Mercury. No material or finish shall contain mercury unless the use is approved by the Lessee in writing. Except for fluorescent lighting, the Lessor shall provide the Lessee a list of all equipment that contains mercury. This shall include electrical switches, thermostats, lift pumps, pilots, heaters, etc.

Mercury. The Shippers Group has advised INEOS that the Shippers Production to be tendered for delivery at the Transfer Point will contain levels of mercury of [ ] which level is in excess of the levels set out in Exhibit II and therefore the provisions of Attachment H to Section 2 of this Agreement shall apply. The Shippers Group has advised INEOS that the Shippers Production to be tendered for delivery at the Transfer Point will contain levels of mercury which are less than or equal to the level set out in Exhibit II. Accordingly, there shall be no “Anticipated Level” as defined in and for the purposes of Paragraph 1 of Attachment H to Section 2 of this Agreement. If at any time after the date of this Agreement, Shippers Production which is tendered for delivery at the Transfer Point contains, or is likely to contain, levels of mercury in excess of the levels set out in Exhibit II, the provisions of Paragraphs 3, 5, 9 and 10 of Attachment H to Section 2 of this Agreement shall apply.

UDEQ and EPA Region 8 are still members of a multi- state, multi-EPA Region effort to communicate and coordinate mercury issues; work with other western states (Utah, Idaho, Nevada ) and Regions 8, 9, and 10. A Memorandum of Understanding was established and signed by all parties resulting in the Great Basin Mercury Workgroup.

Mercury. (a) The Shipper shall as soon as reasonably practicable and prior to commencement of deliveries of Shipper Gas at the Delivery Point, determine whether Shipper Gas to be tendered for delivery at the Delivery Point from the Commencement Date is likely to have a mercury content in excess of 0.01 microgrammes per Cubic Metre. Such determination shall be carried out by the Approved Mercury Testing Contractor at the cost of the Shipper. The Shipper shall procure that the Shipper Group Operator shall as soon as reasonably practicable after such determination provide the CATS Operator with:- (i) a copy of any test results; (ii) details of the testing procedures used; (iii) details of any circumstances which might materially affect the test results; and (iv) any reports made by the Approved Mercury Testing Contractor. (b) Following commencement of delivery of Shipper Gas into the CATS Facilities, the Shipper shall at its cost procure that the Approved Mercury Testing Contractor tests three (3) samples of the stream of Shipper Gas to be delivered at the Delivery Point, so as to determine the mercury content of Shipper Gas. Such tests shall be carried out and samples taken in accordance with the Mercury Measurement Procedures and the samples shall be taken at approximate evenly spaced intervals in the six (6) month period following the expiry of two (2) months after first delivery of Shipper Gas into the CATS Facilities. The mercury content of Shipper Gas as determined from such tests shall be deemed to be the arithmetic mean of the mercury contents of each of the three
