Leave for Extended Illness or Disability. An employee who is unable to work because of personal illness or disability and who had exhausted all sick leave available shall be granted a leave of absence for up to one (1) year. He shall be paid the difference between his salary and that of a replacement for a maximum of thirty (30) days after his sick leave-has been exhausted and during the next eleven (11) months he shall be paid nothing under this provision. A written request to return to work may be made at any time during the leave for extended illness or disability. Upon receipt of such written request for re-employment, the District shall offer as soon as practicable, the same professional assignment the employee held before being on extended illness or disability leave or a substantially equivalent professional assignment, if said assignment is available. If said assignment is not available, the School Board shall offer the employee any other available professional assignment for which the employee is certified until such time as the Board can, through established placement procedures, offer the employee the professional assignment the employee held before, or one substantially similar to it.

Leave for Extended Illness or Disability. A leave for extended illness or disability is defined as an unpaid leave granted or required by the University for medical reasons after a faculty member has exhausted all accrued sick leave and Family and Medical Leave. This leave shall be granted to tenured faculty who apply. This leave may be granted to untenured faculty who apply.
Leave for Extended Illness or Disability. Any teacher under continuing contract who is unable to perform the normal functions and duties of his/her position because of personal illness or disability, shall submit a written request for leave for extended illness or disability without pay for the duration of the illness or disability up to one year. All paid days, sick and personal, must be used before using leave without pay days. Any leave of absence granted by the Board under this article shall run concurrently with Family Medical Leave. Included will be a physician's statement verifying said illness or disability to the Superintendent. Included in such statement from the physician shall be the date that the physician estimates that the employee will be able to resume his/her normal duties. The actual date of return shall be at a semester break or grading period break, or at other times subject to the District’s sole discretion. Prior to the teacher returning to full-time teaching, the physician shall verify that the teacher is capable of returning to teaching without any adverse effects on the individual's health or the students under the teacher's direction. Furthermore, it is understood that satisfactory medical evidence of continued illness or disability shall be provided to the Superintendent by the teacher at such time(s) and in such manner as the Superintendent may require. The Board shall have discretion in deciding to grant leaves requested under this Article. This leave may be renewed by the Board at its sole discretion on a yearly basis upon receipt of a written request from the teacher. To request a leave under this Article, a staff member must have completed two (2) years of service in the District. At any point during the leave the District may request that an employee provide documentation as to the employee’s ability to return to his/her duties.

  • Illness or Disability If, because of Employee’s illness or other disability for a continuous period of more than 45 days, Employee is unable to render the services required by the Company as provided herein, the Company may terminate Employee’s employment hereunder by written notice to Employee at least 30 days in advance of such termination. Upon such termination Employee shall not be entitled to any further payments of any nature, except for payment of (a) any earned but unpaid Annual Base Salary, (b) any unpaid bonuses and (c) unreimbursed business expenses (collectively, “Payable Amounts”). All Payable Amounts shall become due and payable on the date of such termination.

  • Death or Disability The Executive's employment shall terminate automatically upon the Executive's death during the Employment Period. If the Company determines in good faith that the Disability of the Executive has occurred during the Employment Period (pursuant to the definition of Disability set forth below), it may give to the Executive written notice in accordance with Section 12(b) of this Agreement of its intention to terminate the Executive's employment.   • Extended Disability Leave a. Due to a medical disability, an employee shall be granted an extended leave of absence without pay (subject to Paragraph d hereof) if any one of the following conditions exists:

  • Accommodation for Disabilities MAHEC complies with the Americans with Disabilities Act, as amended, Section 504 of the Rehabilitation Act, and state and local requirements regarding Fellow with disabilities. Upon request, MAHEC will provide a reasonable accommodation to the known physical or mental limitations of an otherwise qualified applicant or employee with a disability, unless doing so would impose an undue hardship on MAHEC.

  • Re-employment After Voluntary Termination or Dismissal for Cause Where an employee voluntarily leaves the Employer's service, or is dismissed for cause and is later re-engaged, seniority and all perquisites shall date only from the time of re-employment, according to regulations applying to new employees.

  • Disability If, as a result of the Executive's incapacity due to physical or mental illness, the Executive shall have been absent from his duties with the Company on a full-time basis for six months and within 30 days after written notice of termination is thereafter given by the Company the Executive shall not have returned to the full-time performance of the Executive's duties, the Company may terminate this Agreement for "Disability."

  • Disability Retirement If, as a result of your incapacity due to physical or mental illness, You shall have been absent from the full-time performance of your duties with the Company for 6 consecutive months, and within 30 days after written notice of termination is given You shall not have returned to the full-time performance of your duties, your employment may be terminated for "Disability." Termination of your employment by the Company or You due to your "Retirement" shall mean termination in accordance with the Company's retirement policy, including early retirement, generally applicable to its salaried employees or in accordance with any retirement arrangement established with your consent with respect to You.

  • Permanent Disability Permanent Disability" shall mean Employee's physical or mental incapacity to perform his or her usual duties with such condition likely to remain continuously and permanently as determined by Employer.
