N egotiations. 2.5.1 Subject to patient care requirements, the Employer will make a good faith effort to provide unpaid release time for employees participating in Union negotiations (not to exceed one [1] employee per unit), providing the employee notifies the Unit Director as soon as the employee has knowledge of future meeting dates. 2.5.2 For contract negotiations, Swedish Xxxxxxx will provide one (1) hour of paid release time for every member of the bargaining unit for the Union’s negotiating committee. These monies are intended to supplement the bargaining unit’s vacation donations to negotiating team members. The total number of hours available will be determined on the first day of bargaining, based on the total number of represented employees on that day.

N egotiations. 1. Negotiations will commence after the April Board meeting and required public hearings of the Organization and District proposals. 2. Either party may utilize the services of outside consultants. 3. Negotiations shall take place at mutually agreeable times and places. 4. The Organization may designate one to ten representatives who may divide a total of forty (40) hours for release time without loss of compensation to prepare for negotiation proceedings, attend in-service training sessions, or to participate in negotiations. No less than three (3) and no more than five (5) representatives will participate at the bargaining table. An additional two (2) representatives may attend job review sessions during negotiation proceedings. It is understood that mediation procedures and fact finding procedures would not come out of the above mentioned forty (40) hours. 5. The Organization shall present eight (8) copies of its initial proposal to the District no later than the April Board meeting unless the parties are using the Interest Based Bargaining model. 6. The District shall present eight (8) copies of the counter proposal to the Organization no later than the May board meeting unless the parties are using the Interest Based Bargaining model. 7. If the parties have not been able to agree upon terms of the agreement within a reasonable length of time, and if all avenues of bargaining have been exhausted, either party may institute impasse procedures in accordance with the rules of the Public Employee's Relations Board. 8. As soon as copies are available, the District shall furnish one (1) copy of the following to the Organization to fulfill its role as the exclusive bargaining representative: a. If between the date of this Agreement and the termination of this Agreement pursuant to Section 9.1, Target receives from a third party any offer or indication of interest regarding any Acquisition Transaction, or any request for information regarding any Acquisition Transaction, Target shall (i) notify Acquiror immediately (orally and in writing) of such offer, indication of interest or request, including the identity of such party and the full terms of any proposal therein, and (ii) notify such third party of Target's obligations under this Agreement.

  • Future Negotiations If at any time prior to termination of this Amendment the Custodian as a matter of standard business practice, accepts delegation as Foreign Custody Manager for its U.S. mutual fund clients on terms materially different than set forth in this Amendment, the Custodian hereby agrees to negotiate with the fund in good faith with respect thereto.

  • NEGOTIATIONS PROCEDURE A. Upon the request of Local 149 or the Board, not earlier than ninety (90) calendar days prior to the expiration of this Agreement, the parties may open negotiations for a successor contract. The first meeting will be held within fifteen (15) calendar days of receipt of the request unless the parties mutually agree to a later date. B. The Board and the Union shall be represented at negotiation meetings by a team of not more than six (6) members each. C. The Board and the Union negotiating teams shall exchange items for negotiations at the first negotiating session. All contract proposals shall be presented in writing by both parties. No issue shall be introduced by either party following the first session unless mutually agreed by both negotiating teams. D. Neither team shall release information to the public media without mutual agreement of the other team until such time as impasse is declared by either side. E. When tentative agreement is reached covering the matters of negotiation, it shall be reduced to writing, reproduced at Board expense for the Local 149 membership to ratify or reject. When approved by Local 149 membership, it shall be presented to the Board for its approval or rejection. F. In the event agreement is not reached within thirty (30) calendar days after the first actual negotiating session, either party may request that Federal Mediation and Conciliation Service be notified and requested to furnish the services of a mediator for the purpose of assisting the parties in reaching agreement. The request for a mediator shall be jointly filed. This procedure is intended to serve as an alternate dispute resolution procedure to those set forth in Chapter 4117 of the Ohio Revised Code. G. The procedures set forth above may be modified prior to the start of negotiations by joint agreement of the parties. Should that occur, the bargaining shall be governed by the ground rules agreed to modifying these procedures.

  • Scope of Negotiations The obligation to bargain collectively means to negotiate at reasonable times and to execute a written contract incorporating the terms of any agreement reached. The obligation to bargain collectively does not require the Board and the Association to agree to a proposal nor does it require the making of a concession. Those matters, which are negotiable, are: wages, hours, terms and other conditions of employment and the continuation, modification, or deletion of an existing provision of this Agreement.

  • Exclusive Negotiations The State will not bargain collectively or meet with any employee organization other than MSEA-SEIU with reference to terms and conditions of employment of employees covered by this Agreement. If any such organizations request meetings they will be advised by the State to transmit their requests concerning terms and conditions of employment to MSEA-SEIU.

  • Negotiations At the written request of a Party, each Party will appoint a knowledgeable, responsible representative to meet and negotiate in good faith to resolve any dispute arising out of or relating to this Agreement. The Parties intend that these negotiations be conducted by non-lawyer, business representatives. The location, format, frequency, duration, and conclusion of these discussions shall be left to the discretion of the representatives. Documents identified in or provided with such communications, which are not prepared for purposes of the negotiations, are not so exempted and may, if otherwise discoverable, be discovered or otherwise admissible, be admitted in evidence, in the arbitration or lawsuit.
