Payment of Common Area Expenses. Landlord shall furnish to Tenant a written statement setting forth Landlord’s reasonable estimate of Tenant’s Proportionate Share of Common Area Expenses for the balance of the calendar year in which the date hereof occurs. During each calendar year thereafter, Landlord shall furnish to Tenant written statement setting forth Landlord’s reasonable estimate of Tenant’s Proportionate Share of Common Area Expenses for that calendar year. Tenant shall pay to Landlord on the first day of each month during the Term, an amount equal to one-twelfth (1/12) of Landlord’s estimate of Tenant’s Proportionate Share of Common Area Expenses for that calendar year or partial calendar year, as the case may be. After the end of each calendar year or partial calendar year, Landlord shall furnish to Tenant a statement (the “Actual CAE Statement”) setting forth the actual Common Area Expenses and computing Tenant’s Proportionate Share of such Common Area Expenses. If the Actual CAE Statement shows that the sums paid by Tenant exceed Tenant’s Proportionate Share of Common Area Expenses, Landlord shall at Landlord’s option either refund to Tenant the amount of such excess or permit Tenant to credit the amount thereof against subsequent payments of Common Area Expenses under this Article 5. If the Actual CAE Statement shows that the sums paid by Tenant were less than Tenant’s Proportionate Share of Common Area Expenses, Tenant shall pay the amount of such deficiency within twenty (20) days after demand therefor. Upon the expiration or earlier termination of this Lease (except for termination resulting from Tenant’s default), Tenant’s Proportionate Share of Common Area Expenses shall be appropriately prorated to reflect Common Area Expenses which are due through the expiration or termination date. This provision shall survive the expiration or earlier termination of this Lease. Landlord shall have the right to use a twelve (12) month period other than a calendar year to calculate Tenant’s Proportionate Share of Common Area Expenses.
Payment of Common Area Expenses. Tenant shall pay its pro rata share of Property Operating Costs of actual calendar year expenses as indicated as additional rent in Exhibit B.
Payment of Common Area Expenses. Commencing on the Commencement Date and continuing for the duration of the Term, Tenant agrees to pay Landlord, as Additional Rent, in the manner provided below, for each calendar year that contains any part of the Term, Tenant’s Share of Common Area Expenses.
Payment of Common Area Expenses. Landlord shall keep or cause to be kept said common areas in a safe, neat, clean and orderly condition, properly lighted and landscaped, and shall repair any damage to the facilities thereof in a timely manner. All expenses in connection with the common areas shall be charged and prorated in the manner hereinafter set forth.
(a) It is understood and agreed that the phrase “Common Area Expenses” shall be construed to include all costs, expenses and fees expended in operating, administering, managing, maintaining and repairing the Shopping Center buildings and common areas. Landlord and Tenant hereby acknowledge and agree that such “Common Area Expenses” shall also include the cost of maintaining landscaped areas in the median strip dividers of adjoining streets, the cost of maintaining landscaped areas on adjacent public land as may be required by governmental agencies, the cost of maintaining any public street or sidewalk, the cost of operating any recycling center that may be required by governmental rules, regulations or statutes, and any assessments which may be imposed on Landlord under the Declaration or other recorded instruments affecting title to the Shopping Center. Such costs, expenses and fees shall include, without limitation, all general maintenance and repairs, resurfacing, or painting, restriping, cleaning, sweeping, janitorial services, pest control and garbage collection; purchase, replacement and maintenance of trash receptacles located within the common areas; maintenance and repair of sidewalks, curbs and gutters; repair, maintenance, insurance, maintenance costs and expenses related to Shopping Center signs; irrigation systems, planting and landscaping; electricity for lighting, water, sewer, gas and other utilities; directional signs and other markers and bumpers; maintenance and repair of any fire protection systems, lighting systems, heating and air conditioning systems storm drainage systems and any other utility systems; personnel to implement such services, including, if Landlord deems necessary (but without any obligation to supply security guards), the cost of security guards; any governmental imposition or surcharge imposed upon Landlord or assessed against any portion of the common area; the cost to Landlord of any additional improvements made to the common areas after the commencement of the term; all costs with respect to repairs and maintenance of roofs, structural portions of the buildings of which the Premises constitute...
Payment of Common Area Expenses. Lessee shall pay to Lessor, on the first day of each month after commencement of the term hereof and continuing during the term hereof, an amount estimated by Lessor to be Lessee's proportionate share of the Common Area Expenses (as defined in Section 4.10). Lessee's proportionate share of the Common Area Expenses shall constitute additional rent and shall be equal to the total Common Area Expenses for the Shopping Center multiplied by a fraction, the numerator of which shall be the total floor area of the Improvements built or to be built upon the Premises, and the denominator of which shall be the total floor area (including all floor area used for sales area within any multi-floor structures and mezzanine and basement areas) of all buildings of the Shopping Center intended for the exclusive use of tenants or other occupants, whether or not so occupied. Common Area Expenses that cover a period not within the Term of this Lease shall be prorated. In the event the actual floor area of the entire Shopping Center at the time of completion of the Improvements or any time thereafter during the Term hereof shall increase or diminish from the proposed total floor area, then the percentage set forth herein shall be adjusted accordingly, subject to the aforesaid limitation.
Payment of Common Area Expenses. Tenant agrees to timely pay any common area expenses or other charges imposed by a Restrictive Agreement applicable to the Leased Premises directly to the appropriate party under the Restrictive Agreement, which charges shall be computed and paid in accordance with the terms of a Restrictive Agreement. Landlord shall not be liable for any expenses or charges imposed by any Restrictive Agreement applicable to the Leased Premises.
