Notification of Prescription Medications/Narcotics. All personnel operating motor vehicles in the course of their employment with the City, holding CDLs, or occupying safety sensitive positions are required to notify the applicable Department Head and Safety-Service Director when under a course of treatment that includes prescription narcotics so that a review of the employee’s essential job functions and the impact, if any, of those prescription narcotics can be made. Such information shall be considered confidential and not subject to disclosure except to the Medical Review Officer who shall evaluate the employee’s ability to safely perform the essential functions of his position in light of the prescription medication. The Medical Review Office shall be a physician designated by the City and having expertise in occupational medicine.

Notification of Prescription Medications/Narcotics. Employees shall be required to notify the Department Head when under a course of treatment that includes prescription narcotics. In such case, the employee shall provide notification from the employee’s physician that he/she has the ability to safely perform the essential functions of his/her position in light of the prescription medication. Such notification shall not disclose medical information, including the prescription drug itself, which shall be confidential and not subject to such disclosure, except that such shall be disclosed to the City’s Medical Review Officer, who shall be a physician designated by the City and having expertise in occupational medicine, when so required by the Employer to do so.

The Risk Manager shall have the authority to consult with the Medical Review Officer who shall be a physician designated by the County and having expertise in occupational medicine. In the event that the opinion of the Medical Review Officer is in conflict with the employee’s own physician, the Employer will designate a third physician having expertise in occupational medicine to review the issue and render an opinion on the employee’s fitness for duty. The opinion of that third physician shall be binding on the parties and the Employer will pay for that opinion.

In the event a determination has been made that the employee is not fit for duty as a result of a prescribed medication, he shall be permitted to use available sick leave.

The actual substance under review will not be subject to disclosure except to the Medical Review Officer who shall evaluate the employee’s ability to safely perform the essential functions of his position in light of the prescription medication. The City Manager/designee shall have the authority to consult with the Medical Review Officer who shall be a physician designated by the City and having expertise in occupational medicine. Such consultation shall not include the specifics of the substance being prescribed but shall be limited to the Medical Review Officer’s determination of whether or not the employee remains fit for duty while under the course of the prescribed treatment, and if not, whether or not a reasonable accommodation can be made that would enable the individual to perform the essential functions of his position without posing a danger to himself or others. The employee shall be required to execute a limited release permitting the City Manager/designee to receive this information from the Medical Review Officer.
