OUTCOME OF TESTING. The Customer will issue a Satisfaction Certificate when it is satisfied that a Milestone has been Achieved. If any Milestones (or any relevant part thereof) do not pass the Test in respect thereof then: the Supplier shall rectify the cause of the failure and re-submit the Deliverables (or the relevant part) to Testing, provided that the Parties agree that there is sufficient time for that action prior to the relevant Milestone Date; or the Parties shall treat the failure as a Supplier Default.

OUTCOME OF TESTING. 6.1 On receipt of a final Test Report for a Test Stage in accordance with this Agreement, the DCC will review the Test Report not more than ten (10) Working Days after receipt of the Test Report (or within any such other timeframe as may be expressly agreed by the parties in writing).

OUTCOME OF TESTING. 11.1 UK Biobank shall issue a Test Certificate when the Deliverables satisfy the Test Success Criteria in respect of that Test without any Test Issues. 11.2 If the Deliverables (or any relevant part) do not satisfy the Test Success Criteria, then UK Biobank shall notify the Service Provider and: 11.2.1 UK Biobank may issue a Test Certificate conditional upon the remediation of the Test Issues 11.2.2 where the Parties agree that there is sufficient time, in accordance with the Implementation Plan, UK Biobank may extend the Test Plan by such reasonable period or periods as the Parties may reasonably agree and require the Service Provider to rectify the cause of the Test Issue and resubmit the Deliverables (or the relevant part) to Testing; or 11.2.3 where the failure to satisfy the Test Success Criteria results, or is likely to result, in a Delay, then without prejudice to UK Biobank’s other rights and remedies, such failure shall constitute a Notifiable Default for the purposes of clause 28.1 (Rectification Plan Process).
OUTCOME OF TESTING. 12.1 Network Rail shall issue a Test Certificate or Assurance of a Test Phase as soon as reasonably practicable when the Deliverables satisfy the Test Success Criteria in respect of that Test without any Defects. 12.2 If the Deliverables (or any relevant part) do not satisfy the Test Success Criteria then Network Rail shall notify the Supplier and: 12.2.1 Network Rail may issue a Test Certificate conditional upon the remediation of the Defects or provide Assurance of a Test Phase with caveats; 12.2.2 where the Parties agree that there is sufficient time prior to the relevant Milestone Date, Network Rail may extend the Test Plan by such reasonable period or periods as the Parties may reasonably agree and require the Supplier to rectify the cause of the Defect and resubmit the Deliverables (or the relevant part) to Testing; or 12.2.3 where the failure to satisfy the Test Success Criteria results, or is likely to result, in the failure (in whole or in part) by the Supplier to meet a Milestone, then without prejudice to Network Rail’s other rights and remedies, such failure shall constitute a Notifiable Default for the purposes of clause 28.1 (Rectification Plan Process). 12.3 Network Rail shall be entitled, without prejudice to any other rights and remedies that it has under this Agreement, to recover from the Supplier any reasonable additional costs it may incur as a direct result of further review or re-Testing which is required for the Test Success Criteria for that Deliverable to be satisfied.
OUTCOME OF TESTING. 19.1 Deliverables will complete Testing and a Test Certificate shall be issued when the Deliverables satisfy the Test Success Criteria in respect of that Test without any Test Issues. 19.2 If the Deliverables (or any relevant part) do not satisfy the Test Success Criteria then: 19.2.1 the Contractor shall rectify the cause of the failure and re-submit the Deliverables (or the relevant part) to Testing, provided that the parties agree that there is sufficient time for that action prior to the relevant Milestone Date; or 19.2.2 the parties shall treat the failure as a Contractor Default. 19.3 When the Authority has issued Test Certificates and/or conditional Test Certificates in respect of all the Deliverables related to a Milestone it will also grant a Milestone Achievement Certificate. 19.4 The grant of a Milestone Achievement Certificate will entitle the Contractor to the receipt of a payment in respect of that Milestone in accordance with the provisions of schedule 7.1 (Charges and Invoicing).

This Contract Schedule 6 comprises: Part A: Service Levels and Service Credits; Annex 1 to Part A - Service Levels and Service Credits Table; and Annex 1 to Part B: Performance Monitoring.
