Maintenance by Xxxxxx. Throughout the Term of this Lease, Tenant shall, at Tenant’s sole cost and expense, keep and maintain the Premises and any and all Improvements now or hereafter constructed and installed on the Premises in good order, condition and repair (i.e., so that the Premises does not deteriorate more quickly than its age and reasonable wear and tear would otherwise dictate) and in a safe and sanitary condition and in compliance with all applicable Laws in all material respects. Tenant shall immediately notify the County of any damage relating to the Premises.

Maintenance by Xxxxxx. Tenant shall, throughout the Term, take good care of and maintain the Premises and the fixtures and appurtenances therein in good condition and, at its sole cost and expense, make all necessary repairs to the interior of the Premises, except those required of Landlord under the terms of this Lease, as and when needed to preserve them in good working order and condition, reasonable wear and tear and damage from the elements, fire or other casualty not the fault of Tenant excepted. When used in this Article, the term “repairs” shall include all necessary replacement and renewals. Notwithstanding the foregoing, all damage or injury to the Premises or to any other part of the Property or to the fixtures, equipment and appurtenances, thereto, whether requiring structural or nonstructural repairs, caused by or resulting from negligence, carelessness, omission, neglect or improper conduct of Tenant, its servants, employees, invitees or licensees, shall be repaired promptly by Tenant at its sole cost and expense, to the reasonable satisfaction of Landlord. Tenant shall also repair all damage to the Premises or Property caused by the moving of Tenant’s fixtures, furniture or equipment. All such repairs shall be done in a good and workmanlike manner. There shall be no allowance to Tenant for a diminution of rental value and no liability on the part of Landlord by reason of inconvenience, annoyance or injury to business arising from Tenant or others, excluding Landlord, making or failing to make any repairs, alterations, additions or improvements in or to any portion of the Property or in and to the fixtures, appurtenances or equipment thereof. Tenant shall also, at Tenant’s expense, repair and refurbish the Premises and any part and portion thereof from time to time to assure that the same are kept in a first class, tenantable and attractive condition throughout the Term.
Maintenance by Xxxxxx. Lessee shall at all times repair, and maintain and replace the Premises and all of Lessee's facilities thereat at Xxxxxx's sole expense in a first-class, sound, clean and attractive manner, meeting or exceeding the manner of maintenance at first class comparable facilities in the western United States as determined in Lessor's reasonable discretion.
Maintenance by Xxxxxx. All vehicles will be maintained in accordance with the 5307 Transportation grant requirements provided by the Federal Department of Transportation.
Maintenance by Xxxxxx. Tract 2 shall be kept neat, orderly, planted in grass and trimmed until improvements are constructed thereupon. Following completion of construction of improvements on Tract 2, Xxxxxx shall maintain such improvements and Common Areas in good condition and repair. The maintenance of Tract 2 shall include, without limitation, the following as reasonably necessary: (a) maintaining the surfaces in a level, smooth and evenly-covered condition with the type of surfacing material originally installed or such substitute as shall in all respects be equal in quality, use, and durability; (b) removing all papers, ice and snow, mud and sand, debris, filth and refuse and thoroughly sweeping the area to the extent reasonably necessary to keep the area in a clean and orderly condition; (c) placing, keeping in repair and replacing any and all necessary and appropriate directional signs, markers and lines to provide for reasonably safe pedestrian and vehicular traffic; (d) operating, keeping in repair and replacing, where necessary, such artificial lighting facilities necessary and appropriate to provide for reasonably safe pedestrian and vehicular traffic; (e) maintaining and repainting when necessary or as required under Section 9.2 hereof all perimeter and exterior building walls, including but not limited to all retaining walls in a good condition and state of repair; (f) maintaining, mowing, weeding, trimming and watering all landscaped areas and making such replacements of shrubs and other landscaping as is necessary; (g) maintaining elements of the Storm Drainage System.
Maintenance by Xxxxxx. LESSOR shall keep or cause to be kept the foundation, roof, and structural portions of walls, HVAC, plumbing and fire suppression and alarm systems of the Premises in good order, repair, and condition except for damage due to the acts or omissions of LESSEE, its employees, or invitees. XXXXXX shall commence required repairs as soon as reasonably practicable after receiving written notice from LESSEE of any required repair. Except as provided in this Section, LESSOR shall not be obligated to make repairs, replacements, or improvements of any kind upon the Premises, or to any equipment, merchandise, stock in trade, facilities, or fixtures therein, all of which shall be LESSEE‟s responsibility.
Maintenance by Xxxxxx. LESSEE shall at all times keep the Premises (including all entrances and vestibules) and all partitions, window and window frames and moldings, glass doors, door openers, fixtures, equipment and appurtenances thereof and any Leasehold Improvements it makes and all other parts of the Premises not required herein to be maintained by LESSOR in good order, condition and repair and clean, orderly, sanitary and safe, damage by unavoidable casualty excepted. Such maintenance responsibilities shall include but not limited to those activities necessary to cause the Premises to comply with applicable laws, ordinances, rules, regulations and orders or governmental and public bodies and agencies. If replacement of equipment, fixtures and appurtenances thereto are necessary and upon prior review and approval of LESSOR, LESSEE shall replace the same with equipment, fixtures and appurtenances of the same quality, and repair all damages done in or by such replacement. LESSOR shall be the sole judge of the quality of maintenance and, upon written notice by XXXXXX to LESSEE, LESSEE shall be required to perform whatever maintenance LESSOR deems necessary. If said maintenance is not undertaken by LESSEE within ten (10) days after receipt of written notice, LESSOR shall have the right to enter on the Premises and perform the necessary maintenance, the cost of which plus ten percent (10%) shall be borne by XXXXXX. If XXXXXX fails to perform work resulting from XXXXXX's acts, actions or omissions LESSOR may add the cost of the same to the next installment of Rent due hereunder as Additional Rent.

Maintenance by Xxxxxx. Except to the extent such maintenance is allocated to Landlord pursuant to Section 7(b) below and except to the extent such cleaning is allocated to Landlord pursuant to Section 13(a) below, Tenant’s responsibilities include the obligation to maintain and keep clean all portions of the Premises, including, but not limited to, Xxxxxx’s fixtures and equipment, in good, working condition, ordinary wear and tear excepted, and remove all rubbish, dirt and debris therefrom. Tenant shall not suffer any waste or injury to the Premises. Tenant shall promptly dispose of all garbage in appropriate receptacles. In the event this Lease is terminated and Xxxxxx surrenders the Premises (including the return of all keys to Landlord), Tenant shall deliver the Premises in as good a state of repair and condition as they existed on the Commencement Date, except for any approved Alterations, reasonable wear and tear, and damage by fire, tornado or other casualty, and subject to Landlord’s maintenance obligations contained in Section 7(b) below. Further, Tenant will leave the Premises in a condition free of all personal property, and any Hazardous Substances brought into the Premises by Xxxxxx.
