STATE AND FEDERAL RULES AND REGULATIONS a. SVRI agrees to meet State and Federal service standards as expressed by State and Federal law applicable to the services covered by this agreement. Including 2 CFR Part 200 Uniform Guidance, Section 188 of WIOA, 29 CFR Part 38 WIOA Nondiscrimination & Equal Opp. Regulations and other applicable civil rights laws.
b. Pursuant to 2019 Wisconsin Executive Order 1, Grantee agrees it will hire only on the basis of merit and will not discriminate against any persons performing a contract, subcontract or grant because of military or veteran status, gender identity or expression, marital or family status, genetic information or political affiliation.
c. If a federal agency determines that the DWD paid any amount to SVRI under this agreement that is not allowable under federal law, SVRI will refund to DWD the amount the federal agency determined that DWD overpaid SVRI.
d. SVRI may subcontract part of this agreement only with the prior written approval of DWD. SVRI retains responsibility for fulfillment of all terms and conditions of this agreement when it enters into sub-contractual agreements.
e. SVRI agrees to provide a letter of assurance and copy of its Affirmative Action/ Equal Employment Opportunity Policy to DWD with this agreement, assuring compliance with civil rights laws.
f. If this agreement results in a book or other material, the DWD reserves a royalty-free, non-exclusive irrevocable license to reproduce, publish or otherwise use, and to authorize others to use, all material from the approved program.
g. Any discovery or invention arising out of or developed in the course of work aided by this agreement, shall be promptly and fully reported to the DWD.
STATE AND FEDERAL RULES AND REGULATIONS. Provider agrees to meet state and federal service standards and state licensure and certification requirements as expressed by state and federal rules and regulations applicable to the services covered by this contractual agreement. In addition, Provider shall:
A. Cooperate with the Purchaser on establishing costs for reimbursement purposes.
B. Under §46.036, each vendor agency must provide an annual audit to the county agency, unless the audit requirement is waived by the Department. The standards for the vendor agency annual audits vary by type of agency as shown below.
1) Unless waived, and if requested, the Provider shall submit an annual program or agency-wide audit to the Purchaser if the total amount of annual funding provided by Purchaser to the Provider through this and other contracts is $100,000 or more.
2) The audit shall be in accordance with the requirements of OMB Circular A-133 if the Provider meets the criteria of that Circular for needing an audit in accordance with that Circular. The audit shall also be in accordance with: * The State Single Audit Guidelines, if the Provider is a local government that meets the criteria of OMB Circular A-133 for needing an audit in accordance with that Circular or * The Provider Agency Audit Guide for all other Providers. 3) If the Provider fails to submit the required audit, the Purchaser may arrange to have the audit conducted. The fees for the audit will be withheld from payments to the Provider.
C. Maintain a uniform double entry accounting system and a management information system compatible with cost accounting and control systems. (See DHFS Allowable Costs Policies Manual.) Refer to number 2 in the commentary. Refer to section VI of instructions for exceptions on small residential Providers.
D. Transfer a client from one category of care or service to another only with the approval of the Purchaser. Refer to number 3 in the commentary. If the situation is an emergency, Provider may transfer the client to a different category and will notify Purchaser of the change.
E. If the Provider obtains services for any part of this Agreement from another vendor, the Provider is responsible for fulfillment of the terms of the contract and shall give prior written notification of such to the Purchaser for approval. Such approval will not be unreasonably withheld.

UW- Milwaukee shall at all times comply with and observe all federal and state laws, local laws, ordinances, and regulations which are in effect during the period of this Agreement and which in any manner affect the work or its conduct.
b) UW-Milwaukee may subcontract part of this Agreement only with the prior written approval of DWD. UW-Milwaukee retains responsibility for fulfillment of all terms and conditions of this Agreement when it enters into contractual agreements. If UW- Milwaukee uses a subcontractor to fulfill any part of this Agreement, it shall require its subcontractor (s) to comply with all applicable terms and conditions of this Agreement.

C. DWD reserves a royalty-free, non-exclusive irrevocable license to reproduce, publish or otherwise use, and to authorize others to use, all material resulting from this Agreement to meet its obligations under the federal grant from the Federal Rehabilitation Services Administration (dated October 2021).
D. Any discovery or invention conceived and reduced to practice related to this Agreement shall be promptly and fully reported to DWD.
STATE AND FEDERAL RULES AND REGULATIONS. The Provider agrees to meet State and Federal service standards and program policies as expressed by State and Federal law applicable to the services covered by this Agreement, and agrees to meet the requirements of the Rehabilitation Act of 1973 and Amendments and the Americans with Disabilities Act of 1990 and Amendments. The Provider agrees that all services provided under this Agreement meet conditions under State and Federal civil rights compliance requirements, including the Equal Opportunity Requirements under Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, as amended, Equal Pay Act of 1963, Age Discrimination in Employment Act of 1967, Age Discrimination Act of 1975, Americans with Disabilities Act of 1990, Title IX of the Education Amendments of 1972, Public Accommodations and Amusements Law of 1965, Wisconsin Fair Employment Act, and any related provisions of Wisconsin Statutes and Wisconsin Administrative Code. Further, the Provider agrees to comply with all guidelines issued by the DVR to ensure implementation of these and other related State and Federal requirements.
