OPERATION OF THE PANEL. The Panel Chairman The Panel Chairman shall be the Panel Member appointed as such, from time to time, by a simple majority of the Panel Members. The Panel Chairman may at any time be removed from the office of Panel Chairman by a simple majority of the Panel Members or at the direction of the Authority. Where a Panel Member is removed from the office of Panel Chairman he may not be reappointed as such without the Authority’s prior consent. The Panel Chairman shall preside at every meeting of the Panel at which he is present. If the Panel Chairman is unable to be present at a meeting, he may nominate, by notice in writing to the Panel Secretary, another Panel Member (or his Alternate) to act as Panel Chairman for that meeting. If neither the Panel Chairman nor any person nominated by him in accordance with this Clause 7.3 is present at a Panel meeting, the Panel Members present may, by simple majority, appoint any one of their number to preside at that meeting. The Panel Chairman shall be entitled to vote in his capacity as a Panel Member. The Panel Chairman shall in no circumstances be entitled to an extra or casting vote.
OPERATION OF THE PANEL. The Panel shall adopt rules of procedure for its operations at its first meeting. After each meeting a report of infractions and related matters shall be made available to the public. The Panel will prepare an annual report on its activities. The proceedings of the Panel will not be public, and its members shall not divulge any information concerning individual vessels and operators derived from review forms or from the proceedings of the Panel. In- formation concerning compliance with the terms of the Agreement will be made public by means of the Panel's Re- ports.
OPERATION OF THE PANEL. The Conduct of Proceeding of the Panel shall be in accordance with rules, which may be established from time to time by mutual agreement between the parties, the most recent version of which is attached as “Appendix During the Hearing, only the Arbitrator, members of the Panel hearing the case, parties presenting the case and the Coordinator shall be allowed to sit in the immediate area where the Hearing is being conducted. Any other observers shall only be allowed to be present where specifically granted permission by the Coordinator of the Panel. The Panel shall make all decisions in an executive session after each individual case has been heard. While in Executive Session only Panel members and the Coordinator will be in attendance. After each decision is reached by the Arbitrator and Panel, the Arbitrator will issue the Award on the Award Form provided for this purpose and it shall be signed by the Arbitrator and members of the Panel and filed with the Coordinator. The Coordinator will mail decisions within hours of the Hearing. No decisions will be given the day of the Hearing. ADMINISTRATION OF THE PANEL All correspondence issued on behalf of The Canadian Joint Grievance Panel Inc. shall be issued on stationary bearing its name. All authorized expenses incurred on behalf of or in the name of The Canadian Joint Grievance Panel shall be paid jointly by all attending parties. Rules and Regulations may be changed or amended by mutual agreement of the participating parties. Cancellation fees will be assessed in the following manner:
