Manner of Employment. Executive shall faithfully, diligently and competently perform his responsibilities and duties. The Executive shall devote his exclusive and full business efforts and time to the Company. This Section 3(b), however, shall not preclude the Executive, outside normal business hours, from engaging in appropriate civic or charitable activities, or from serving as a director of any not-for profit entity, as long as such activities do not interfere or conflict with his responsibilities to the Company. With the Board's consent, Executive may serve as a director of a for-profit entity.

Manner of Employment. Section 3.01 It is understood and agreed that no employees falling within the classes of persons covered by this collective bargaining agreement shall be hired except in accordance with the terms of this article. Whenever an Employer desires new or additional help the Employer shall notify the referral office of the Union, either in writing, in person, or by telephone, stating the job location, starting time, approximate duration of the job, the type of work to be performed, and the number of workmen desired. Subject to the procedures outlined in this article, the Union referral office shall refer qualified job applicants to meet the needs of the Employer. Also, there shall be a pre-job conference whenever a Xxxxxxx is to be required when requested by either the Union or Employer.

CRAFT SKILLS All new applicants for membership in District Council 58/ Local 513 affiliated with this Collective Bargaining Agreement may be evaluated as to their craft skills within forty- five (45) days of their application or Clearance Card being filed with Local 513. These skill evaluations will be provided by the recognized training entity with District Council 58/ Local 513. Those who demonstrate their skills shall be given either a journeyman or apprentice classification. Those failing or unwilling to demonstrate their skills to the recognized training entity, shall automatically be classified as an apprentice and will be subject to all rules and regulations of that training program. All contractor referrals will be accepted for consideration of due process for obtaining membership of the IUPAT.

Executive understands and agrees that pending proper financing of the Company, such Base Compensation may be accrued.
