Malpractice and Maladministration. 6.1 Notify Safety Training Awards of any changes within the ATC which may impact on their ability to fulfil the requirements of this agreement.
Malpractice and Maladministration. The Centre shall: Have in place robust procedures for preventing and investigating incidents of malpractice or maladministration that reflect the CILEx Policies and Procedures. Take all reasonable steps to prevent incidents of malpractice or maladministration occurring, including, but not limited to, implementing actions or measures directed by CILEx after the completion of a malpractice or maladministration investigation. Promptly notify CILEx of any incidents of malpractice or maladministration in line with the requirements of CILEx malpractice and/or maladministration policies. Maintain records of any investigations carried out by the Centre for the duration of this agreement. Provide access to documents, records, data, staff, third parties, Learners, Satellite Centres or any other resources required by CILEx or a Regulator during an investigation of suspected malpractice or maladministration. Conflict of interest The Centre shall put in place and implement appropriate conflicts of interest policy, in compliance with any relevant CILEx Policies and Procedures. The Centre shall take all reasonable steps to avoid any conflict of interest relating to the Centre’s obligations under this agreement. Where, having taken all such reasonable steps, a conflict cannot be avoided, the Centre shall record, appropriately disclose, monitor and properly manage the conflict. Retention of records The Centre shall: Maintain all Learner records and details of achievement in an accurate, timely and secure manner in line with CILEx requirements and clause 8, and in the format required by CILEx. Have appropriate measures to ensure Learners’ Personal Data (as defined in clause 8 (Data Protection) is held in accordance with clause 8. Keep complete and accurate records for the duration of this agreement, relating to the Centre’s obligations under this agreement and CILEx Qualifications and make these available to CILEx upon request, including, but not limited to attendance, performance, assessment and feedback and Learner feedback records. Learner information and support The Centre shall: Provide Learners with accurate, comprehensive and up to date information and guidance, including a Learner handbook or similar information pack, at the start of a programme undertaken in connection with a CILEx Qualification. Malpractice and Maladministration. 11a take all reasonable steps to prevent incidents of malpractice or maladministration from occurring. 11b promptly notify the British Safety Council of any incidents of malpractice or maladministration in line with the requirements of the British Safety Council’s malpractice and maladministration policy. 11c take all reasonable steps to investigate any suspected incidents of malpractice or maladministration and rectify any negative impact of these incidents. 11d have in place robust procedures for investigating incidents of malpractice or maladministration. 11e develop an action plan for managing and rectifying the negative impact of any incidents of malpractice or maladministration and make this action plan available to the British Safety Council as required. This plan should also identify any areas of improvement required to ensure the malpractice or maladministration does not recur in the future. 11f take appropriate and proportionate action against those responsible for the malpractice or maladministration to ensure it does not recur in the future. 11g deliver, in full, the actions required to manage and rectify any identified incidents of malpractice or maladministration. 11h regularly review procedures for preventing and investigating incidents of malpractice or maladministration and make any improvements necessary to ensure they remain relevant and fit for purpose. 11i provide access to documents, records, data, staff, third parties, sub-contractors, learners, satellite centres or any other resource required by the British Safety Council during an investigation of centre malpractice or maladministration. Monitoring activity and investigations 12a fully co-operate with the British Safety Council and the Regulators in carrying out any reasonable monitoring activities. 12b agree to the application of the British Safety Council’s Sanctions Policy. Complaints, result enquiries and appeals 13a operate a complaint handling process and a result enquiry and appeals process for the benefit of learners. 13b adhere to the British Safety Council’s Result Enquiry and Appeals Policy and provide information and support to enable learners to access the result enquiries and appeals process. Malpractice and Maladministration. 16.1 The Centre will have in place robust procedures for preventing and investigating incidents of malpractice and maladministration which are up to date and communicated across the Centre, its satellite Centres, sub-contractors and third parties.
Malpractice and Maladministration. As part of the regulatory requirements for approval, your centre is required to have in place a policy and procedure for dealing with actual or suspected malpractice/maladministration by centre staff and/or learners. The policy should be written in plain language and communicated to learners as well as all staff involved in the management, delivery and administration of qualifications. The policy must provide clear information about what is defined as malpractice and maladministration, how staff or learners should report it and to whom, what to expect if making such a report, and the centre’s procedure for dealing with such reports. Any suspicion or accusation of malpractice or maladministration must be reported to LASER immediately, whether it involves centre staff and/or learners. A Report of Suspected Malpractice (M1) Form is available on the LASER website, and should be completed and submitted to the LASER Quality Manager. Further information and guidance is provided on the LASER website. Examples (not exhaustive) of possible centre malpractice include: • Providing learners with assistance during examinations, such as explaining questions or suggesting answers. • Assisting learners in the production of work for assessment, where the support has the potential to influence the outcomes of assessment, and/or where the assistance involves centre staff producing work for the learner. • Facilitating and/or allowing impersonation. • Misusing the arrangements for reasonable adjustments or special conditions, for example where learners are permitted support. • Falsifying records or certificates, for example by alteration, substitution, or by fraud. • Fraudulent certificate claims, that is claiming for a certificate without the learner having completed all of the requirements of assessment. • Failing to keep assessment materials and examination papers secure prior to the assessment or examination. • Altering or forging any assessment or examination documentation. Examples (not exhaustive) of possible learner malpractice include: • Cheating in assessments/examinations. • Plagiarism. • Destruction of another learner’s work. • Disruptive behaviour. Examples (not exhaustive) of possible centre maladministration include: • Failing to keep complete and accurate records. • Failing to follow administrative procedures. • Failing to register courses/learners within the required timeframes. • Failing to pay invoices within the required timeframe.
Malpractice and Maladministration. The Centre shall adopt, and ensure compliance with, a policy and procedure, complementary to BIIAB’s Policies and Procedures on malpractice and maladministration, that allows for the identification of, and aims to reduce, the risk and incidents of malpractice or maladministration occurring.
