Obligations of the Minister. 12.1 Subject to clauses 12.2 and 12.3 and starting from the first payment date, the Minister is required to direct the Fund Manager to make such management payments specified in the payment schedules from the relevant biobank site account to the landowner, at such intervals specified in the payment schedules.
12.2 The Minister may only make such a direction if:
12.2.1 the relevant biobank site account has sufficient funds to cover the management payment, and
12.2.2 the landowner has submitted the annual report for the preceding reporting period in accordance with clause 7.2 and Annexure D of this agreement, and
12.2.3 the Minister has reviewed the annual report for the preceding reporting period and is satisfied that the landowner has complied with their obligations set out in this agreement in the preceding period.
12.3 The landowner acknowledges that the Minister may, with the agreement of the landowner, direct that the management payments should not be made, or should be reduced, for a specified period of time or until further notice if the biobank site account has an operational deficit greater than the operational deficit threshold. Note: Withholding or lowering payments when funds in the account are below the maximum operational deficit may help to preserve the long-term financial viability of the fund for the landowner.
12.4 If the Minister, with the agreement of the landowner, directs that management payments be reduced or not be made for a specified period of time or until further notice, then:
12.4.1 the Minister may, by written agreement with the landowner, suspend or vary any of the landowner’s obligations to carry out management actions under this agreement for the same period of time or some other period, and
12.4.2 despite clause 4 of this agreement, the landowner’s obligations to carry out management actions under this agreement are suspended or varied in accordance with the agreement. The Minister must not agree to any variation or suspension under this clause unless satisfied that the variation or suspension does not have a negative impact on the biodiversity values protected by the agreement.
12.5 The landowner acknowledges that the Minister may, in addition to the management payments, direct additional payments to be paid from the BioBanking Trust Fund to the landowner, but only in circumstances where the biobank site account has an operational surplus, the operational surplus amount exceeds the maximum operational surplus for the bioba...
Obligations of the Minister. The Minister of Sustainable Development, Environment, Wildlife and Xxxxx agrees to:
a) Provide the KRG with the management plan for Parc national Tursujuq as well as any change or replacement to it; the management plan shall be attached to the Tursujuq Agreement as an integral part of it;
b) Provide the KRG, according to its means, with all the available technical assistance it has and related to execution of this mandate;
c) Cover all the costs including in particular legal fees and all costs related to carrying out this mandate, beyond all amounts and fees covered by the insurance policies mentioned in this mandate;
d) Collaborate with the Cree and Inuit cultural bodies involved to identify sites and areas within the park that could benefit from a culturally appropriate name, in order to give the information to the appropriate authorities.
Obligations of the Minister. The Minister undertakes to:
1. Make available free of charge to the KRG, at the Kuujjuaq and Inukjuak offices, the technological infrastructure required to grant it access to the Department’s computer systems for the carrying out of its mandate, to keep them in a good state of operation at its expense and in the same manner as the Department;
2. Provide the employees of the KRG with the same information and the same training programs as those given to the Department’s employees for the performance of their tasks. If the Minister cannot meet this obligation, he can authorize the KRG to call on an outside firm and reimburse the KRG for the costs;
3. Provide free of charge to the KRG the forms used;
4. Consult the KRG just as it does the regional directorates or local offices on any project to develop orientations, programs, activities or operational methods related to the fields covered by the present mandate; The customer services assumed by the Minister will be available in French and in English. The technical support, the documentation and the training provided by the Minister will be available in French only.
Obligations of the Minister. The Minister undertakes to transfer to the KRG the expertise of the ministère de la Famille et des Xxxxx regarding the exercise of the powers and mandates attributed by the present mandate, in particular in the sectors of inspection and technical and professional support with existing nursery schools, coordinating offices and childcare centres or those in the process of being set up.
Obligations of the Minister. The Minister covenants with the Owner as follows: -
7.1 The Minister must bear the costs of, and incidental to, the preparation of this Agreement including payment of the Owner's reasonable legal costs connected with the execution of the Agreement and any necessary stamp duty and registration fees.
7.2 The Minister agrees to notify the Registrar General when this Agreement has been entered into, varied or terminated so that the Registrar General can carry out his or her responsibilities pursuant to Section 69F of the Act.
7.3 The Minister will arrange for the provision of technical advice and any other assistance to the Owner as the Minister deems necessary to assist with the implementation of this Agreement.
7.4 The Minister agrees to the extent of his or her statutory responsibilities that the signing of this Agreement shall not render the Owners ineligible for any compensation and assistance which may, under future legislation, become available to landowners who enter into a conservation agreement pursuant to the Act or any other Act.
Obligations of the Minister. The Minister’s obligations hereunder include:
a) In accordance with subparagraph 91(d) (i) of the Regulations, to receive the Provincial Allocation from the Investor and keep it until the beginning of the Allocation Period unless the Provincial Allocation is repaid to the Investor under paragraph 92(b) of the Regulations.
b) In accordance with subparagraph 91(d) (ii) of the Regulations, to transfer the Investor's Provincial Allocation to the XYZ Fund at the beginning of the Allocation Period in accordance with paragraph 92(d) of the Regulations, unless the XYZ Fund is suspended under subsection 93(1) of the Regulations.
c) In accordance with subparagraph 91(d) (iii) of the Regulations, to prepare and deliver to the Investor a Debt Obligation, in the form attached as Schedule “A”, at the beginning of the Allocation Period in accordance with paragraph 92(e) of the Regulations.
d) In accordance with subparagraph 91(d)(iv) of the Regulations, to receive the Provincial Allocation transferred by the XYZ Fund at the end of the Allocation Period in accordance with paragraph 92(g) of the Regulations.
e) In accordance with subparagraph 91(d)(v) of the Regulations, in the event of default by the XYZ Fund to transfer the Provincial Allocation under paragraph 92(g) of the Regulations, to receive the Provincial Allocation from the province in accordance with paragraph 92(h) of the Regulations.
f) In accordance with subparagraph 91(d)(vi) of the Regulations, to repay the Provincial Allocation to the Investor thirty (30) days after the expiry of the Allocation Period in accordance with paragraph 92(i) of the Regulations.
Obligations of the Minister. 11.1 The Minister agrees to notify the Registrar General when the Conservation Agreement has been entered into so that the Registrar General can carry out his or her responsibilities under section 69F of the NPW Act.
11.2 The Minister will arrange for the provision of technical advice and any other assistance to the Owner as the Minister deems necessary to assist with the implementation of the Conservation Agreement.
