Maintenance by Xxxxxx. Throughout the Term of this Lease, Tenant shall, at Tenant’s sole cost and expense, keep and maintain the Premises and any and all Improvements now or hereafter constructed and installed on the Premises in good order, condition and repair (i.e., so that the Premises does not deteriorate more quickly than its age and reasonable wear and tear would otherwise dictate) and in a safe and sanitary condition and in compliance with all applicable Laws in all material respects. Tenant shall immediately notify the County of any damage relating to the Premises.
Maintenance by Xxxxxx. Any and all repairs, replacements, maintenance and other care of the Leased Premises which are not expressly the responsibility and obligation of the Landlord under Section 0, above, will be the responsibility of the Tenant, all of which will be performed and completed at Tenant’s sole cost and expense all as reasonably necessary to keep and maintain the Improvements in good order, condition, and repair including, without limitation, all repairs, maintenance and replacement to the mechanical, electrical and plumbing systems and equipment, utility systems, fire suppression system, dock door equipment and the heating, ventilation, and air-conditioning systems serving the Leased Premises (collectively, the “Building Systems”); provided, however, that Tenant’s obligations in connection with the Building Systems installed pursuant to the Tenant Finish Work shall be subject to Landlord’s obligations under Section 9(d) below. In addition, Xxxxxx shall perform all routine maintenance and upkeep of the Structural Elements of the Leased Premises (including, without limitation, any painting). Without limiting the generality of the foregoing, Tenant shall implement: (i) a janitorial program of cleaning sufficient to keep the Leased Premises in a safe, clean, and sanitary condition at all times; and (ii) a regularly scheduled program of preventive maintenance and repair of the Building Systems, which complies with the requirements of the applicable manufacturers’, suppliers’, and contractors’ warranties, and which keeps and maintains the Building Systems in good order, condition, and repair at all times (such preventive maintenance contracts shall meet or exceed Landlord’s standard maintenance criteria, and shall provide for inspection and maintenance of the Building Systems on at least a semi-annual basis). Tenant shall not be responsible for making any repairs occasioned by any gross negligence, intentional act, or willful misconduct of Landlord or its employees, contractors, or agents, all of which repairs shall be made promptly by Landlord at its cost and expense.
Maintenance by Xxxxxx. All vehicles will be maintained in accordance with the 5307 Transportation grant requirements provided by the Federal Department of Transportation.
Maintenance by Xxxxxx. Lessee shall at all times repair, and maintain and replace the Premises and all of Lessee's facilities thereat at Xxxxxx's sole expense in a first-class, sound, clean and attractive manner, meeting or exceeding the manner of maintenance at first class comparable facilities in the western United States as determined in Lessor's reasonable discretion.
Maintenance by Xxxxxx. Tract 2 shall be kept neat, orderly, planted in grass and trimmed until improvements are constructed thereupon. Following completion of construction of improvements on Tract 2, Xxxxxx shall maintain such improvements and Common Areas in good condition and repair. The maintenance of Tract 2 shall include, without limitation, the following as reasonably necessary: (a) maintaining the surfaces in a level, smooth and evenly-covered condition with the type of surfacing material originally installed or such substitute as shall in all respects be equal in quality, use, and durability; (b) removing all papers, ice and snow, mud and sand, debris, filth and refuse and thoroughly sweeping the area to the extent reasonably necessary to keep the area in a clean and orderly condition; (c) placing, keeping in repair and replacing any and all necessary and appropriate directional signs, markers and lines to provide for reasonably safe pedestrian and vehicular traffic; (d) operating, keeping in repair and replacing, where necessary, such artificial lighting facilities necessary and appropriate to provide for reasonably safe pedestrian and vehicular traffic; (e) maintaining and repainting when necessary or as required under Section 9.2 hereof all perimeter and exterior building walls, including but not limited to all retaining walls in a good condition and state of repair; (f) maintaining, mowing, weeding, trimming and watering all landscaped areas and making such replacements of shrubs and other landscaping as is necessary; (g) maintaining elements of the Storm Drainage System.
Maintenance by Xxxxxx. Tenant shall immediately notify the Lessor of any damage relating to the Premises.
Maintenance by Xxxxxx. Xxxxxx shall at his own cost and expense keep and maintain all portions of the Premises, including all improvements and all facilities appurtenant to said Premises, in good repair and in as good condition as they were when received by Xxxxxx, reasonable wear and tear excepted.
Maintenance by Xxxxxx. (a) During the Term and at its own cost and expense a Tenant shall repair, maintain, keep in good order and make replacements to the Premises and all equipment, Leasehold Improvements and mechanical systems within or necessarily incidental to the Premises, including, without limitation, the heating, ventilating and air-conditioning equipment and any improvement now or hereafter made to the Premises, as a careful owner would do, and the Tenant covenants to perform such maintenance, to effect such repairs and replacements and to decorate, at its own cost and expense as and when necessary or reasonably required so to do by the Landlord.
Maintenance by Xxxxxx. (a) The Lessor shall keep and maintain the Property and all Services in good order and repair and shall:
Maintenance by Xxxxxx. (i) Nothing in this Agreement requires Lessor to perform any maintenance or repair to the Premises or to any adjacent property or bulkheads; or to make any improvements whatsoever on or for the benefit of the Premises. However, with no less than twenty-four (24) hours notice from Lessor to Lessee, Lessor shall have the right, but not the obligation, to maintain or make any necessary repairs related to safety or hazard concerns to or on the Premises. Lessee shall reasonably cooperate with Lessor in any activity undertaken by Lessor on the Premises. Lessor may collect its cost for maintenance or repairs from the Lessee in the manner provided in Section 44.
