Quality of Goods and Services. 14.1 The Bank shall not, in any way, be responsible for merchandise, merchandise warranty or services purchased, or availed by you from Merchant Establishments, including on account of delay in delivery, non-delivery, non-receipt of goods or receipt of defective goods by you.

Quality of Goods and Services. Unless otherwise specified, all materials shall be new and both workmanship and materials shall be of the highest quality. All workers and subcontractors shall be skilled in their trade. Contractor guarantees all Work against defects in material or workmanship for a period of two years from the date of acceptance or final payment from County, whichever is later. Contractor shall assign all manufacturers’ warranties to County and all guarantees and warranties of goods supplied under this Contract shall be deemed to run to the benefit of County. Contractor shall provide County with all manufacturer’s warranty documentation and operations and maintenance manuals.
Quality of Goods and Services. CS Corp. acknowledges that Schwab has, and Schwab acknowledges that CS Corp. intends to develop, the highest quality reputation for the delivery of goods and services in the Financial Services Business, and each agrees that the goods and services offered by it or him using the Name or Likeness shall be of such quality as to be appropriate and suited to the protection and enhancement of the Name and Likeness and the good will appurtenant thereto, that such goods and services will be manufactured, sold, distributed and performed in accordance with all Federal, state and local laws that are applicable and material, and that the sale, distribution, provision of services, and/or exploration by it or him shall be of the highest standard and that the same shall in no manner reflect adversely upon the good name of the other or the Name and/or Likeness. Further, CS Corp. agrees not to use any Likeness in advertising or as a xxxx while Schwab is alive without first obtaining Xxxxxx’x approval of his appearance in the Likeness, but such approval shall not be unreasonably withheld.
Quality of Goods and Services. Any dispute with or complaint against any Merchant Establishment regarding any goods purchased or services availed must be directly resolved by the Customer with the Merchant Establishment.

It must be distinctly understood that the Card facility is purely a facility to the Cardholder to purchase goods or avail of services and the Bank holds no warranty or makes no representation about quality, quantity, delivery or otherwise howsoever regarding the goods or services, and the Cardholder with the Merchant must resolve any dispute. The existence of a dispute shall not relieve the Cardholder of the obligations to the Bank, notwithstanding any of his/her objections to the Bank pending dispute or claim whatsoever.

Quality of Goods and Services. 5.1 The Supplier warrants that on delivery, the Finished Product shall: (a) conform in all material respects with the Goods Specification and the Services Specification; (b) be free from material defects in design, material and workmanship; (c) be of satisfactory quality (within the meaning of the Sale of Goods Act 1979); and (d) be fit for any purpose held out by the Supplier. 5.2 The Customer unconditionally acknowledges and agrees that the nature and intended use of Finished Product are such that a representation or warranty on the part of the Customer that Finished Product will comply with any and each element of clause 5.1 for a period of more than 10 consecutive Business Days after delivery would be inappropriate. 5.3 If the Customer considers that on delivery some or all items of Finished Product did not comply with any element of clause 5.1 it shall give notice of such fact within 3 Business Days after delivery, as to which time shall be of the essence, and shall grant the Supplier, at the Supplier’s cost, a reasonable opportunity to inspect the Finished Product (or instalment of it as the case may be) at the Customer’s Premises. The Customer may not intimate a claim for damages for breach of warranty under this clause later than 10 Business Days after the delivery of Finished Product to which it relates. 5.4 If, upon such inspection it is agreed that: (a) Up to and including 10% by number of the Finished Product (or instalment) did not comply with any element of clause 5.1 the Supplier shall allow the Customer a corresponding abatement in price which the Customer shall accept in full and final settlement of any and all claims and remedies it may have against the Supply in respect of such failure to comply; or (b) More than 10% by number of the Finished Product (or instalment) did not comply with any element of clause 5.1 the Customer may elect to reject the Finished Product (or instalment) in its entirety or to pay for such amount as does so comply at the rate specified in the Contract and require the Supplier to replace the defective items of Finished Product with compliant Finished Product within 20 Business Days (the Customer supplying at the Supplier’s cost any additional Customer’s Material needed for the purpose). 5.5 The Supplier shall not be liable for the failure of any item in the Finished Product to comply with any element of the warranty in clause 5.1 if: (a) the Customer makes any use of such item after giving a notice in accordance w...

Quality of Goods and Services. ‌ Concessionaire shall ensure that all customers are provided First Class goods and services, and Concessionaire shall keep in stock and have ready for sale at all times of operation, a sufficient supply and variety of goods and services offered for sale at each Concession Location, consistent with the Price List, to meet the demand of customers at DEN. If City identifies any deficiencies with respect to the operations, including, without limitation, quality, variety, and quantity of goods or services offered, Concessionaire shall be notified in writing by City and shall correct, or cause to be corrected, such problem or problems within seven (7) days, unless City authorizes in writing a longer period. If Concessionaire fails to correct within seven (7) days after written notice is given by City, City may collect liquidated damages as described in VIII. Concessionaire shall develop and implement creative merchandising techniques to optimize customer satisfaction and Gross Receipts including, without limitation, retail merchandise displays; promotional displays; attractive and durable packaging; and menu boards. Prices for all goods and services shall be displayed and visible to all customers. All retail merchandise and other items sold or kept for sale shall be of high quality and wholesome, and must conform to the fullest extent with all applicable food and drug laws, ordinances and regulations, as well as DEN’s Rules and Regulations and Operating Directives. Concessionaire has printed signage and price lists shall include the appropriate use of descriptive terminology that accurately and truthfully describes the goods and services being offered. City reserves the right to approve all menus and product displays. Concessionaire hereby affirms that City, in its sole discretion, has the absolute right to require that Concessionaire discontinue the sale of any goods and services City deems unsatisfactory, distasteful, or inappropriate for any reason and to require Concessionaire to modify menus, signage, and product displays for any reason. If Concessionaire fails to comply with any such City request within one (1) day after written notice from City, City may collect liquidated damages as described in Article VIII. All franchise standards applicable to a Concession Location shall be met or exceeded. Quality of Goods and Services. This Order is subject to the requirements contained in the Carrier Supplier Quality Manual (CSQM), which is incorporated into this order for all goods to be used in production. The CSQM is located on the Carrier website. Seller acknowledges receipt, review and acceptance of the CSQM. Buyer reserves the right at its discretion to revise or amend the CSQM at any time, and Seller agrees that any such revised or amended CSQM, as posted on the Carrier website or otherwise made available to Seller, shall be binding on this order and Seller. All goods sold by Seller to Buyer pursuant to this order shall conform to Buyer’s quality standards and requirements set forth in any specifications, drawings, samples or other document upon which this order is based. Prior to delivery, Seller shall inspect and test the goods for quality in compliance with this order. The Seller shall keep records of all such quality inspections and tests and, if so requested by Buyer, supply Buyer with copies of such records. Buyer, without prejudice to any other rights or remedies, including the right to inspect goods after delivery, shall have the right at all times to inspect and test the goods during manufacture or processing or while stored under Seller’s control. Seller shall not make any changes during the term of this order in the quality, in the location of manufacture, or in Seller’s processes related to the goods without prior notification to and written acceptance of such changes by the Buyer. Any accepted changes shall become the controlling standard of quality for the remaining term of this order.
