Preconstruction Phase Compensation. The Design-Builder’s compensation for Preconstruction Work performed during the Preconstruction Phase shall be an amount equal to: (a) The Fully Loaded Hourly Rates for the personnel performing the Preconstruction Work (at the rates provided in the DBA exhibit referred to at clause (a) of Section 15 (NTE Amount) of this Design- Build Agreement Term Sheet), multiplied by the number of hours worked by such personnel on the Preconstruction Work; plus (b) Payment for documented out-of-pocket reimbursable expenses reasonably incurred in performing Preconstruction Work (to the extent such types of expenses are included in the DBA exhibit referred to at clause (b) of Section 15 (NTE Amount) of this Design- Build Agreement Term Sheet); plus (c) Payment for documented out-of-pocket reimbursable expenses reasonably incurred in establishing and maintaining a Project office at which the Authority personnel and consultants will be co- located (to the extent such types of expenses are included in the DBA exhibit referred to at clause (c) of Section 15 (NTE Amount) of this Design-Build Agreement Term Sheet); provided that in no event shall the Preconstruction Phase compensation exceed the Preconstruction Phase NTE Amount agreed by the parties prior to DBA execution. The hourly rates for Preconstruction Work established as of the Effective Date (described in clause (a) of Section 15 (NTE Amount) of this Design- Build Agreement Term Sheet above) may be adjusted only with the approval of the Authority on an annual basis to the extent appropriate to reflect annual base salary increases for the roles enumerated, not to exceed 5% per year. The Design-Builder shall not change the categorization of an individual performing Preconstruction Work on the relevant exhibit due to a promotion of such individual without first obtaining the written approval of the Authority.
Preconstruction Phase Compensation. CMAR shall be paid for preconstruction services, as described in Section 4.1, prior to moving to GMP.

  • Preconstruction Phase The Preconstruction Phase shall mean the period commencing on the date of this CM/GC Contract and ending upon commencement of the Construction Phase; provided that if the Owner and CM/GC agree, the Construction Phase may commence before the Preconstruction Phase is completed, in which case both phases shall proceed concurrently, subject to the terms and conditions of the Contract Documents.

  • Preconstruction Phase Services The CM/GC agrees to provide all of the Preconstruction Phase Services described below on an ongoing basis in support of, and in conformance with, the time frames described in the Request for Proposals. Commencement of the Construction Phase shall not excuse CM/GC from completion of the Preconstruction Phase Services, if such services have not been fully performed at commencement of the Construction Phase. Preconstruction Phase Services shall include CM Services performed during the Preconstruction Phase.

  • COMPENSATION FOR CONSTRUCTION PHASE SERVICES 5.1 For the Construction Manager’s performance of the Work as described in Section 2.3, the Owner shall pay the Construction Manager the Contract Sum in current funds. The Contract Sum is the Cost of the Work as defined in Section 6.1.1 plus the Construction Manager’s Fee.

  • Construction Phase Fee Contractor’s Construction Phase Fee is the maximum amount payable to Contractor for any cost or profit expectation incurred in the performance of the Work that is not specifically identified as being eligible for reimbursement by Owner elsewhere in this Agreement. References in the UGSC to Contractor’s “overhead” and “profit” mean Contractor’s Construction Phase Fee. The Construction Phase Fee includes, but is not limited to, the following items:
