Initial Request and Response. (a) If Operator requests WCMRC to respond to a spill of Oil on water in WCMRC’s GAR (“Initial Request”), WCMRC shall use its Best Efforts to provide a response (“Initial Response”). The Initial Request shall specify the approximate location and size of the spill, that the individual contacting WCMRC is authorized by Operator to request Marine Spill Response Services under this Agreement, the name of the ship (if applicable), the type of Oil involved, the contract number assigned to this Agreement and the nature and extent of the Marine Spill Response Services required. The Initial Request shall be documented by a WCMRC Duty Officer and will be followed by a draft work order. (b) Upon receipt of each draft work order, Operator shall determine the extent to which it requests WCMRC to perform the Marine Spill Response Services set forth in the draft work order and the parties shall consult and agree on the Marine Spill Response Services which WCMRC is to undertake and complete. (c) The parties shall evidence their agreement by signing a Work Order (each a “Work Order”). WCMRC will not commence any Marine Spill Response Services until the parties have agreed on the terms of a Work Order and both parties have signed same. (d) Upon being signed by both parties, a Work Order shall become an integral part of thisAgreement. (e) Each Work Order shall include a description of the Marine Spill Response Services to be performed by WCMRC and may, in WCMRC’s sole discretion, provide an estimate of WCMRC Fees payable in connection with the Marine Spill Response Services. (f) Work Orders shall be issued from time to time as the response changes, or until such time as overall command of the response is under a Unified Command structure. If the response isunder a Unified Command, response tasks relevant to WCMRC that are detailed in the Incident Action Plan are deemed to have been approved by Operator. WCMRC may or may not cease issuing individual Work Orders once a Unified Command begins issuing Incident Action Plans. (g) WCMRC will invoice Operator for all WCMRC Fees and Taxes borne from approved Work Orders and Incident Action Plans.

The Initial Request shall specify the approximate location and size of the spill, that the individual contacting Western Canada Marine Response is the person authorized to implement the agreement, the type of Oil involved, and the nature and extent of the Marine Spill Response Services required. The Initial Request shall be documented by a Western Canada Marine Response Duty Officer and will be followed by a Work Order that the Requesting Party shall approve before a response commences. (b) Upon receipt of each Work Order, Requesting Party shall determine the extent to which it wishes Western Canada Marine Response to perform the Marine Spill Response Services set forth in the Work Order and the parties shall consult and agree on the Marine Spill Response Services which Western Canada Marine Response is to undertake and complete. (c) Upon being signed by both parties, a Work Order shall become an integral part of this Agreement. (d) Work orders shall be issued from time to time as the response changes, or until such time as overall command of the response is under a Unified Command structure. If the response is under Unified Command, response tasks relevant to Western Canada Marine Response detailed in the Incident Action Plan are considered approved by the Requesting Party and Western Canada Marine Response may cease issuing Work Orders. (e) Western Canada Marine Response will invoice Requesting Party for all response costs borne from approved Work Orders and Incident Action Plans

The Initial Request shall specify the approximate location and size of the spill, that the individual contacting Alert is the person authorized to implement the arrangement, the name of the ship, the type of Oil involved, the contract number identified in Operator’s confirmation of arrangement form and the nature and extent of the Marine Spill Response Services required. If the Initial Request is not provided in writing, then it shall be confirmed in writing forthwith. Unless otherwise agreed between the parties, the Initial Response shall consist of the provision of Marine Spill Response Services for up to forty-eight (48) hours.

Initial Request and Response. 2.1 Upon the occurrence with Alert’s geographic area of response of a spill of Oil on Waters, Owner shall (where it has requested Alert to respond to such spill) be responsible for the management and control of all response activities. 2.2 If Owner requests Alert to respond to a spill of Oil on Waters in Alert’s geographic area of response (the “Initial Request”), Alert shall use its Best Efforts to provide a response (the “Initial Response”). The Initial Request shall specify the approximate location and size of the spill, that the individual contacting Alert is the person authorized to implement the arrangement, the name of the ship, the type of oil involved, the contract number identified in this form and the nature and extent of the Marine Spill Response Services required. If the Initial Request is not provided in writing then it shall be confirmed in writing forthwith. 2.3 Unless otherwise agreed between the parties, the Initial Response shall consist of the provision of Marine Spill Response Services for up to 24 hours.
Initial Request and Response. If Converge desires that VNE perform any Professional Services that the Project Managers anticipate would cause VNE to materially exceed (on a pro-rata monthly basis for the given quarter, unless otherwise mutually agreed upon in writing) the Quarterly Allocation, Converge shall submit to VNE a written request for such Professional Services, which request shall detail the Professional Services being requested in reasonable detail. Within 45 days after VNE's receipt of Converge's request for VNE to perform any such Professional Services, VNE shall furnish to Converge a preliminary statement of work (including proposed pricing, which shall take into account any portion of such work that will be covered by a portion of the Quarterly Allocation) under which VNE would be willing to perform such Professional Services for Converge (each, a "Proposed SOW"). VNE may respond to separate requests for Professional Services in a single Proposed SOW; provided, however, that the Proposed SOW will itemize the foregoing information separately for each of the requested Professional Services.
Initial Request and Response. Subscriber may make a request for WCMRC to respond to a Spill (“Initial Request”). The Initial Request shall specify the approximate location and size of the Spill, that the individual contacting WCMRC is the person authorized to make the Initial Request, the type of Oil involved and the nature and extent of the Marine Spill Response Services required. If the Initial Request is not provided in the form of a Work Order, then Subscriber shall confirm all details of the Initial Request in the form of a Work Order, that is signed by both subscriber and WCMRC, forthwith and WCMRC will not be required to commence provision of services hereunder unless a Work Order has been prepared and signed by all parties. Upon receiving the Initial Request, WCMRC shall, subject to the terms and conditions of this Agreement, use its Best Efforts to provide a response to the Initial Request. Unless otherwise agreed between the parties, the initial response to an Initial Request shall consist of the provision of Marine Spill Response Services for up to twenty-four (24) hours (or such longer period as WCMRC and Subscriber may agree by written agreement (including by way of a signed Work Order)).
