because of holidays, vacation, sick leave and compensated time off shall be considered as time worked by the unit member.
4.11 The District will give CSEA and the unit member involved ten (10) working days’ notice before requiring a permanent change in work hours. When a change in work hours is planned, the unit member involved shall be consulted prior to the change taking effect. The change in work hours shall not be made for arbitrary or capricious reasons. CSEA and/or the unit member will be given an opportunity to meet, if requested. This will not apply to hour changes applicable to unit members with variable work hours.
4.12 Unit members called back to work without prior notice after the completion of their regular assignment shall be paid a minimum of four (4) hours pay. Time worked on call back where a regular daily assignment is less than eight (8) hours shall be paid at straight time up through eight (8) hours and all hours worked after eight (8) will be paid at time and one-half (1.5). The guaranteed four (4) hours shall not be applied toward overtime compensation unless actually worked; for example, a unit member called back for one
(1) hour will be paid for four (4) hours and an eight (8) hour unit member called back for three (3) hours will be paid four and one-half (4.5) hours. This will result in payment of a minimum of four (4) hours pay, or the actual time worked at one and one-half (1.5) (where applicable), whichever is greater.
4.13 Any unit member required by the District to take an examination shall be released for such purpose without loss of pay if the examination only occurs during the unit member's regular work hours.
4.14 Any unit member wishing to test for a District vacancy shall be permitted to do so without loss of pay if the test is only given during the unit member's regular work hours.
4.15 All unit members who work a complete shift between the hours of 2:00 p.m. and 6:30 a.m. shall be required to work only seven and one-half (7.5) hours, effective with rather than the next pay periodregular eight (8) hours. Overtime for evening and night shift unit members shall be awarded after thirty-seven and one-half (37.5) hours per week or seven and one-half (7.5) hours per day.
4.16 Subject to agreement by the worker and written approval by the supervisor and the Principal or Superintendent, unit members may be permitted to work alternative work schedules.

8.8 The District may fill a vacant position(s) with a substitute(s) for no longer than sixty (60) calendar days. After the completion of sixty (60) days the district shall not continue to fill the vacant position(s) with a substitute without an average agreement with CSEA.
8.9 A substitute may be hired for less than 195 days to replace a bargaining unit member who is temporarily absent from duty. This section does not preclude the District from hiring additional substitutes if the bargaining unit member’s absence is for more than 195 days.

8.14 Bargaining unit members who are contracted to work six (6) or more per day in excess hours shall receive two fifteen (15) minute rest periods. The first rest period shall, when practicable, be scheduled at the mid-point of the regular partfirst half of the shift and the second rest period shall, when practicable, be scheduled at the mid-time assignment point of the second half of the shift.

The parties agree that start and end times of paraeducator shifts shall be negotiated with CSEA annually for all departments and sites no later than July 31 of each year. District agrees to consider a number of District-wide “Floater” Paraeducator positions with fixed daily hours, to be assigned as needed to cover lunches and breaks, leaves of absence (in lieu of substitutes as preferred), and coverage for the students in the classroom who may ultimately need a Paraeducator per their IEP.
13.1 Unit members shall be on duty as assigned by the District. The length of the workday for full-time unit employees shall be eight (8) hours. The regular workweek shall consist of five (5) consecutive days, Monday through Friday, or forty (40) hours for full-time unit members. This Article shall not restrict the extension of the regular work day or work week and on an overtime basis when such is necessary to carry on the business of the District, except as provided for in the overtime section of this Agreement. When mutually agreeable between affected employees, CSEA and the District, some employees’ normal workweek may consist of four (4) consecutive days, ten (10) hours per day, and forty (40) hour week.

13.5.5 The District shall not change an employee or employees’ hours in order to avoid the payment of overtime.
13.6 Compensatory time off in lieu of cash compensation for overtime work may be granted at the appropriate rate in effect at the time earned.
13.6.1 The unit member has the sole discretion to request compensatory time in lieu of overtime pay.
13.6.2 Compensatory time is taken at the discretion of the unit member with twenty-four (24) hours notice to the supervisor. Allowances may be made in an emergency situation.
13.6.3 A unit member may decline a request for overtime.
13.6.4 Compensatory time must be used within one year of the date it was earned. 13.7 Any unit member who works an average of fifteen thirty (1530) minutes or more per day in excess of the a regular part-part- time assignment for a period of twenty (20) consecutive working days or moremore by virtue of assignment to so work by his/her immediate supervisor, shall have the his/her regular assignment adjusted upward to reflect the longer hours in order to acquire fringe benefits on a pro rata basis. The District shall have the right to reduce upward adjusted hours back to regular work schedule when it is determined to be in the best interest of the District, however, the District may be required to utilize layoff or other legal procedures as required by law in order to reduce the adjusted hours. This section does not apply to temporary increases in assigned time to fill in for another unit member on leave of absence or vacation.
4.3 Bargaining unit members who work six (6) or more consecutive hours per day shall be entitled to an unpaid meal period of not less than thirty (30) minutes and no more than one hour, effective except bus drivers.
4.4 All bargaining unit members will be granted a rest period of fifteen (15) minutes for every four (4) consecutive hours of work.
4.5 Overtime will not be allowed unless the unit member has the prior approval of his/her immediate supervisor. Overtime compensation shall be based on the individual's rate of pay at the time the overtime was worked at time and one-half for all time over forty (40) hours a week or over eight (8) hours a day.
4.6 The District will grant a unit member paid time off for the purpose of voting in State or Federal elections if the unit member is required to be at work during the entire time the polls are open.
4.7 Unit members shall be granted paid time off to donate blood during District sponsored blood drives.
4.8 Any unit member working four (4) or more hours per day, five (5) days a week shall be paid overtime for any work required on the sixth or seventh consecutive day of work. Work done on the sixth consecutive day shall be compensated at a rate of time and one-half. Any unit member working less than four (4) hours per day shall be paid overtime for any work required on the seventh consecutive day of work. Work done on the seventh consecutive day shall be paid at a rate of double time.
4.9 Overtime shall first be offered to regular unit members at the site, in the classification that is responsible for performing the duties as defined in the job description. Offers of overtime shall be distributed on a rotating basis by seniority. In the event overtime cannot be filled by a site unit member serving in the classification, it will be offered to site unit members qualified to perform the duties. Unit members shall be first offered the opportunity to take pay for overtime before being offered compensatory time.
4.9.1 Compensatory time off must have prior approval by the immediate supervisor. Compensatory time off, if overtime, will be equal to one and one half times the number of hours actually worked. Non-overtime compensatory time shall be allowed with prior approval of his/her immediate supervisor, and shall be based upon the next actual time worked. The supervisor who denies a compensatory time off request will attach an explanation. All compensatory time off requests will be handled in a timely manner. The compensatory time off shall be used by June 30th of the year accrued. If earned in June, time may be carried over to December of the following year. The District shall pay periodthe employee for unused compensatory time in June of each school year.
4.10 For the purpose of computing the number of hours worked, time during which the unit member is excused from work because of holidays, vacation, sick leave and compensated time off shall be considered as time worked by the unit member.
4.11 The District will give CSEA and the unit member involved ten (10) working days’ notice before requiring a permanent change in work hours. When a change in work hours is planned, the unit member involved shall be consulted prior to the change taking effect. The change in work hours shall not be made for arbitrary or capricious reasons. CSEA and/or the unit member will be given an opportunity to meet, if requested. This will not apply to hour changes applicable to unit members with variable work hours.
4.12 Unit members called back to work without prior notice after the completion of their regular assignment shall be paid a minimum of four (4) hours pay. Time worked on call back where a regular daily assignment is less than eight (8) hours shall be paid at straight time up through eight (8) hours and all hours worked after eight (8) will be paid at time and one-half (1.5). The guaranteed four (4) hours shall not be applied toward overtime compensation unless actually worked; for example, a unit member called back for one (1) hour will be paid for four (4) hours and an eight (8) hour unit member called back for three (3) hours will be paid four and one-half (4.5) hours. This will result in payment of a minimum of four (4) hours pay, or the actual time worked at one and one-half (1.5) (where applicable), whichever is greater.
4.13 Any unit member required by the District to take an examination shall be released for such purpose without loss of pay if the examination only occurs during the unit member's regular work hours.
4.14 Any unit member wishing to test for a District vacancy shall be permitted to do so without loss of pay if the test is only given during the unit member's regular work hours.
4.15 Subject to agreement by the worker and written approval by the supervisor and the Principal or Superintendent, unit members may be permitted to work alternative work schedules.

13.5 Overtime shall be paid, at the rate of time and one-half of an employee’s rate of pay, when an employee is required to work:
13.5.1 More than eight (8) hours in one (1) work day;
13.5.2 More than forty (40) hours in one (1) work week.
13.5.3 Saturday pay shall be paid at a rate of time and one-half, Sunday pay shall be paid at double time, and Holiday pay at time and one-half in addition to the regular salary.
13.5.4 The District will offer overtime on an equitable basis among qualified unit members at each department or work site. The District shall identify and assign unit members desiring to work overtime on a rotating basis, based on seniority.
13.5.5 The District shall not change an employee or employees’ hours in order to avoid the payment of overtime.
13.6 Compensatory time off in lieu of cash compensation for overtime work may be granted at the appropriate rate in effect at the time earned.
13.6.1 The unit member has the sole discretion to request compensatory time in lieu of overtime pay.
13.6.2 Compensatory time is taken at the discretion of the unit member with twenty-four (24) hours notice to the supervisor. Allowances may be made in an emergency situation.
13.6.3 4.2 A unit member may decline a request for overtime.
13.6.4 Compensatory time must be used within one year of the date it was earned. For hours not used within the year it was earned, all compensatory hours accrued through May 15, of the current fiscal year, shall be paid out with the employees’ last regular pay check in the month of June. Any hours accrued from May 16 through June 30 shall be paid at the end of the next fiscal year.
13.7 Any unit member who works an average of fifteen thirty (1530) minutes or more per day in excess of the a regular part-part- time assignment for a period of twenty (20) consecutive working days or moremore by virtue of assignment to so work by his/her immediate supervisor, shall have the his/her regular assignment adjusted upward to reflect the longer hours in order to acquire fringe benefits on a pro rata basis. The District shall have the right to reduce upward adjusted hours back to regular work schedule when it is determined to be in the best interest of the District, however, the District may be required to utilize layoff or other legal procedures as required by law in order to reduce the adjusted hours. This section does not apply to temporary increases in assigned time to fill in for another unit member on leave of absence or vacation.
4.3 Bargaining unit members who work six (6) or more consecutive hours per day shall be entitled to an unpaid meal period of not less than thirty (30) minutes and no more than one hour, except bus drivers.
4.4 All bargaining unit members will be granted a rest period of fifteen (15) minutes for every four (4) consecutive hours of work.
4.5 Overtime will not be allowed unless the unit member has the prior approval of his/her immediate supervisor. Overtime compensation shall be based on the individual's rate of pay at the time the overtime was worked at time and one-half for all time over forty (40) hours a week or over eight (8) hours a day.
4.6 The District will grant a unit member paid time off for the purpose of voting in State or Federal elections if the unit member is required to be at work during the entire time the polls are open.
4.7 Unit members shall be granted paid time off to donate blood during District sponsored blood drives.
4.8 Any unit member working four (4) or more hours per day, five (5) days a week shall be paid overtime for any work required on the sixth or seventh consecutive day of work. Work done on the sixth consecutive day shall be compensated at a rate of time and one-half. Any unit member working less than four (4) hours per day shall be paid overtime for any work required on the seventh consecutive day of work. Work done on the seventh consecutive day shall be paid at a rate of double time.
4.9 Overtime shall first be offered to regular unit members at the site, in the classification that is responsible for performing the duties as defined in the job description. Offers of overtime shall be distributed on a rotating basis by seniority. In the event overtime cannot be filled by a site unit member serving in the classification, it will be offered to site unit members qualified to perform the duties. Unit members shall be first offered the opportunity to take pay for overtime before being offered compensatory time. .
4.9.1 Compensatory time off must have prior approval by the immediate supervisor. Compensatory time off, if overtime, will be equal to one and one half times the number of hours actually worked. Non- overtime compensatory time shall be allowed with prior approval of his/her immediate supervisor, and shall be based upon the actual time worked. The supervisor who denies a compensatory time off request will attach an explanation. All compensatory time off requests will be handled in a timely manner. The compensatory time off shall be used by June 30th of the year accrued. If earned in June, time may be carried over to December of the following year. The District shall pay the employee for unused compensatory time in June of each school year.
4.10 For the purpose of computing the number of hours worked, time during which the unit member is excused from work because of holidays, vacation, sick leave and compensated time off shall be considered as time worked by the unit member.
4.11 The District will give CSEA and the unit member involved ten (10) working days’ notice before requiring a permanent change in work hours. When a change in work hours is planned, the unit member involved shall be consulted prior to the change taking effect. The change in work hours shall not be made for arbitrary or capricious reasons. CSEA and/or the unit member will be given an opportunity to meet, if requested. This will not apply to hour changes applicable to unit members with variable work hours.
4.12 Unit members called back to work without prior notice after the completion of their regular assignment shall be paid a minimum of four (4) hours pay. Time worked on call back where a regular daily assignment is less than eight (8) hours shall be paid at straight time up through eight (8) hours and all hours worked after eight (8) will be paid at time and one-half (1.5). The guaranteed four (4) hours shall not be applied toward overtime compensation unless actually worked; for example, a unit member called back for one (1) hour will be paid for four (4) hours and an eight (8) hour unit member called back for three (3) hours will be paid four and one-half (4.5) hours. This will result in payment of a minimum of four (4) hours pay, or the actual time worked at one and one-half (1.5) (where applicable), whichever is greater.
4.13 Any unit member required by the District to take an examination shall be released for such purpose without loss of pay if the examination only occurs during the unit member's regular work hours.
4.14 Any unit member wishing to test for a District vacancy shall be permitted to do so without loss of pay if the test is only given during the unit member's regular work hours.
4.15 All unit members who work a complete shift between the hours of 2:00 p.m. and 6:30 a.m. shall be required to work only seven and one-half (7.5) hours, effective with rather than the next pay periodregular eight (8) hours. Overtime for evening and night shift unit members shall be awarded after thirty-seven and one-half (37.5) hours per week or seven and one-half (7.5) hours per day.
4.16 Subject to agreement by the worker and written approval by the supervisor and the Principal or Superintendent, unit members may be permitted to work alternative work schedules.

HOURS AND OVERTIME. The District agrees to extend hours of some paraeducator position to 6.5 hours per day. The parties agree that start and end times of paraeducator shifts shall be negotiated with CSEA annually for all departments and sites no later than July 31 of each year. District agrees to consider a number of District-wide “Floater” Paraeducator positions with fixed daily hours, to be assigned as needed to cover lunches and breaks, leaves of absence (in lieu of substitutes as preferred), and coverage for the students in the classroom who may ultimately need a Paraeducator per their IEP.
13.1 Unit members shall be on duty as assigned by the District. The regular workweek shall consist of up to five (5) consecutive days, Monday through Friday, or forty (40) hours workdays for full-time unit members. 13.1.1 The length of the workday shall initially be designated by the District for each classified assignment in accordance with the provisions set forth in this Agreement. Each unit member shall be assigned a fixed, regular, and ascertainable minimum number of hours per day, days per week.
13.2 Rest breaks of fifteen (15) minutes for each all employees rendering service averaging four (4) hours worked or more per day during the workweek.
6.2 The workday and workweek for all employees shall be providedestablished and regularly fixed by the District. Except; however, whenever it becomes necessary for the District to modify either the work day or the work week of any employee, the District shall give the employee as much advance notice as possible, but in any event, not less than ten (10) calendar days. Furthermore, any work schedule modification shall remain in effect for the duration of the need, but in any event, for at least thirty (30) calendar days.
13.3 An uninterrupted lunch break 6.3 The District retains the right to extend the regular workday or work week of not employees when it deems it necessary to carry out the District’s business.
6.4 A non-compensated meal period of no less than thirty (30) minutes shall be provided to all employees who render service of at least five (5) hours. The length of the meal period shall be determined by the supervisor. The supervisor shall assign the meal period to be taken as soon after the conclusion of four (4) hours of service as possible.
6.5 A fifteen-(15) minute compensated rest period shall be provided employees for each three and not more than one a half (13.5) hour period of service. This rest period shall be provided.
13.3.1 In individual situations, a supervisor, taken at the request direction of the unit member, may allow a variation in the lunch break schedule for a unit member in order to allow flexibility in the unit member’s regular work day.
13.3.2 No modification shall reduce the lunch break to less than thirty (30) minutes.
13.4 Breaks enumerated under Articles 13.2 and 13.3 above shall be scheduled by management as supervisor at or near the midpoint of each work four-(4) hour period as possible, consistent with the District’s work scheduleof service.
13.4.1 For unit members who serve other than full-time in their job classifications as set forth in this Agreement, leaves, vacations and holidays which occur within the unit member’s work year 6.6 Overtime compensation shall be earned at the ratio provided employees who are directed by their immediate supervisor to work in excess of the unit member’s assigned hours to a full-time classified work day.
13.5 Overtime shall be paid, at the rate of time and one-half of an employee’s rate of pay, when an employee is required to work:

6.7 Employees who are required to report for work on their non-workdays, holidays, or outside of their regular hours on workdays, shall be paid overtime compensation for the actual time worked, but in no event for less than two (2) hours compensation. If an employee who is called out for such work outside of his regular hours on a workday continues to work into his regular hours, he shall be paid overtime compensation only for the actual time worked. If an employee performs overtime work immediately following the end of his regular shift, he shall be paid overtime compensation only for the actual time worked. Extra work of one (1) work week.
