Notice To All Prospective Contractors. 86.1.1. Local Law No. 34 of 1991 became effective on September 10, 1991 and added Section 6- 115.1 of the Administrative Code. The local Law provides for certain restrictions on City Contracts to express the opposition of the people of the City to employment discrimination practices in Northern Ireland to promote freedom of work-place opportunity. 86.1.2. Pursuant to Section 6-115.1, prospective Contractors for Contracts to provide goods or services involving an expenditure of an amount greater than ten thousand ($10,000.) dollars, or for construction involving an amount greater than fifteen thousand ($15,000.) dollars, are asked to sign a rider in which they covenant and represent, as a material condition of their Contract, that any business operations in Northern Ireland conducted by the Contractor and any individual or legal entity in which the Contractor holds a ten (10%) percent or greater ownership interest in the Contractor will be conducted in accordance with the XxxXxxxx Principles of nondiscrimination in employment. 86.1.3. Prospective Contractors are not required to agree to these conditions. However, in the case of Contracts let by competitive sealed bidding, whenever the lowest responsible bidder has not agreed to stipulate to the conditions set forth in this notice and another bidder who has agreed to stipulate to such conditions has submitted a bid within five (5%) percent of the lowest responsible bid for a Contract to supply goods, services or contraction of comparable quality, the Agency shall refer such bids to the Mayor, the Speaker or other officials, as appropriate, who may determine, in accordance with applicable Law, that it is in the best interest of the City that the Contract be awarded to other than the lowest responsible pursuant to Section 313(b)(2) of the City Charter. 86.1.4. In the case of Contracts let by other than competitive sealed bidding, if a prospective Contractor does not agree to these conditions, no Agency, elected official or the City Council shall award the Contract to that bidder unless the Agency seeking to use the goods, services or construction certifies in writing that the Contract is necessary for the Agency to perform its functions and there is no other responsible Contractor who will supply goods, services or construction of comparable quality at a comparable price. 86.2. Notice To All Prospective Contractors. Local Law No. 29 of 2000, effective August 23, 2000, added Section 1058 to the Charter of the City of New York. The local law provides for, among other things, the distribution of voter registration forms by City Consultants, under certain circumstances, in the performance of their services under City agreements. The Department hereby provides fair notice to prospective Consultants that they may be required to comply with the provisions of Section 1058 for contracts entered into on or after August 23, 2000. As detailed in Article I, Part A, below, Consultants (or subConsultants, as appropriate), if they have regular contact with the public in the daily administration of their business, shall be required to provide and distribute voter registration forms to all persons together with written applications for services, renewal or recertification for services and change of address relating to such services, whether in person or through the United States mail, provided that this requirement does not apply to services that must be provided to prevent actual or potential danger to the life, health or safety of any individual or of the public. In addition, these Consultants shall incorporate an opportunity to request a voter registration application into any application for services, renewal or recertification for services and change of address relating to such services provided on computer terminals, the World Wide Web or the Internet. In response to such request, these Consultants must send a voter registration form to the person requesting it, or direct that person to where the form may be downloaded. As detailed in Article I, Part B, Consultants or subConsultants may also provide certain other services related to voter registration. Specifically, these Consultants may provide assistance to applicants in completing voter registration forms, and may receive and transmit completed forms for transmittal to the New York City Board of Elections.
