Maintenance of the System a. Grantee shall at all times employ ordinary care in the maintenance and operation of the Cable System so as not to endanger the life, health or property of any citizen of the Grantor or the property of the Grantor. b. All construction practices and installation of equipment shall be done in accordance with all applicable sections of the National Electric Safety Code. c. The Cable System shall be designed, constructed and operated so as to meet those technical standards adopted by the FCC relating to Cable Systems contained in part 76 of the FCC’s rules and regulations as they may, from time to time, be amended.

Maintenance of the System. The Borrower shall maintain the System, including the Project, in good condition and repair and make all necessary renewals, replacements, additions, betterments and improvements thereto. The Borrower shall not grant or permit to exist any lien on the System or the Project other than liens securing System Debt where a parity or superior lien secures this Loan Agreement and the Borrower Bond, provided that this Section shall not be deemed violated if a mechanic’s or contractor’s lien is filed against the property, as long as the Borrower uses its best efforts to obtain the discharge of such lien, and promptly reports the filing of such lien, the proposed steps to discharge the lien, and the discharge of the lien to the District.
Maintenance of the System. Tenant shall operate and maintain the System and Equipment in good working order, in a safe and clean manner, and in accordance with all applicable laws, rules and regulations. In the event the System or Equipment become damaged or destroyed at any time during the Term, Tenant shall have the right to repair, replace or reinstall the Equipment or any portion thereof at times approved by Landlord, which approval shall not be unreasonably withheld or delayed, and in a manner which complies with the terms of this Lease. If the Equipment is damaged or destroyed as a direct result of the breach, act or omission, negligence or willful misconduct of Landlord, its agents, employees, contractors, authorized representatives or invitees, Landlord shall be liable for the full cost of any repair, replacement or reinstallation necessitated thereby; provided, however, it is expressly understood and agreed that Landlord shall not liable for the acts or omissions of other tenants of the Property.
Maintenance of the System. (a) FirstLink shall maintain the System in good order, condition and repair. (b) Routine maintenance services shall be performed by FirstLink during normal working hours.

Buyer shall not, directly or indirectly, control, supervise or direct the operation of the System. Seller will continue at all times prior to the Closing Date to control, supervise and direct the operation of the System. From the date hereof until the Closing Date, Seller agrees that it will, unless otherwise consented to in writing by Buyer: 1. use commercially reasonable efforts to keep available the services of the present employees of Seller's business (except as provided in Section 8.5); encourage such employees to accept employment with Buyer (if such employment is offered); and use commercially reasonable efforts to preserve its relationships with customers, suppliers and others having business dealings with Seller to the end that its goodwill and ongoing business shall be conducted on substantially the same basis on the Closing Date as on the date hereof;
Maintenance of the System. Power Provider shall maintain the System in good working order, ordinary wear and tear excepted, and shall ensure that the System performs consistent with the specifications set forth in Exhibit B (System), attached hereto. Host Customer Responsibilities. Host Customer shall be responsible for maintaining and fulfilling all contractual obligations with respect to its interconnected utility Power Provider, including with respect to such interconnection service, power supply service, net-metering arrangements and delivery service, and, where applicable, meet all requirements imposed by the local utility and the California Public Utilities Commission with respect to such service. Host Customer will furnish, or cause others to furnish, for the Service Term hereof, to the Power Provider, promptly as information becomes available, accurate and complete data concerning energy usage for and other information pertaining to the Premises, including but not limited to the following: Utility records throughout the Service Term; Any energy or environmental audits performed during the Service Term relating to all or any part of the Premises; and Any service or maintenance agreement(s) entered into during the Service Term regarding the BES, or any part thereof. Notice of Malfunction. Host Customer shall utilize its best efforts to notify Power Provider within twenty-four (24) hours of Host Customer’s actual notice of (a) any material malfunction in the operation of the equipment installed on the Premises in connection with this Agreement or equipment affected by the Output provided pursuant to this Agreement (including the BES) and/or (b) any interruption or alteration of the energy supply to the Premises.
