Project Use. Grantee was awarded this Agreement based on representations in its grant application regarding the Project’s intended use. If the Project is a capital project, Grantee hereby commits to continued use of the Project for the purposes stated in its application for a period of at least five years after completion of construction. SANDAG may require Grantee to refund SGIP funding provided for the Project in the event Grantee fails to utilize the Project for its intended purposes as stated in the grant application or for any disallowed costs.
Project Use. A special projects shift may be assigned to those employees working on plant maintenance, construction and head end work. On a project by project basis, a 4:00 hours to 12:00 hours shift may be scheduled.
Project Use. The Project Site will be developed and used for Park Purposes. In accordance with Section B.10 of the General Provisions of the Master Contract, if the use of the Project Site changes to a use that is not for park purposes, or if the Project Site is sold or otherwise disposed of, Urban Tilth shall pay to the County the Reimbursement. The “Reimbursement” is an amount that is equals to the amount the County would be obligated to repay EBRPD pursuant to section B.10 of the General Provisions of the Master Contract. Urban Tilth shall pay the Reimbursement to the County within (30) days of a demand from the County. The County shall use the Reimbursement to either make capital improvements related to park and recreation facilities in accordance with an agreement between the County and EBRPD, or to reimburse the Project Award to EBRPD.
Project Use. City was awarded this Agreement based on representations in City’s grant application regarding the Project’s intended use. If the Project is a capital project, Grantee hereby commits to continued use of the Project for the purposes stated in City’s application for a period of at least five (5) years after completion of construction. SANDAG may require Grantee to refund Extension Ordinance assistance provided for the Project in the event Grantee fails to utilize the Project for its intended purposes as stated in the grant application.
Project Use. Grantee was awarded this Agreement based on representations in its Grant application regarding the Project’s intended use. CCF may require Grantee to refund Grant funding provided for the Project in the event Grantee fails to use the Project for its intended purposes as stated in the Grant application or for any disallowed costs.
Project Use. Subject to applicable statutory and land requirements, Developer may convert any part of the Project Land into a different use than as approved in the Development Plan or the Project Plan, or sell some or all of the buildings or Project Land at any point in the future, all as provided by this Agreement.
Project Use. The Company will not make any material change in the intended use of the Project unless the Trustee and the Issuer receive an Opinion of Tax Counsel to the effect that such change will not impair the exclusion of interest on the Bonds from the gross income of the owners of the Bonds for federal income tax purposes.
Project Use. Subject to applicable statutory requirements, Developer may convert and sell some or all of the apartments into condominiums at some point in the future. Any such sale might include a sale of the Parking Facilities to the condominium owners but shall in no way reduce the availability of public parking in the Parking Facilities pursuant to Section 4.7 below.
Project Use. Except to the extent authorized by OCII in writing, the Project Property shall be used during the term of the Ground Lease only for residential purposes and ancillary uses.
