Lay-off, Recall and Notice. In the case of lay-off and recall from lay-off, seniority shall be the governing factor, provided that in all cases the Company has the right to retain, lay-off or recall employees on the basis of the employee being able to perform the work required. Where the Company decides to lay-off employees, the Company will give fifteen (15) calendar days notice which will be posted, except in situations where lay- offs occur due to emergencies beyond the control of the Company, where every effort will be made to give as much notice as possible. Where the Company has not given proper notice, the affected employees scheduled to work during the notice period will be paid eight (8) times their straight time hourly rate for each regular work day that proper notice was not given. The Company will meet with the Plant Committee prior to any lay-off in order to review the schedule of employees to be retained or laid-off.
