Payment Transactions. Rent and other payments are to be paid in the manner designated by the Lessor on a monthly basis in advance by the 6th date of each month to a bank account or other recipient as indicated by the Lessor. Should the Tenant not pay the aforementioned rent and other fees by the due date, overdue interest on the unpaid charges will be the maximum overdue interest rate as stipulated by the Interest Act. The Payment is shown on the Account in USD, after its receipt by the Company. a) The Payment is executed using exclusively the payment services provided in the Cabinet. b) A Payment in any other form (different from the ones stated above) may be executed by the Client only with the written permission of the Company. Otherwise the Company has the right to not receive such Payment or return the received money to the payer’s account (minus the cost of banking operations). 7.2. The Company has the right to demand a copy of the payment document from the Client, provided by the bank or the Payer’s payment service with a note of execution. If the payment is made by bank transfer, the Client is obliged to specify the following payment purpose in the payment documents: "Payment under Client Agreement №01-2016". a) In the case of improper purpose of the payment by the Client, the Company has the right not to show the payment on the Account, and not to make any transactions with the payment before the Client has clarified the purpose of the payment. In this case, the Client is obliged to provide the Company with a written clarification of the purpose of the payment. In case of Client’s failure to fulfill this obligation before the end of the calendar month during which the corresponding payment was entered, the Company is entitled to return the payment to the account from which it was received. 7.4. The payment is made on the basis of the Application, form of which is available in the "Deposit" subsection of the “Banking" section of the Cabinet. The cancellation of the Application, submitted according to this paragraph, cannot be carried out after being sent. 7.4.1. Payments are credited to the account in the following terms: a) Payments transmitted to the Company’s bank account, are processed no later than one day after the day of the receiving; b) Payments transmitted to the Agent’s bank account, are processed no later than one day after the day of the funds being transferred to the Company’s business account by the Agent. 7.5. Payment Transactions. All Payment Transactions shall be governed by the provisions of the following sections: a. Reporting obligations prior to issuance of the Payment Order: Single Identifier: The Customer is required to confirm and verify the data relating to Payment Orders it sends to the Bank. For the proper execution of Payment Orders, the Customer must furnish the Bank with the international Bank Account number (IBAN) in order to identify the Payment Account(s) affected by the Payment Transaction intended to be executed, or in the case of utilization of Payment Instruments, the identifier relates to the card number or PAN. For this purpose, a Payment Order shall be deemed to be properly executed when made in favor of the Beneficiary of the Single Identifier furnished by the Customer. Consequently, the Bank shall not be liable for the non-execution or defective execution of a Payment Transaction when it was carried out in favor of the Single Identifier furnished by the Customer, regardless of the Customer having furnished additional information for the proper execution of the Payment Transaction. Notwithstanding the above, in these cases of defective execution of a Payment Transaction, the Bank shall make a reasonable effort shall make such efforts as are reasonable in order to recover the funds of the Payment Transaction. In the event that it is not possible to recover the funds, the Bank will provide the Customer, upon the Customer's written request, with all the information in its possession that is relevant for the Customer to make a legal claim to recover the funds. 5350/30/03 – HD0121-02 b. Payment Transactions. 4.1.1 The Merchant shall accept the Cards in making Payment Transactions in relation to the sale of all goods and services offered by the Merchant without any differentiation and in accordance with this Agreement. 4.1.2 Payment Transactions shall not be made or accepted by the Merchant for any good or service other than those goods offered or services rendered by the Merchant in accordance with its business license and the activities licensed and authorized by the applicable authorities in the Territory. 4.1.3 Notwithstanding the requirement of observing the Floor Limit, the Merchant shall accept Payment Transactions irrespective of value. The Merchant shall not announce or pre-set any rule to accept a minimum or maximum value for any Payment Transaction, other than the Floor Limit. 4.1.4 The Merchant shall ensure to have the Card swiped or inserted into the POS Terminal for all Payment Transactions at the time of initiating any Authorization. 4.1.5 If a Payment Transaction is initiated using the Card which is issued by an Issuer outside the Territory for an amount in Bahraini Dinar, the Merchant should, but shall not be obliged to, verify the identity of the Cardholder, record details of the Cardholder’s identification document on the POS Record, obtain a photo copy of such documents and retain copies of the documents for presentation to AUB upon demand. 4.1.6 The Merchant shall not split a Payment Transaction by initiating multiple Authorizations at any given time. The Merchant acknowledges that splitting a Payment Transaction into multiple Authorizations may result in the Issuer’s rejection of any or all Payment Transactions made and AUB shall be entitled to debit the value of the rejected Payment Transactions including all expenses related thereto from the Merchant’s Bank Account holding Sale Proceeds. 4.1.7 Details of all Payment Transactions Authorized by the Merchant shall be made available to AUB within a maximum period of seven (7) calendar days from AUB’s request. 4.1.8 The value of the Payment Transaction shall be reduced in accordance with any discount that is offered by the Merchant on the sale of its goods and services.
