Inspection Process. The AGTA is hereby amended by adding the following new Section 5.6 immediately following Section 5.5 of the AGTA for the 787 Aircraft, the intent of which is to define the 787 inspection process [CONFIDENTIAL PORTION OMITTED AND FILED SEPARATELY WITH THE COMMISSION PURSUANT TO A REQUEST FOR CONFIDENTIAL TREATMENT]. Notwithstanding the foregoing, the representations, warranties, indemnities and agreements of Boeing made in the AGTA or the Purchase Agreement shall not be affected or deemed waived by reason of any investigation made by Customer pursuant to this Letter Agreement.
Inspection Process. (a) No less than 5 Business Days prior to reaching an Inspection Stage as set out in the Inspection Schedule, the Owner must notify the Council of the proposed inspection date (Inspection Date).
(b) On the Inspection Date, or other agreed date, the Owner must ensure that any employees, contractors, agents or representatives of the Council have access to and may enter the Land to inspect the Contribution Works.
(c) In addition to carrying out inspections in accordance with the Inspection Schedule, the Council may enter the Land or any part of the Land on which the Public Domain Works are located to inspect the progress of the Public Domain Works, subject to:
(i) the terms of the Construction Contract (save for any clause of the Construction Contract which prevents the Council from accessing the Land);
(ii) giving reasonable notice to the Owner;
(iii) complying with all reasonable directions of the Owner; and
(iv) being accompanied by the Owner or a nominee, or as otherwise agreed.
Inspection Process. A formal inspection regime will be carried out. Any officer or agent of the Council shall be entitled at any time when directed by the Council to enter a site and inspect any allotment plot. All plots will be inspected on a quarterly basis to ensure there is adequate maintenance. Should any plots fall below the required standard, the process for non-cultivation will be instigated. This includes :-
1. An initial meeting with the plot holder to establish any issues.
2. Sending a formal letter warning of the consequences of non- cultivation giving an appropriate timescale (usually four weeks) in which to bring the plot to the required standard.
3. A final letter confirming that should the plot not be brought up to the required standard, the tenancy will be terminated.
Inspection Process. Filed Inspectors will inspect installations and assure that the projects are complete and accurately described in the completed Work Orders. Field Inspectors will also confirm the project has been installed in compliance with all applicable codes, the site has been cleaned up satisfactorily, and the customer is satisfied with the work performed. Inspection reports will be uploaded to SMART regularly by Field Inspectors and reviewed by the Field Manager. After inspection, final completed Work Orders and Punch lists, if necessary, will be submitted by the Field Supervisor to the Project Coordinators for review and upload into SMART. Project Coordinators will perform the final review of all documentation to confirm that it complies in all respects to the Work Order and Invoice checklists. Setting a standard of what constitutes an acceptable piece of project documentation is vital to ensuring a smooth and consistent invoicing process. Below are the key criteria which will determine whether project documentation will be approved once it is invoiced.
Inspection Process. Following inspection, Dealer shall advise FGUSA or Xxxxxxx, as applicable, in writing within the time frames specified above, of any alleged defects in the Products. FGUSA or Xxxxxxx shall, respectively, remedy any defects - which the parties agree are defects --within thirty (30) days (or such longer period as is reasonably necessary) of receipt of the Dealer's advice thereof. If Dealer has certified the existence of a material defect, either individually or collectively, upon FGUSA's or Xxxxxxx'x certification, as applicable, that the material defect, either individually or collectively, has been corrected, Dealer shall be provided notice thereof and upon satisfactory re-inspection of the yacht within such reasonable time as specified in the notice, Dealer shall thereupon accept and pay for the yacht. If FGUSA or Xxxxxxx fail to remedy the defect, Dealer shall not be required to accept or pay for the yacht. The failure by Dealer to advise FGUSA or Xxxxxxx, as applicable, of alleged defects prior to Delivery, as provided herein, shall constitute an absolute waiver by Dealer, or any party claiming through Dealer, of any claims for obvious defects. The parties acknowledge, however, that such a waiver shall not hinder Dealer's ability to make appropriate warranty claims.
