Paperwork Reduction Act Statement. This proposed rule contains new or amended collections of information subject to the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.). This proposed rule has been submitted to the Office of Management and Budget (OMB) for review and approval of the information collection(s). Type of submission, new or revision: Revision. The title of the information collection: 10 CFR part 26, Fitness for Duty Drug Testing Requirements. The form number if applicable: Not applicable. How often the collection is required: Once and annually. One-time information collections include the licensee or other entity of each FFD program completing revisions to the FFD program policy and FFD procedures, to distribute information on the FFD program policy updates to individuals subject to 10 CFR part 26, and for those subject individuals to review the information on the FFD program policy changes. Annual information collections include the licensee or other entity of each FFD program submitting an FFD program performance report to the NRC to provide information on the additional positive drug test results that would result from the proposed rule changes. On occasion, a third party disclosure would be made for each additional positive drug test result from the proposed rule changes. Also, on occasion, the license or other entity would report information to the NRC in the form of a 24-hour event report when some individuals (e.g., licensed reactor operators, supervisors) test positive as a result of the proposed rule changes. Who will be required or asked to report: Licensees of nuclear power reactor sites (operating and under construction), licensees of Category I fuel cycle facilities, contractors/vendors, HHS-certified laboratories, and individuals with a positive drug test result. An estimate of the number of annual responses: 7,813 (33 recordkeepers + 68 reporting responses + 7,712 third-party disclosures). The estimated number of annual respondents: 149 (27 FFD programs, 12 HHS-certified laboratories, 6 licensee testing facilities, and 104 individuals with a positive drug test result). An estimate of the total number of hours needed annually to complete the requirement or request: 1,382 (559 hours recordkeeping + 71 hours reporting + 752 hours third-party disclosure).
