Other Leaves of Absence. All employees covered by this Agreement may be granted leaves of absence only by action of the Executive Committee. Except as provided in Section 6.3 above, leaves of absence without pay may be granted based on the following conditions: 1. Request for leave shall be in writing, stating the reason for the requested leave, and submitted to the Director, setting forth the length of leave requested. 2. Written notice of intention to either return or resign shall be given by the employee to TMCSEA fifteen (15) calendar days prior to the end of the leave of absence. Failure to furnish such written notice shall constitute a notice of resignation. 6. An employee returning from a leave of absence without pay will be reassigned to the job classification he or she left. 7. An employee on an unpaid leave of absence may remain in TMCSEA’s insurance plans, but shall pay the full premium costs for same on a monthly basis. Arrangements may be made at the Director’s discretion for time off with pay to attend the funeral of a student. Short-term leaves of absence without pay, not to exceed five (5) workdays, may be granted at the discretion of the Director. Personal leave shall be exhausted prior to any unpaid short-term leave of absence.

Written requests for an extension of a leave shall be submitted prior to the job classification he or she leftexpiration of the leave. 7. An employee on an unpaid leave of absence 10.8.2.1 The Appointing Authority may remain in TMCSEA’s insurance plans, but shall pay the full premium costs for same on a monthly basis. Arrangements may be made at the Director’s discretion for time off with pay to attend the funeral of a student. Prior to returning from a leave of absence, the employee shall contact the supervisor to ensure that all necessary documents have been completed and steps taken. 10.8.6 For purposes of this Section 10.8, seniority shall be defined in accordance with Section 11.1.1 of Article 11, entitled Layoff. 10.8.7 Any employee who is absent without notification to their Department Director, or designee, for two consecutive work shifts, shall be separated from City service, unless the failure to report is due to extenuating circumstances beyond the control of the employee. An employee will be considered to be absent without notification pursuant to this Section, if notification is not provided prior to the commencement of the second consecutive shift. 10.8.8 Employees who have been separated from City service for failure to return from leave, or failure to report, and whose failure is determined by the City to be the result of extenuating circumstances beyond the employee’s control shall be reinstated.

Except as otherwise indicated in the Collective Agreement, applications for Leaves of Absence without pay will be adjudicated on the basis of merit, compassion, length of service and the operational needs of the store. Employees returning from an unpaid leave or absence shall be placed on the salary schedule at the Directorsame place they occupied at the beginning of the leave unless they have completed teaching the equivalent of one semester’s discretion for time off with pay duty in the school year in which the leave was taken. In the latter case, employees shall be granted a full year’s credit on the salary schedule. Prior to attend the funeral approval of any leave request pursuant to this clause, the Superintendent and/or Board may require that the employee submit proper documentation such as statements of a studentphysician, admission in an institution of higher learning, or approval by the proper agency of adoption. All leaves shall normally commence at the beginning of the school year or immediately after Christmas vacation, and reinstatement at other than the agreed upon time shall be at the discretion of the Executive Committee. However, in the event of adoption of a child and the may grant an employee does not receive sufficient advance notice of the delivery of the child in order for the leave to commence at a natural break in the school year, the leave shall commence the day the child arrives and will terminate at the agreed upon subsequent break in the school year providing that the employee had informed the Administration at the time of making application for an adopted child that such application was being made and thereafter kept the Administration informed as to the most likely schedule for the adoption to proceed. 4. Sick leave days shall not accrue, but unused sick leave held at the start of the leave shall be available upon reinstatement. 5. Written notice of intention to either return or resign shall be given by the employee to TMCSEA fifteen (15) calendar days prior to the end of the leave of absence. Failure to furnish such written notice shall constitute a notice of resignation. 6. An employee returning from a leave of absence without pay will be reassigned to the job classification he or she left. 7. An employee on an unpaid leave of absence may remain in TMCSEA’s insurance plans, but shall pay the full premium costs for same on a monthly basis. Arrangements may be made at the Director’s discretion for time off with pay to attend the funeral of a student. Short-term leaves of absence without paygood and sufficient reason, not to exceed five twelve (512) workdaysmonths. Such leaves may, may however, be granted at the discretion extended, not to exceed an additional six (6) months, upon written request of the Directoremployee, subject to approval of the appointing authority, or designee. Personal Written requests for an extension of a leave shall be exhausted submitted prior to any unpaid short-the expiration of the leave. 10.8.3 Any leave granted pursuant to the provisions contained herein may be canceled by the appointing authority, or designee, by notice in writing mailed to the employee at the employee's address on file in the Human Resources Department or such other address as the employee may designate. Such notice shall be by registered mail, return receipt requested and shall be mailed not later than thirty (30) days prior to the effective date of the cancellation of the leave. Failure of the employee to return to work on the first scheduled work day after the effective date of the cancellation, or on the first scheduled work day following the expiration of a leave, shall be considered a voluntary resignation, unless the failure to return is due to extenuating circumstances beyond the control of the employee. Each employee who is granted a leave pursuant to the provisions of this Article shall, upon return from leave, be entitled to a position in the department within the classification held by the employee at the time the leave commenced. 10.8.4 If the position to which an employee would otherwise be entitled pursuant to the above has been deleted from the department's budget during the term of the employee's leave of absence, the employee shall, upon return from leave, be entitled to a position within the classification held by the employee at the time the leave commenced, provided there is either a vacancy in such classification or an employee in the classification with less seniority whose duties the returning employee is qualified to perform. 10.8.5 The employee is responsible for coordinating the return to work following a leave of absence. Prior to returning from a leave of absence, the employee shall contact the supervisor to ensure that all necessary documents have been completed and steps taken. 10.8.6 For purposes of this Section 10.8, seniority shall be defined in accordance with Section 11.1.1 of Article 11, entitled Layoff. 10.8.7 Any employee who is absent without notification to their Department Director, or designee, for two consecutive work shifts, shall be separated from City service, unless the failure to report is due to extenuating circumstances beyond the control of the employee. An employee will be considered to be absent without notification pursuant to this Section, if notification is not provided prior to the commencement of the second consecutive shift. 10.8.8 Employees who have been separated from City service for failure to return from leave, or failure to report, and whose failure is determined by the City to be the result of extenuating circumstances beyond the employee’s control shall be reinstated.

Other Leaves of Absence. All employees covered A. A full-time member of the Police Department who is temporarily either mentally or physically incapacitated to perform his/her duties or who temporarily desires to engage in a course of study which will increase his/her usefulness upon return to service, or who for any reason considered good by this Agreement may the Township Committee and to secure leave from his/her regular duties may, with the approval of the Township Committee, upon recommendation of the Chief of Police, be granted leaves of absence only by action of the Executive Committee. Except as provided in Section 6.3 above, leaves of absence without pay may be granted based on the following conditions: 1. Request for leave shall be in writing, stating the reason for the requested leave, and submitted to the Director, setting forth the length of leave requested. 2. All leaves of absence shall be limited to a maximum of one (1) school year. 3. Short-term leaves special leave of absence without paypay other than as herein provided under the Statutes, the Township Committee shall, at the time the leave is approved, determine whether the employee granted such leave shall be entitled to his/her former positions upon return from such leave or whether his/her name shall be placed on the re-employment list. B. Any employee granted such leave of absence by the Township Committee (not to exceed five (5six months) workdays, may be granted at the discretion of the Director. Personal leave shall be exhausted prior to any unpaid short-term not accumulate seniority while on leave of absence, and shall have all fringe benefits discontinued while on leave of absence except in the case of veterans to the extent so provided by State and Federal Law or other statuary leave permitted under FMLA or other laws providing for leave time and retaining employee status.
