MULTIPLE APPLICANTS. If two or more parties sign this Agreement as Applicants (i) it shall be the joint and several agreement of all such signers and binding upon their respective successors and assigns; and (ii) the term “Applicant” shall mean all of such signers or any one or more of them, whether or not all or any of them are referred to in any Letter of Credit.
MULTIPLE APPLICANTS. If there is more than one Applicant, the obligations hereunder and under the Project Documents, shall be joint and several.
MULTIPLE APPLICANTS. Applicants shall be considered for the vacant position on the basis of their skill, ability, qualifications to perform the work and seniority. If two (2) or more applicants have the necessary skill, ability and qualifications to perform the work, then the most senior applicant shall be selected.
MULTIPLE APPLICANTS. Where an application form has been completed by or on behalf of any other applicant(s) with whom CEP has entered into an agreement similar or equivalent in effect to this Agreement, and a separate application form has been completed by or on behalf of Flagstone Re which corresponds, in CEP’s opinion with such other application form (or any other combination of circumstances exist which, in CEP’s opinion, are reasonably equivalent to the foregoing), then CEP shall be at liberty to open a single Credit jointly on behalf of Flagstone Re and such other applicant(s) (together “the Applicants”). In such event the following provisions shall apply:- (a) The Company and Flagstone Re’s obligations pursuant to Clause 1.3 shall be in respect of its due proportion of each drawing under any such Credit; (b) In establishing the Company and Flagstone Re’s due proportion of each drawing under any such Credit CEP is hereby irrevocably authorised to make apportionments between the Applicants (i) on a pro rata basis by reference to the amounts set forth in the application forms originally completed by the Applicants in respect of such Credit (and after taking into account any subsequent increases or decreases in such Credit effected by CEP for the Applicants accounts) or, if CEP should so choose (ii) in reliance on the instructions and advice of, and information provided by, the relevant Insurance Broker (construed in accordance with Clause 4); and (c) For the purposes of Clause 1.4 above, CEP may make any required apportionments in such manner as it, in its sole discretion, considers to be fair and reasonable.
MULTIPLE APPLICANTS. 1. If there is more than one applicant for a transfer opportunity, all eligible applicants shall receive consideration before external applicants will be interviewed. The supervisor/manager and a Human Resources representative will provide a group orientation with the applicants about the duties and expectations of the position. All applicants still interested in the transfer opportunity after this orientation will be interviewed by the supervisor/manager and a Human Resources representative. 2. The following criteria will be considered in making the final selection. Final selection is within the discretion of the District. a. Reference letters that may be submitted at the time of application. b. Previous performance evaluations (written and verbal from current supervisor/manager). c. Specific skills required in the transfer assignment and the skill level of the applicant. d. Seniority in the job classification. 3. Those applicants who are not selected for the transfer assignment will receive a written response from the District indicating the reason for non-selection with signatures from the immediate supervisor and the department/area manager. 4. The employee selected will be placed in the assignment in "probationary status" for a period of thirty (30) work days. During the thirty (30) day probationary period, either or both the supervisor/manager and the employee have the right to terminate the transfer without cause. 5. During this thirty (30) day probationary period, the applicant's former assignment will be left vacant and may be filled by a non-student temporary employee to allow the employee to return to the former assignment.

  • Applicants If the NRMP's investigation of an alleged Match violation by an applicant results in a finding that an applicant has committed a violation of this Agreement, the processing of the applicant's rank order list may be interrupted. The NRMP at its discretion may withdraw the applicant from the SMS Match. If a matched applicant is the subject of a violation investigation, the program to which the applicant matched may not fill the position with another applicant until the NRMP has issued the Final Report or granted a waiver, whichever is earlier. If the violation investigation has not concluded by the start date of training, the program shall begin training the matched applicant unless NRMP has granted a waiver or issued a deferral. The NRMP’s Final Report on the confirmed violation will be delivered to the applicant with copies to: (1) the applicant's medical school official, with a request that the Final Report be placed in the applicant’s permanent file (2) the Educational Commission for Foreign Medical Graduates if the applicant is a graduate of an international medical school (3) the NRMP institutional official and the director of the program to which the applicant matched (4) the NRMP institutional official and the director of the program to which the applicant has applied or switched (if known) (5) the party who originally reported the violation (6) the NRMP Executive Committee (7) the American Board of Medical Specialties (8) the American Osteopathic Association (9) the applicant's residency program director (10) the Federation of State Medical Boards if the applicant is to be permanently identified as a Match violator or permanently barred from future NRMP Matches (11) any parties whom the NRMP has determined are relevant to its investigation (12) state medical licensure boards, if requested by the applicant In addition, the applicant may be barred from subsequent NRMP Matches and/or identified as a Match violator to participating programs for one to three years or permanently, as determined by the NRMP. The applicant also may be barred for one year from accepting an offer of a position or a new training year, regardless of the start date, in any program sponsored by a Match-participating institution, and/or starting a position or a new training year in any program sponsored by a Match-participating institution if training would commence within one year from the date of issuance of the Final Report. Further, any applicant who has been denied a waiver of a binding commitment and who does not accept the matched position may be barred for one year from accepting an offer of a position or a new training year, regardless of the start date, in any program sponsored by a Match- participating institution and/or from starting a position or a new training year in any program sponsored by a Match- participating institution if training would commence within one year from the date of the NRMP's decision on the waiver. The decision conveyed in the Final Report will be displayed in the R3 system Applicant Match History for one to three years or permanently, as determined by the NRMP. Term limits of any sanction(s) imposed for the violation will be included to identify the length of time the action is in effect. The NRMP has sole discretion to determine which of the sanctions described above shall be applied in the event an applicant violates this Agreement. Failure to comply with sanctions levied as a result of a confirmed violation that is final may result in a new investigation and additional sanctions.

  • Unbundled Channelization (Multiplexing) 5.7.1 To the extent NewPhone is purchasing DS1 or DS3 or STS-1 Dedicated Transport pursuant to this Agreement, Unbundled Channelization (UC) provides the optional multiplexing capability that will allow a DS1 (1.544 Mbps) or DS3 (44.736 Mbps) or STS-1 (51.84 Mbps) Network Elements to be multiplexed or channelized at a BellSouth central office. Channelization can be accomplished through the use of a multiplexer or a digital cross-connect system at the discretion of BellSouth. Once UC has been installed, NewPhone may request channel activation on a channelized facility and BellSouth shall connect the requested facilities via COCIs. The COCI must be compatible with the lower capacity facility and ordered with the lower capacity facility. This service is available as defined in NECA 4. 5.7.2 BellSouth shall make available the following channelization systems and interfaces: 5.7.2.1 DS1 Channelization System: channelizes a DS1 signal into a maximum of twenty- four (24)
