Limited Equipment Warranty. Where Customer purchases a security system under this Agreement, SCSS warrants that the equipment will be free from defects in material and workmanship for a period of 90 DAYS from the date the security system is placed into operation. If, during this warranty period, any of the equipment or parts are defective or malfunction, they will be repaired or replaced, at SCSS’s sole option, free of charge. Warranty repair is done 8:00 am – 4:00 pm local time, Monday through Friday, excluding holidays. This warranty will not apply if the damage or malfunction occurs because the system has been adjusted, added to, altered, abused, misused or tampered with by the Customer, operated or used contrary to the operating instructions, software is used with an operating system other than that specified by SCSS or its original equipment manufacturer (“OEM”), performance issues relating to the use of Customer’s data network(s), power fluctuations, or any other cause not within the cause or control of SCSS. If inspection by SCSS fails to disclose any defect covered by this limited equipment warranty, the equipment will be repaired or replaced on a time and material basis. DISCLAIMER OF ALL OTHER WARRANTIES: WITH THE EXCEPTION OF THE FOREGOING LIMITED EQUIPMENT WARRANTY, SCSS MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, THAT THE SYSTEM OR SERVICE SUPPLIED MAY NOT BE COMPROMISED, OR THAT THE SYSTEM OR SERVICE WILL IN ALL CASES PROVIDE THE PROTECTION FOR WHICH IT IS INTENDED. IN NO EVENT WILL SCSS, ITS EMPLOYEES, AGENTS OR REPRESENTATIVES BE RESPONSIBLE FOR CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES OF ANY NATURE WHATSOEVER. SCSS MAKES NO WARRANTIES CONCERNING ANY EQUIPMENT OR DEVICES ATTACHED TO CUSTOMER'S SYSTEM UNLESS SUCH EQUIPMENT OR DEVICES WERE ORIGINALLY PURCHASED AND INSTALLED UNDER THIS AGREEMENT. STATE LAW. SOME STATES DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR A LIMITATION ON THE DURATION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. THE WARRANTY PROVIDES SPECIFIC LEGAL RIGHTS AND CUSTOMER MAY ALSO HAVE OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.

Limited Equipment Warranty. We warrant that if any part of the Equipment (excluding batteries) does not work because of a defect in materials or workmanship, we will repair or replace that part at no charge to you: a) during the Initial Term, for a period equal to the greater of (i) the remaining duration of the Initial Term or (ii) one (1) year from the date of purchase of additional Equipment; b) during any Renewal Term, for a period of one (1) year from the date of purchase of the additional equipment. We may use reconditioned parts in making repairs, but this warranty will only extend to the replacement parts for the remainder of the warranty period. You must notify us within the warranty period of any problem that you claim is covered by this limited warranty. This limited warranty is for your benefit only and cannot be enforced by any other person. This limited warranty does not cover any of the following conditions: (a) damages resulting from repair of the equipment or system by unauthorized persons, alterations, abuse, misuse, tampering, weather conditions, environmental conditions, natural disasters, or acts of God; (b) problems with the internet or communication lines or equipment; (c) damages caused directly or indirectly by break-ins or other occurrences that the Equipment is designed to detect or avert; (d) problems caused by interruption of electrical mains or faulty batteries; (e) your failure to follow operating instructions in the owner’s manual or other product documentation or as provided by us; (f) alterations to the Equipment by you or a third party; or (g) problems caused by any alteration of the premises; (h) low or dead batteries; (i) damages resulting from self-installation of Equipment;
Limited Equipment Warranty. G. Customer represents and warrants that Customer is the owner of the premises or, if not, that the owner agrees and consents to the installation of the system on the premises. Customer shall indemnify and hold SCSS harmless from any losses or damages, including attorney fees, resulting from breach of such representation and warranty.
Limited Equipment Warranty. (a) Limited Warranty (Basic Equipment) Subject to the limitations below, Okos warrants to you that any smart speaker, smart bulbs, smart plugs, smart thermostat and smart sensors (the “Basic Equipment”) shall be free from material defects in workmanship and materials, under normal use, from the date such Basic Equipment is installed (as set forth in the Order Confirmation) to the expiry of the Minimum Term. This limited warranty is absolutely conditional upon the Basic Equipment having been properly installed (where not installed by Okos), maintained and operated under conditions of normal use in accordance with the manufacturer's recommended operating instructions. Okos’s sole obligation under this limited warranty is, at Okos’s option and expense, to repair the affected Basic Equipment or replace it with similarly functioning Basic Equipment then made available by Okos. This limited warranty applies to any replaced or repaired Basic Equipment through to the end of the Minimum Term. The replacement Basic Equipment provided to you may be new or refurbished at Okos’s sole discretion. Neither this limited warranty nor any of the rights hereunder are transferable by you. Limited Equipment Warranty. We provide a limited warranty on the Equipment as to manufacturing defects for a period of one (1) year from the date of purchase or rental (the “Limited Warranty”). This Limited Warranty applies only to Equipment purchased or rented through our website or through Resellers. This Limited Warranty does not apply to any defect or failure other than a manufacturing defect, and without limiting the generality of the foregoing, does not apply to any defect caused by damage in transit, damage by a Reseller, damage from dropping, abuse, water damage, electrical or lighting, or from other types of customer handling. Your sole remedy for any breach of the Limited Warranty is to obtain a repaired or replacement item of Equipment. You must include with the require Equipment a letter stating that you are returning the nature of the defect. IF you received your Equipment from a Reseller, you may be instructed to return the Equipment to the Reseller. The capability to use the Equipment to make calls as described and qualified herein, will continue with any Equipment obtained from us to replace to original Equipment under this warranty. This Limited Warranty does NOT cover cost of shipment. You must be registered with Valley Fiber as the primary account holder of record to exercise rights under this paragraph.

This limited warranty is absolutely conditional upon the Core Equipment having been properly installed (where not installed by Enercare), maintained and operated under conditions of normal use in accordance with the manufacturer's recommended operating instructions. Limited Equipment Warranty. Clear-Com LLC (“Clear-Com”) warrants that each of its products, including any supplied accessories (but not software), will be free from defects in material and workmanship for the time period set forth below for each such product (the “Warranty Period”) provided the product is a new product and was purchased from an authorized Clear-Com dealer or distributor (the “Limited Equipment Warranty”).

It is further agreed that Contractor will not be assessed liquidated or delay damages by County due to product delays or shortages from any of its suppliers or due to delays caused by County's or other contractors' or subcontractors' provided infrastructures. In no case will assessment be made for delays or causes arising outside the scope ohhis Agreement. Any liquidated and/or delay damages, taken in the aggregate, shall not exceed 25% of the contract price.
