Payment for Leave on Termination. An Employee is entitled to payment for untaken annual leave on termination of service.

Payment for Leave on Termination. If an employee leaves or is dismissed, the Employer must pay the Employee any leave entitlement available plus any pro rata accrual of leave for any part year worked since the Employee began working or last qualified for leave. Where an employee has been paid a loading as prescribed in Clause 6.1.2 for leave taken but not yet fully entitled, the Employer may deduct from monies due, the equivalent amount of the loading paid for all accrued leave taken. Where an employee resigns or is terminated, leave loading will only be paid on entitled leave available to the employee.
