Maintenance by Xxxxxx. Throughout the Term of this Lease, Tenant shall, at Tenant’s sole cost and expense, keep and maintain the Premises and any and all Improvements now or hereafter constructed and installed on the Premises in good order, condition and repair (i.e., so that the Premises does not deteriorate more quickly than its age and reasonable wear and tear would otherwise dictate) and in a safe and sanitary condition and in compliance with all applicable Laws in all material respects. Tenant shall immediately notify the County of any damage relating to the Premises.
Maintenance by Xxxxxx. Tenant, at its own expense, shall keep the interior of the Premises in good repair, decorated and in tenantable condition during the entire term of the Lease and shall promptly and adequately repair all damage to the Premises using labor and material approved by Landlord. Tenant shall repair and maintain the heating, air conditioning, ventilating, electrical, plumbing equipment and services within the Premises; Landlord represents and warrants that all of the foregoing systems and equipment shall be in good working order on the commencement date. In the event Tenant fails or refuses to maintain Premises or make such repairs or replacements, Landlord may (but shall not be obligated to), following five (5) days prior written notice to Tenant and Xxxxxx’s failure to cure within such period, make such repairs or replacements, and the cost thereof shall be considered additional rent, payable by Tenant upon demand. Landlord shall warrant and guarantee, at it’s sole expense, the heating and air conditioning equipment within the demised premises during the first twelve (12) months of this Lease, provided that Tenant enters into a preventative maintenance contract with a qualified heating and air conditioning contractor to perform preventative maintenance to the equipment at Tenant’s sole expense. Furthermore, provided Tenant has contracted with a qualified heating and air conditioning contractor for preventative maintenance, Landlord and Tenant shall prorate the cost of any repair or replacement of the equipment upon the percentage of time the Tenant had use of the equipment vs the age of the equipment at the time of failure.
Maintenance by Xxxxxx. Tract 2 shall be kept neat, orderly, planted in grass and trimmed until improvements are constructed thereupon. Following completion of construction of improvements on Tract 2, Xxxxxx shall maintain such improvements and Common Areas in good condition and repair. The maintenance of Tract 2 shall include, without limitation, the following as reasonably necessary: (a) maintaining the surfaces in a level, smooth and evenly-covered condition with the type of surfacing material originally installed or such substitute as shall in all respects be equal in quality, use, and durability; (b) removing all papers, ice and snow, mud and sand, debris, filth and refuse and thoroughly sweeping the area to the extent reasonably necessary to keep the area in a clean and orderly condition; (c) placing, keeping in repair and replacing any and all necessary and appropriate directional signs, markers and lines to provide for reasonably safe pedestrian and vehicular traffic; (d) operating, keeping in repair and replacing, where necessary, such artificial lighting facilities necessary and appropriate to provide for reasonably safe pedestrian and vehicular traffic; (e) maintaining and repainting when necessary or as required under Section 9.2 hereof all perimeter and exterior building walls, including but not limited to all retaining walls in a good condition and state of repair; (f) maintaining, mowing, weeding, trimming and watering all landscaped areas and making such replacements of shrubs and other landscaping as is necessary; (g) maintaining elements of the Storm Drainage System.
Maintenance by Xxxxxx. All vehicles will be maintained in accordance with the 5307 Transportation grant requirements provided by the Federal Department of Transportation.
Maintenance by Xxxxxx. Lessee shall at all times repair, and maintain and replace the Premises and all of Lessee's facilities thereat at Xxxxxx's sole expense in a first-class, sound, clean and attractive manner, meeting or exceeding the manner of maintenance at first class comparable facilities in the western United States as determined in Lessor's reasonable discretion.
Maintenance by Xxxxxx. Xxxxxx shall at his own cost and expense keep and maintain all portions of the Premises, including all improvements and all facilities appurtenant to said Premises, in good repair and in as good condition as they were when received by Xxxxxx, reasonable wear and tear excepted.
Maintenance by Xxxxxx. Subject to Section 6.2, at all times during the Term of this Lease, Lessee shall, at its own cost and expense, keep and maintain said Property and all Improvements and facilities hereafter constructed on said Property by Xxxxxx.
Maintenance by Xxxxxx. At all times during the term of this Agreement, LESSEE shall, at LESSEE’s sole cost and expense, keep and maintain said Premises and all improvements now or hereafter on said Premises as well as all facilities in good order and repair and in a safe and clean condition.
Maintenance by Xxxxxx. Except as set forth in Section 9.1, Landlord shall have no other maintenance, repair or replacement obligations whatsoever, with regard to any aspect of the Premises. Therefore, Tenant shall, at Tenant’s sole expense, maintain the Premises, including without limitation, the Land, the Building, all other improvements, and all aspects and components of the foregoing, throughout the Term, at Tenant’s sole expense, in good, safe and clean order, condition and repair, including, without limitation:
(a) all plumbing, heating, air conditioning, ventilation, electrical, lighting, security, fire suppression, communications and data facilities, and all components thereof, serving the Premises;
(b) the interior of the Building, including without limitation, all walls, windows, doors; and
(c) all fencing and other perimeter structures, signage, landscaping, driveways, parking areas, loading areas and docks, garbage areas, and sidewalks on the Premises.
Maintenance by Xxxxxx. Tenant shall keep and maintain the Boat and all personal property of Tenant in good state of maintenance and repair and in a sightly, healthy and clean condition, and so as to comply with all applicable ordinances, regulations and laws of all government and quasi-government entities, whether federal, state or local, having jurisdiction, and the Prospectus for the Community, the Rules and Regulations for the Community adopted by the Co-Op and all other documents governing the use and operation of the Community.
