Operations and Maintenance Manuals. 7.21.1 At least three (3) months prior to the Opening Date, or as soon thereafter as practicable, the Padres shall present to the City a preliminary draft of a Ballpark Operations Guidelines and Policy Manual (the “Operations Manual”), reflecting the Padres’ proposed plan for implementing the proper operation of the Ballpark Property. The Padres shall solicit and obtain comments from the City to such preliminary draft. The Padres shall complete and deliver a final Operations Manual to the City no later than the last day of the first Major League Baseball Season during the Term.

Operations and Maintenance Manuals. As part of the Work, Construction Manager shall submit a preliminary operations and maintenance manual which is complete as of the date of its submission for review by the Owner and the Architect prior to the first application for payment when 50 % or more of the Work has been completed. No payments beyond 50% shall be made until the preliminary O&M Manual has been received by the Owner and Architect. The O&M Manuals shall contain but not be limited to a complete set of all submittals, all product data as required by the specifications, training information, a telephone list of consultants, manufacturers, installers and suppliers, manufacturer’s printed data, recording and shop drawings, schematic diagrams of systems, equipment indexes, warranties and bonds. The Owner’s representative shall review and return the O&M Manual. Prior to its submission of its final payment request five complete and approved sets of O&M Manuals shall be delivered by the Construction Manager to the Owner and Architect.
